 On October 11, 2011, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Health (Department). This rulemaking deletes 28 Pa. Code Chapters 1001 to 1015 and adds Chapters 1021 to 1033. The proposed regulation was published in the October 29, 2011 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on July 16, 2013.

 This regulation implements Act 37 of 2009, known as the Emergency Medical Services System Act.

 We have determined this regulation is consistent with the statutory authority of the Department (35 Pa.C.S.A. § 8105(b)(11)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

State Board of Pharmacy—
Cancer Drug Repository Program;
Regulation No. 16A-5423 (#2889)

 On March 2, 2011, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Pharmacy (Board). This rulemaking amends 49 Pa. Code Chapter 27 by adding §§ 27.501—27.506. The proposed regulation was published in the March 12, 2011 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on April 8, 2013. At its May 16, 2013 public meeting, the Commission voted to disapprove the final-form regulation. On July 24, 2013, the Board submitted its report containing the revised final-form regulation to the Commission.

 This final-form rulemaking establishes the Cancer Drug Repository Program as required by the Cancer Drug Repository Act of 2008. 62 P. S. § 2921—2927.

 We have determined this regulation is consistent with the statutory authority of the Board (62 P. S. §§ 2923 and 2927 and 63 P. S. § 390-6(k)(9)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
