Medical Malpractice Increased Limits Capacity Study for Health Care Providers; Request for Public Comments

 Under section 711(d)(3) of the Medical Care Availability and Reduction of Error (MCARE) Act (act) (40 P. S. § 1303.711(d)(3)), the Insurance Commissioner (Commissioner) is conducting a study regarding the availability of additional basic insurance coverage capacity in the medical malpractice marketplace for health care providers, as the providers are defined in section 103 of the act (40 P. S. § 1303.103).

 Earlier this year, the Insurance Department (Department) issued a data call to insurers to collect information relative to the capacity in the marketplace for the increased limits and the impact of the various reforms enacted over the last 9 years.

 As a part of this review, the Commissioner is soliciting public comments regarding the provision to increase the basic limits of insurance for participating health care providers from their current level of $500,000 per occurrence or claim and $1,500,000 per annual aggregate ($2,500,000 for hospitals) to $750,000 per occurrence or claim and $2,250,000 per annual aggregate ($3,750,000 for hospitals) effective January 1, 2012. While the Commissioner's decision must be based upon the evaluation of basic insurance coverage capacity, the Department offers all interested parties the opportunity to comment on this important topic.

 Interested parties are invited to submit written comments on this matter to Michael McKenney, Insurance Department, Insurance Product Regulation, 1311 Strawberry Square, Harrisburg, PA 17120, mmckenney@state.pa.us within 30 days after publication of this notice in the Pennsylvania Bulletin.
