Under the Pennsylvania Assigned Risk Plan (Plan), Section 64 adopted by the Insurance Commissioner under 75 Pa.C.S. § 1741 (relating to establishment), notice is hereby given that Marianne Cauthorn has requested a hearing to review the Pennsylvania Assigned Risk Plan Governing Committee's (Committee) decision concerning the suspension of her certification by the Plan and has filed a request that the suspension of her certification be stayed pending the final outcome of these proceedings. The proceedings in this matter will be governed by 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law), 1 Pa. Code Part II (relating to General Rules of Administrative Practice and Procedure) and 31 Pa. Code Chapter 56 (relating to Special Rules of Administrative Practice and Procedure).

The request for a stay of the suspension imposed by the Committee is granted and the suspension is stayed pending further order, except that on or before June 30, 2015, Marianne Cauthorn must file with the Administrative Hearings Office documentary evidence that she has completed the Plan online Producer Procedures Course. Failure to comply with this provision will result in the immediate lift of the stay on that date. Furthermore, the stay automatically will be lifted upon receipt of any documentary evidence from the Plan that Marianne Cauthorn has violated any of the Plan Rules at any time after issuance of this Order.

A prehearing telephone conference will be held on July 14, 2015, at 10 a.m. Motions preliminary to those at hearing, protests, petitions to intervene, notices of appearance or notices of intervention, if any, must be filed with the Hearings Administrator at the Administrative Hearings Office, Room 200, Capitol Associates Building, 901 North Seventh Street, Harrisburg, PA 17102, on or before July 2, 2015. Answers to petitions to intervene, if any, shall be filed on or before July 10, 2015.

A date for a hearing shall be determined, if necessary, at the prehearing/settlement telephone conference.

Persons with a disability who wish to attend the previously-referenced administrative telephone conference and require an auxiliary aid, service or other accommodation to participate in the telephone conference should contact Donna R. Fleischauer, Human Resources Director at (717) 705-4194.
