Regulated Medical and Chemotherapeutic Waste—
Environmental Quality Board;
Regulation No. 7-480 (#3017)

 On August 5, 2013, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Environmental Quality Board (EQB). This rulemaking amends 25 Pa. Code Chapters 271, 272, 273, 284, 285, 287, 288 and 299. The proposed regulation was published in the August 24, 2013 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on August 29, 2014.

 This final-form regulation updates the Department of Environmental Protection's regulated medical and chemotherapeutic waste provisions to make them consistent with federal requirements, including clarifying and streamlining the storage, transportation and shipment requirements for regulated medical waste; allowing the use of electronic tracking systems to record the proper processing and disposal of regulated medical waste; and allowing the transportation of regulated medical waste through the United States Postal Service.

 We have determined this regulation is consistent with the statutory authority of EQB (35 P. S. §§ 6018.102 and 104, 35 P. S. §§ 6019.2(b) and 4(b)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Regulation No. 125-168 (#3003)

 On April 5, 2013, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Pennsylvania Gaming Control Board (Board). This rulemaking amends 58 Pa. Code Subparts B, E, G, I, J and K. The proposed regulation was pub- lished in the April 20, 2013 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on August 13, 2014.

 This regulation is a general update of provisions that address Gaming Junket Enterprises, Accounting and Internal Controls, Compulsive and Problem Gambling, Self-Exclusion, Underage Gaming, Equipment, and Blackjack.

 We have determined this regulation is consistent with the statutory authority of the Board (4 Pa.C.S. § 1202(b)(30)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

Genetic Counselors—
State Board of Medicine;
Regulation No. 16A-4937 (#3034)

 On October 7, 2013, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Medicine (Board). This rulemaking amends 49 Pa. Code Sections 16.11 and 16.13 and adds Sections 18.701 to 18.710. The proposed regulation was published in the October 19, 2013 Pennsylvania Bulletin with a 30-day public comment period. The final-form regulation was submitted to the Commission on June 5, 2014. At its July 10, 2014 public meeting, the Commission voted to disapprove the final-form regulation. On August 29, 2014, the revised final-form regulation was submitted to the Commission.

 This regulation implements Act 125 of 2011 which established licensure and regulation of genetic counselors. The regulation includes fees, provisions for three types of licensure, biennial registration, disciplinary actions, continuing education and professional liability insurance.

 We have determined this regulation is consistent with the statutory authority of the State Board of Medicine (63 P. S. § 422.8) and the intention of the General Assembly. After considering all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
