Intellectual Disability Terminology Update
Regulation No. 14-539 (# 3137)

 On April 14, 2016, the Independent Regulatory Review Commission (Commission) received this regulation from the Department of Human Services (Department). This rulemaking amends 55 Pa. Code Chapters 13, 14, 20, 2380, 2390, 2600, 2800, 3800, 4200, 4210, 4215, 4220, 4230, 4300, 4305, 4310, 6201, 6210, 6211, 6250, 6350, 6400, 6500, and 6600. Notice of proposed rulemaking was omitted for this regulation; it will become effective upon publication in the Pennsylvania Bulletin.

 This final-omitted regulation updates the language in 24 chapters of Title 55 (relating to public welfare) to replace the terms ''the retarded,'' ''retarded person,'' ''mentally retarded'' and ''mental retardation'' with the term ''intellectual disability.''

 We have determined this regulation is consistent with the statutory authority of the Department (62 P.S. §§ 201(2), 211, 213, 443.1(2) and (3)) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
