   47-00001B: PPL Montour LLC (P. O. Box 128, Washingtonville, PA 17884) for the installation of flue gas desulfurization systems on two bituminous coal-fired electric utility boilers (Units 1 and 2) and the construction of two 500 horsepower diesel-fired engines at the Montour Steam Electric Station in Derry Township, Montour County.

   A Title V operating permit (No. 47-00001) has been issued for this facility.

   The proposed flue gas desulfurization systems will have the ability to remove 70% to 97% of the SOx generated by the respective boilers, depending upon boiler load. This will not however necessarily result in a 70% to 97% reduction in the current level of SOx emissions from the respective boilers (126,978.1 tons in 2004 for both boilers combined) due to the fact that the existence of the flue gas desulfurization systems will allow the use of higher sulfur coal in the boilers than can currently be used.

   No change is expected in the emission rate of any other air contaminant from the boilers as a result of the flue gas desulfurization system installations.

   PPL Montour LLC will also be constructing a new exhaust stack for the boilers, the exit of which will be no less than 540 feet above grade.

   The air contaminant emissions from the proposed 500 horsepower diesel-fired engines are not expected to exceed 3.8 tons of NOx, 1.1 tons of CO, .56 ton of total hydrocarbons, .42 ton of SOx and .22 ton of particulate matter, including PM10 per year.

   The Department of Environmental Protection's (Department) review of the information submitted by PPL Montour LLC indicates that the boilers should comply with applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants following the installation of the proposed flue gas desulfurization systems. Likewise, the Department has determined that the proposed diesel-fired engines should comply with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants, including the best available technology provision of 25 Pa. Code §§ 127.1 and 127.12. Based on these findings, the Department proposes to issue plan approval for the installation of the flue gas desulfurization systems on the respective boilers as well as for the construction of the proposed diesel-fired engines. Additionally, if the boilers and flue gas desulfurization systems are subsequently determined by the Department to be operating in compliance with all applicable plan approval conditions and regulatory requirements following flue gas desulfurization system installation and if the diesel-fired engines are also subsequently determined by the Department to be operating in compliance with all applicable plan approval conditions and regulatory requirements following their construction, the conditions of the plan approval will be incorporated into Title V Operating Permit 47-00001 by means of administrative amendment in accordance with the requirements specified in 25 Pa. Code § 127.450.

   The following is a summary of the conditions the Department proposes to place in the plan approval to be issued to ensure compliance with all applicable requirements.

   1.  The emission of SOx (expressed as sulfur dioxide) from Unit 1 shall not exceed .85 pound per million Btu of heat input (3-hour block average) once a flue gas desulfurization system has been installed on Unit 1.

   2.  The emission of SOx (expressed as SO2) from Unit 2 shall not exceed .85 pound per million Btu of heat input (3-hour block average) once a flue gas desulfurization system has been installed on Unit 2.

   3.  Following the installation of a flue gas desulfurization system on Unit 1 or Unit 2, the respective boiler shall exhaust to the atmosphere at a height of no less than 540 feet above grade. Additionally, the inside diameter of the flue for each of these two units shall be no greater than 30.68 feet at the point of exhaust.

   4.  The permittee shall install, certify, maintain and operate continuous monitoring systems for NOx emissions (expressed as NO2) and sulfur oxides emissions (expressed as SO2) and volumetric flow on the exhaust of Unit 1 and on the exhaust of Unit 2 in accordance with all applicable requirements specified in 25 Pa. Code Chapter 139 and the Department's ''Continuous Source Monitoring Manual.''

   5.  The continuous emission monitoring and flow monitoring systems associated with each of the two units (Units 1 and 2) shall be installed and capable of operation before startup of the flue gas desulfurization system on the respective unit and before the respective unit is exhausted to the atmosphere through its new stack. No new continuous emission monitoring system or flow monitoring system may however be installed unless Phase I approval has first been obtained from the Department.

   6.  The permittee shall submit a Phase I application to the Department for all new continuous emission and flow monitoring systems to be associated with each of the two units (Unit 1 and Unit 2) at least 6 months before the startup of the flue gas desulfurization system on the respective unit.

   7.  The NOx and SOx emission monitoring systems shall be capable of monitoring the NOx and SOx emission rates expressed in pounds per million btu of heat input as well as in pounds per hour. They shall also be capable of monitoring the total emission of the respective air contaminant from the respective unit in any 12-consecutive month period (expressed in tons per year).

   8.  Neither Unit 1 nor Unit 2 shall be exhausted to the new stack for any reason unless the NOx and SOx continuous emission monitoring systems and flow monitoring system associated with the respective unit has received Phase I approval from the Department and has subsequently been installed and made operational in accordance with the conditions of this plan approval. Furthermore, the continuous emission monitoring systems and flow monitoring system associated with each unit shall be operated in accordance with all applicable requirements specified in 25 Pa. Code Chapter 139, as well as with all the applicable requirements specified in the Department's ''Continuous Source Monitoring Manual,'' any time the respective unit is operating.

   9.  Relative accuracy testing shall be completed on the continuous emission monitoring systems and flow monitoring system associated with a unit, and the respective monitoring systems shall be fully certified, in accordance with all applicable requirements specified in the Department's ''Continuous Source Monitoring Manual'' within 180 days of startup of the flue gas desulfurization system on the respective unit.

   10.  The air contaminant emissions from each of the diesel-fired engines shall not exceed 6.9 grams of NOx (expressed as NO2) per brake horsepower-hour and 1.9 tons in any 12-consecutive month period, 2.0 grams of CO per brake horsepower-hour and .55 ton in any 12-consecutive month period, 1.0 gram of total hydrocarbons per brake horsepower-hour and .28 ton in any 12-consecutive month period, and .4 gram of particulate matter, including PM10 per brake horsepower-hour and .11 ton in any 12-consecutive month period.

   11.  Each diesel-fired engine shall not be operated more than 500 hours in any 12-consecutive month period.

   12.  The diesel engines shall only be fired on virgin diesel fuel or No. 2 fuel oil to which no reclaimed or reprocessed oil or other waste materials have been added. Additionally, the sulfur content shall not, at any time, exceed .2% (by weight).

   13.  The permittee shall maintain comprehensive and accurate records of the number of hours that each diesel-fired engine operates each month as well as the amount and type of fuel used in each diesel-fired engine each month.

   14.  Within 15 days of the selection of specific diesel-fired engines to be constructed at this site, the permittee shall submit specifications for the engines to the Department as well as vendor-supplied, unit-specific air contaminant emission data for the engines.

OPERATING PERMITS

   23-00071: Giant Construction, Inc. (260 Bridgewater Road, Aston, PA 19014) for a Non-Title V Facility, State-only, Natural Minor Permit in Montgomery Township, Montgomery County. The source of emissions is a concrete plant with a filter vent. Monitoring, recordkeeping and reporting requirements have been added to the permit to address applicable limitations.

   46-00100: Moyco Precision Abrasives (200 Commerce Drive, Montgomeryville, PA 18936) for a Non-Title V Facility, State-only, Synthetic Minor Permit in Montgomery Township, Montgomery County. The sources of emissions are space heaters, surface coating operations and thermal oxidizer. The facility has a potential to emit VOCs. Monitoring, recordkeeping and reporting requirements have been added to the permit to address applicable limitations.

   15-00077: Hanson Aggregrates--Downingtown formerly Milestone Materials (1609 Sullivan Trail, Easton, PA 18044) for a Non-Title V Facility, State-only, Natural Minor Permit in East Caln Township, Chester County. The source of emissions is a stone crushing plant consisting of crushers, screens, conveyors, baghouses and wet suppression system. Monitoring, recordkeeping and reporting requirements have been added to the permit to address applicable limitations.

   40-00034:  Schott Glass Technologies, Inc.--Duryea Plant (400 York Avenue, Duryea, PA 18642) for operation of nine continuous melting furnaces, melting pots, presses, silos, space heaters, water heaters, various bins and their associated air-cleaning devices at their facility in Duryea, Luzerne County. The major emission is of NOx. This action is for the Title V Operating Permit to be issued.

   08-00003:  CraftMaster Manufacturing, Inc. (Shiner Road, P. O. Box 311, Towanda, PA 18848) for their facility in Wysox Township, Bradford County. The respective facility is a major facility for which a Title V operating permit (TVOP 08-00003) has been issued. Under 25 Pa. Code §§ 127.521 and 127.541 (Significant Operating Permit Modification), the Department of Environmental Protection (Department) intends to issue a revised Title V operating permit incorporating the requirements of the following plan approvals: 08-302-039, 08-00004A, 08-316-014, 08-318-024A and 08-316-013A. The plan approvals have been issued for the construction or modification of the following sources: construction of a 242.4 mmBtu/hr wood/natural gas fired boiler and associated multicyclone, electrostatic precipitator and wood fuel handling equipment, a throughput increase to coating line No. 2, increased production from the die form press, construction of a resin blending facility and associated fabric collector and two cyclones and modification of the line No. 2 press to allow for the production of trimboard affecting the board saws, board-forming line and lap siding surface coating line. The revision also incorporates the following insignificant emissions sources exempted from the Department's plan approval requirements: two-side sander; trim surface coating brush machine and associated fabric collector; a die form coating wetting booth; an A-1 tool machine; and associated brush machine. There is no increase in air contaminant emissions as a result of this significant operating permit modification.

   40-00091: America's Body Co., Inc. (275 West Union Street, Nanticoke, PA 18634) for motor vehicle and car painting plant in the City of Nanticoke, Luzerne County. The facility's main sources of emissions include two spray paint booths and one spray gun parts washer. The potential to emit PM, VOCs, HAPs, NOx, SOx and CO are below the major emission thresholds. The proposed operating permit contains all applicable requirements including Federal and State regulations. In addition, monitoring, recordkeeping and reporting conditions regarding compliance with all applicable requirements are also included.

   18-00025: Moriarty-Dutcavich Funeral Home (112 East Church Street, Lock Haven, PA 17745) for operation of a crematory facility in the City of Lock Haven, Clinton County.

   The crematory facility incorporates a crematory incinerator in which human remains are incinerated. The incinerator is equipped with an integral secondary combustion chamber which is used to minimize air contaminant emissions. The air contaminant emissions from this facility are not expected to exceed 1.09 tons of NOx, .16 ton of CO, .36 ton of SOx, .038 ton of total organic compounds and .036 ton of particulate matter including PM10 per year.

   The respective facility is not a major (Title V) facility for any air contaminant.

   The Department of Environmental Protection proposes to incorporate into the operating permit to be issued conditions requiring compliance with all applicable regulatory requirements pertaining to air contamination sources and the emission of air contaminants as well as conditions previously existing in Operating Permit 18-301-009. These previously-existing conditions include a particulate matter emission limitation of .08 grain per dry standard cubic foot of effluent gas (corrected to 7% oxygen), a condition prohibiting the incineration of anything other than human remains and associated containers, a condition requiring a secondary combustion chamber temperature of at least 1,800 F upon any occasion when the incinerator is in use and a condition requiring the secondary combustion chamber temperature to be continuously monitored and recorded whenever the incinerator is in use.

COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of an application is available for inspection at the district mining office indicated before an application. Where a 401 Water Quality Certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for certification.

   Written comments, objections or requests for informal conferences on applications may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the district mining office indicated before an application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34.

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. NPDES permits will contain, at a minimum, technology-based effluent limitations as identified in this notice for the respective coal and noncoal applications. In addition, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit, when necessary, for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies who have requested review of NPDES permit requirements for a particular mining activity within the previously mentioned public comment period will be provided with a 30-day period to review and submit comments on the requirements.

   Written comments or objections should contain the name, address and telephone number of the person submitting comments or objections; the application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor wishes to have the conference conducted in the locality of the proposed mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

   The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (Department). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the State to certify that the involved projects will not violate the applicable provisions of sections 301--303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311--1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA or to the issuance of a Dam Permit, Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment must submit comments, suggestions or objections within 30 days of the date of this notice, as well as questions, to the regional office noted before the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

   The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Individuals will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. To replace an existing bridge in Jenner Township, Somerset County, Pittsburgh ACOE District (Boswell, PA Quadrangle N:  4.1 inches; W:  5.9 inches and Latitude: 40° 08` 51"--Longitude: 79° 02` 33"). The applicant proposes to remove the existing structure and to construct and maintain a bridge having a normal clear span of 68.09 feet and an underclearance of 10.35 feet across Quemahoning Creek (CWF) located on SR 0030, Section 010, Segment 0110, Offset 0000. The project includes construction of a temporary bridge having a clear span of 76 feet and an underclearance of 13.9 feet.

FINAL ACTIONS TAKEN FOR NATIONAL POLLUTION DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS

   The Department of Environmental Protection (Department) has taken the following actions on previously received applications for new, amended and renewed NPDES and WQM permits, applications for permit waivers and Notices of Intent (NOI) for coverage under general permits. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92 and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P. S. §§ 691.1--691.1001) and the Federal Clean Water Act.

   Sections I--VI contain actions related to industrial, animal or sewage wastes discharges, discharges to groundwater and discharges associated with municipal separate storm sewer systems (MS4), stormwater associated with construction activities and concentrated animal feeding operations (CAFOs). Section VII contains notices for parties who have submitted NOIs for coverage under general NPDES permits. The approval for coverage under general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in each general permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective permit. Permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

   Persons aggrieved by an action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law), to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed with the Board within 30 days of publication of this notice in the Pennsylvania Bulletin, unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary of the Board at (717) 787-3483. This paragraph does not, in and of itself, create any right of appeal beyond that permitted by applicable statutes and decision law.

   For individuals who wish to challenge an action, appeals must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
