FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704. The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. The amount of wetland impact is considered a deminimus impact of 0.01 acre and wetland mitigation is not required.

 To construct and maintain: 1) 2,600 linear feet of 18-foot wide cartway and accompanying parallel storm water system that create a net cut of 187 cubic yards of fill in the left 100-year FEMA floodway of the West Branch Susquehanna River; 2) 441 square foot impact to wetlands as a result of the road construction and associated stormwater outfalls; 3) replace an existing 36-foot long by 36-inch culvert with a 77-foot long by 53-inch by 34-inch elliptical reinforced concrete pipe culvert and all of which is located between the Avis exit of SR 220 and the Village of South Avis. This permit also includes 401 Water Quality Certification.

E41-639. Pennsylvania Department of Transportation, Engineering District 3-0, PO Box 218 Montours-ville, PA 17754-0218. S.R. 0864 Section 007 Mill Creek Slope Failure Repair, Upper Fairfield Township, Lycoming County, ACOE Baltimore District (Montours-ville North, PA Quadrangle N: 41° 17` 25"; W: -76° 52` 35").

 PA DOT Engineering District 3-0 proposes to repair the roadway side slope adjacent to Mill Creek. The repair will consist of 1.5:1 Rip Rap slope protection for approximately 655 Ft. Approximately 736 Linear Feet of Mill Creek will be relocated to accommodate the Rip Rap slope. Project mitigation will include upstream log deflectors and riparian plantings. The log deflectors will help to create some fish habitat as well as streambank stabilization. The project will not impact any jurisdictional wetlands and does not require mitigation. Mill Creek is classified as Trout Stream Fishery by Title 25, Chapter 93 Water Quality Standards. The project will require mitigation. This permit also includes 401 Water Quality Certification.

 Applicant has been given consent to place and maintain fill in approximately 0.065 acre of wetlands (PEM) on the left bank of the Ohio River (WWF, N) for the purpose of constructing an Independent Spent Fuel Storage Installation Facility. The project is located approximately 2,300.0 feet downstream from the intersection of SR 168 and the Conrail Tracks (Hookstown, PA Quadrangle N: 21.94 inches; W: 8.48 inches; Longitude: 40° 37` 15"; Latitude: 80° 26` 10") in Shippingport Borough, Beaver County. The permittee shall construct 0.07 acre of replacement wetlands.

E61-08-001, Laurel Mountain Midstream Operating, LLC, Westpointe Corporate Center Three, 1605 Coraopolis Heights Road, Moon Township, Pa 15108.  3) two 6-inch waterlines impacting 39 linear feet of Beaver Run (CWF, MF) and 4418 square feet of adjacent EV palustrine scrub-shrub (PSS) wetland (Sonestown PA Quadrangle 41°16`55"N, 77°35`50"W).

 The project will result in a total of 175 linear feet of stream impacts and 0.10 acre of wetland impacts all for the purpose of installing water pipeline and associated access roadways for Marcellus well development.

 2. a 12 inch diameter natural gas line, a 16 inch diameter water line and a timber mat bridge impacting 4,657 square feet of a Palustrine Emergent Wetland (PEM) (Rome, PA Quadrangle, Latitude: 41°49`24", Longitude: -76°18`05");

 3. a 12 inch diameter natural gas line, a 16 inch diameter water line and a timber mat bridge impacting 2,045 square feet of a Palustrine Emergent Wetland (PEM) (Rome, PA Quadrangle, Latitude: 41°49`18", Longitude: -76°18`00");

 4. a 12 inch diameter natural gas line, a 16 inch diameter water line and a timber mat bridge impacting 23,323 square feet of a Palustrine Forested Wetland (PFO) (Rome, PA Quadrangle, Latitude: 41°49`16", Longitude: -76°17`56");

 The project will result in 16,572 square feet (0.38 acre) of temporary PEM wetland impacts and 23,323 (0.54 acre) of conversion impacts to a PFO wetland all for the purpose of installing a natural gas pipelines and a water line with associated access roadways for Marcellus shale development in Orwell and Herrick Township, Bradford County. The permittee will provide 0.75 acre of enhancement mitigation to a PEM wetland along Benet Creek in Stevens Township, Bradford County (Le Raysville, PA Quadrangle 41°45`06"N 76°10`30"W).

[Permit #E26-07-004] Caiman Penn Midstream, LLC, 5949 Sherry Lane, Suite 1300, Dallas, Texas 75225-8008. This project starts at the Fike Facility Pad on the Friendsville, PA Quadrangle at N 20 1/2 inches and W 3 1/4 inches (39° 43` 36.14", -79° 29` 35.99") and ends on the Brandonville, PA Quadrangle at N 25 inches and W 15 7/8 inches at the Polk Facility Pad (39° 44` 45.66", -79° 31` 42.93"). The pipeline passes through Henry Clay and Wharton Townships in Fayette County, PA, Pittsburgh ACOE District, State Water Plan Basin 19G, Upper Monongahela River Watershed. The Polk to Fike Pipeline Project includes the construction of approximately 21,000 feet of 12" gas gathering line with a 60 foot Right of Way (ROW), two surface sites, and five access roads. The Project has 10 stream and 3 wetland crossings of Fike Run (HQ-CWF) and unnamed tributaries to Fike Run (HQ-CWF). The 10 stream crossings consist of 270 linear feet and 1,213 square feet of temporary disturbance. The crossings will be a combination of flume pipe diversions for the utility line crossings and temporary mobile bridges for the temporary access roads. The wetland crossings consist of 1,853 square feet of temporary disturbance. Two (2) wetlands crossings will be HDD bores and one crossing will utilize an open trench with timber mats. The total disturbance for this project is 35.1 acres. This pipeline crosses from PA into WV at latitude 39° 43` 16.21" and longitude -79° 30` 53.66".

 To reclaim a portion of an abandoned mine cut by placing fill material. There are no wetlands in the project area, and the mine cut has no outlet to any waters of the Commonwealth. The project purpose is to reduce public health and safety risks associated with this abandoned mine. The information submitted appears to meet the environmental parameters indicated in the Environmental Assessment published in the Pennsylvania Bulletin on December 14, 1996, for abandoned mine reclamation activities. OIL AND GAS MANAGEMENT

 The following Well Permits have been issued with a waiver under 58 Pa.C.S. § 3215(b)(4) (relating to well location restrictions).

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be send to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, PO Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users may contact the Board through the Pennsylvania Relay Service, (800) 654-5984. Appeals must be filed which the Board within 30 days of publication of this notice in the Pennsylvania Bulletin unless the appropriate statute provides a different time period. Copies of the appeal form and the Board's rules of practice and procedure may be obtained from the Board. The appeal form and the Board's rules of practice and procedure are also available in Braille or on audiotape from the Secretary to the Board at (717) 787-3483. This paragraph does not in and of itself create a right of appeal beyond that permitted by applicable statutes and decisional law.

 For individuals who wish to challenge an action, the appeal must reach the Board within 30 days. A lawyer is not needed to file an appeal with the Board.
