NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P. O.  On May 10, 2012, the Southeast Regional Office approved the Act 537 Plan Update entitled Western Delaware County Act 537 Plan Update for the Chester-Ridley Creek Service Area. The plan approval affects Aston Township, Brookhaven Borough, Chester Township, Chester Heights Borough, the City of Chester, Edgmont Township, Middletown Township, Upper Chichester Township and Upper Providence Township. The Update provides for the following:

 The Southwest Delaware County Municipal Authority (''SWDCMA'') Baldwin Run Pollution Control Plant (''BRPCP'') will be decommissioned.

 A sewage pumping station and a force main will be constructed on the BRPCP property and will convey sewage flows from the SWDCMA Chester-Ridley Creek Service Area to the Delaware County Regional Water Control Authority (''DELCORA'') Western Regional Treatment Plant (''WRTP''), as shown by Alternative No. 2-C on Figure 6-1 in the Plan. The pumping station will have average design flows of 6.66 million gallons per day (''MGD''). SWDCMA will continue to address inflow and infiltration (I/I) through its I/I abatement program.

Plan Description: The Plan evaluated alternatives to address the deteriorated condition of the existing wastewater collection system within the Roamingwood study area and to alleviate excessive rainfall derived infiltration and inflow (I/I), which is transported to the existing wastewater treatment plant. The recommendation of the Plan involves replacement of the existing wastewater collection system with the construction of a low pressure sewer system, including grinder pumps at each existing property. Sewage will continue to be treated at the existing wastewater treatment plant. The Plan specifies that this construction will be accomplished by South Wayne County Water & Sewer Authority through two separate project stages.

Plan Description: The approved plan provides for the extension of sanitary sewer collection service to the areas of Homer's Gap, Grandview, Bloom Road, Hope Lane, Kittanning Point Rd., Red Hill and Rose Hill. The project will serve existing single family homes and will produce 85,000 gallons per day of sewage flow. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal. Any required NPDES Permits or WQM Permits must be obtained in the name of the municipality or authority as appropriate.

LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 2


The following plans and reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Provisions of Sections 301—308 of the Land Recycling and Environmental Remediation Standards Act (act) (35 P. S. §§ 6026.301—6026.308) require the Department to publish in the Pennsylvania Bulletin a notice of submission of plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected. Submission of plans and reports, other than the final report, will also be published in the Pennsylvania Bulletin. These include the remedial investigation report, risk assessment report and cleanup plan for a site-specific standard remediation. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements.

LAND RECYCLING AND
ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

Therefore, the facility is subject to the Title V Operating Permit requirements adopted in 25 Pa. Code Chapter 127, Subchapter G. The facility is also subject to the Compliance Assurance Monitoring Rule (CAM) found in 40 C.F.R. Part 64. Appropriate permit conditions to address the applicable CAM requirements have been included in the permit. The diesel generators and emergency generators are subject to 40 CFR Part 60, Subpart ZZZZ. The applicable conditions of Utility MACT 40 CFR Part 63, Subpart UUUUU has included in the Source level of Boilers as group.

 The acid rain permit will be issued along with the renewal permit. The initial Acid Rain permit was issued on December 24, 1997, and revised on January 13, 1999, was reissued on January 23, 2003. The permit expires on December 31, 2007. The facility applied for a modification of the existing Title V Operating permit to include an Acid Rain permit for January 1, 2008 through December 31, 2012. The renewal acid rain permit will be valid from January 2011 to December 2016. GenOn Power Midwest LP—New Castle Power Plant air emission sources are three coal-fired boilers. The facility, because the boilers are listed in Table 2 (Phase II Allowance Allocations) of 40 CFR 73.10, is a Title IV facility and is therefore subject to the Acid Rain requirements adopted in 25 Pa. Code Chapter 127, Subchapter G.

Project Description: The Pennsylvania Infrastructure Investment Authority, which administers the Commonwealth's State Revolving Fund, is intended to be the funding source for this project. Redbank Valley Municipal Authority (RVMA) proposes to install a standby generator for the operation of equipment at the Water Treatment Plant (WTP). RVMA has an electric service agreement with the power company to provide 60 cycle, three phase, 480 volt electric power to the WTP. The WTP needs three (3) phase power to operate the major components of the system including the filters, raw water pumps, control valves and high service pumps. The RVMA has experienced a problem with losing phases at the WTP. The Department's review of the project and the information received has not identified any significant, adverse environmental impact resulting from this proposal. The Department hereby categorically excludes this project from the State Environmental Review Process.

 Under 25 Pa. Code § 92a.83 notice is hereby given that the Department of Environmental Protection (DEP) will hold a public hearing from 6:30-8:30 PM on Wednesday, June 27, 2012 at the Homer-Center High School, 70 Wildcat Lane, Homer City, PA 15748.

 The hearing is to take testimony concerning the Department's intent to issue an NPDES permit amendment to EME Homer City Generation, LP for discharges associated with the proposed coal combustion waste landfill expansion treatment facilities, cooling tower blowdown, and make-up water treatment system. The Department published a separate notice of intent to issue this NPDES permit amendment in the Pennsylvania Bulletin to allow for public comments regarding the proposed NPDES permit amendment.

 The receiving streams are an Unnamed Tributary of Blacklick Creek, Unnamed Tributary of Muddy Run, Unnamed Tributary of Two Lick Creek all classified as Cold Water Fishes, aquatic life, water supply and recreation and Two Lick Creek, classified as Trout Stocking, aquatic life, water supply and recreation. All streams are located in State Water Plan watershed 18-D. The discharge is not expected to affect public water supplies.
