Acceptance of Recommendation to Develop a Regulatory Proposal to Reduce Mercury Emissions

   On August 9, 2004, the Environmental Quality Board (Board) received a rulemaking petition submitted on behalf of the Citizens for Pennsylvania's Future (PennFuture), PennEnvironment, Pennsylvania Federation of Sportsmen's Clubs, Pennsylvania NOW, Pennsylvania State Building and Construction Trades Council, Pennsylvania Trout, Planned Parenthood Pennsylvania Advocates, Sierra Club Pennsylvania Chapter, Women's Law Project, WomenVote PA and an additional 39 copetitioners requesting the Board adopt regulations to reduce mercury emissions from electric utilities located in this Commonwealth. This petition was accepted by the Board in October 2004 (See 34 Pa.B. 5992 (October 30, 2004)).

   Based on an analysis prepared by the Department of Environmental Protection (Department) and on comments received from the petitioners, the Department recommended that rulemaking to reduce mercury emissions be developed for the Board's consideration and that during the development of the regulatory proposal, the Department confer with various stakeholders, including, but not limited to, Pennsylvania Chamber of Business & Industry, Pennsylvania Chemical Industry Council, Associated Petroleum Industries of Pennsylvania, Pennsylvania Manufacturers Association, Industrial Energy Users of Pennsylvania, Electric Power Generation Association, Pennsylvania Coal Association, United Mine Workers of America, Air Quality Technical Advisory Committee, theCitizens Advisory Council, the petitioners and other representatives of the regulated community. The Board accepted the Department's recommendation on August 16, 2005.
