COAL AND NONCOAL MINING ACTIVITY APPLICATIONS

 Applications under the Surface Mining Conservation and Reclamation Act (52 P.S. §§ 1396.1—1396.19a); the Noncoal Surface Mining Conservation and Reclamation Act (52 P.S. §§ 3301—3326); The Clean Streams Law (35 P.S. §§ 691.1—691.1001); the Coal Refuse Disposal Control Act (52 P.S. §§ 30.51—30.66); and The Bituminous Mine Subsidence and Land Conservation Act (52 P.S. §§ 1406.1—1406.20a). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P.S. §§ 4001—4015); the Dam Safety and Encroachments Act (32 P.S. §§ 693.1—693.27); and the Solid Waste Management Act (35 P.S. §§ 6018.101—6018.1003).

 The following permit applications to conduct mining activities have been received by the Department. A copy of the application is available for inspection at the district mining office indicated before each application. Notices of requests for 401 Water Quality Certifications are included in individual application notices, as noted.

 Written comments or objections, or requests for an informal conference, or a public hearing, as applicable, on a mining permit application and request for Section 401 water quality certification application may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the address of the district mining office indicated before each application within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement as provided by 25 Pa. Code §§ 77.121—77.123 and 86.31—86.34.

 Written comments or objections regarding a mining permit application should contain the name, address and telephone number of persons submitting comments or objections, application number and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based.

 A request for an informal conference or a public hearing, as applicable, on a mining permit application, as provided by 25 Pa. Code § 77.123 or § 86.34, must contain the name, address and telephone number of the requestor; the application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

 When an NPDES number is listed, the mining activity permit application was accompanied by an application for an individual NPDES permit. A separate notice will be provided after the draft NPDES permit is prepared.

Coal Applications Received

Cambria District Mining Office: 286 Industrial Park Road, Ebensburg, PA 15931, 814-472-1900.

Permit No. 56160101 and NPDES No. PA0279510. Berwind Coal Sales Co., 509 15th Street, Windber, PA 15963, commencement, operation and restoration of a bituminous surface and auger mine in Paint Township, Somerset County, affecting 159.2 acres. Receiving streams: Weaver Run to Seese Run to Paint Creek/Stonycreek Watershed, classified for the following use: cold water fishes. The first downstream potable water supply intake from the point of discharge is Freeport, PA on Allegheny River. Application received: May 26, 2017.

 The application includes a stream encroachment to utilize an existing stream crossing for haulroad access within the barrier area of unnamed tributary to Weaver Run and a wetland encroachment to mine through and replace 0.1 acre of wetland within the drainage area of Weaver Run.

Permit No. 56090102 and NPDES No. PA0262722, PBS Coals, Inc., 1576 Stoystown Road, P.O. Box 260, Friedens, PA 15541, commencement, operation and restoration of a bituminous surface and auger mine to change the land use from woodland to wildlife habitat in Somerset Township, Somerset County, affecting 83.5 acres. Receiving stream: Wells Creek classified for the following use: cold water fishes. There are no potable water supply intakes within 10 miles downstream. Application received: June 7, 2017.

Permit No. 56900109 and NPDES No. PA0598887, PBS Coals, Inc., 1576 Stoystown Road, P.O. Box 260, Friedens, PA 15541, commencement, operation and restoration of a bituminous surface mine to change the land use from woodland to industrial/commercial on 2.0 acres; woodland to pastureland on 4.6 acres; and pastureland to industrial/commercial on 5.2 acres in Quemahoning and Somerset Townships, Somerset County, affecting 48.2 acres. Receiving stream: Wells Creek classified for the following use: cold water fishes. Fieg Brothers, 3070 Stoystown Road, Stoystown, PA 15563, permit renewal for the continued operation and restoration of a bituminous surface mine in Southampton Township, Somerset County, affecting 318.4 acres. Receiving streams: unnamed tributaries to the North Branch of Jennings Run; unnamed tributary to Rush Run classified for the following uses: cold water fishes and high quality cold water fishes. There are no potable water supply intakes within 10 miles downstream. Application received: June 13, 2017.

MINING ACTIVITY NPDES DRAFT PERMITS

 This notice provides information about applications for a new, amended or renewed NPDES permits associated with mining activity (coal or noncoal) permits. The applications concern industrial waste (mining) discharges to surface water and discharges of stormwater associated with mining activities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (Department) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

*The parameter is applicable at all times.

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code Chapter 77 are pH 6 to 9 and other parameters the Department may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

 In addition to BAT or WQBEL limits, coal and noncoal NPDES permits establish effluent limitations in the form of implemented Best Management Practices (BMPs) identified in the associated Erosion and Sedimentation Plan, the Reclamation Plan and the NPDES permit application. These BMPs restrict the rates and quantities of associated pollutants from being discharged into surface waters in this Commonwealth.

 More restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining that may occur are incorporated into an NPDES permit when necessary for compliance with water quality standards and antidegradation requirements (in accordance with 25 Pa. Code Chapters 91—96).

 The procedures for determining the final effluent limits, using a mass-balance equation or model, are found in Technical Guidance Document 563-2112-115, Developing National Pollutant Discharge Elimination System (NPDES) Permits for Mining Activities. Other specific factors to be considered include public comments and Total Maximum Daily Load(s). Additional discharge limitations may apply in the event that unexpected discharges occur.

 Discharge rates for surface mining activities are precipitation driven. Discharge rates for proposed discharges associated with underground mining are noted in the permit description.

 Persons wishing to comment on an NPDES draft permit should submit a written statement to the Department at the address of the district mining office indicated before each draft permit within 30 days of this public notice. Comments received within the comment period will be considered in the final determinations regarding the NPDES permit applications. Comments must include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and the relevant facts upon which it is based.

 The Department will also accept requests or petitions for a public hearing on NPDES permit applications, as provided in 25 Pa. Code § 92a.82(d). The request or petition for a public hearing shall be filed within 30 days of this public notice and contain the name, address, telephone number and the interest of the party filing the request, and state the reasons why a hearing is warranted. A public hearing may be held if the Department considers the public interest significant. If a hearing is scheduled, a notice of the hearing on the NPDES permit application will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. When a public hearing is held, the Department will consider comments from the public hearing in the final determination on the NPDES permit application.

Coal NPDES Draft Permits

California District Office: 25 Technology Drive, Coal Center, PA 15423, 724-769-1100.

NPDES No. PA0236004 (Mining Permit No. 63091301), Tunnel Ridge, LLC, (2596 Battle Run Road, Triadelphia, WV 26059). A revision to the NPDES and mining activity permit for the Tunnel Ridge Mine in Donegal Township, Washington County to construct the Wagner Airshaft and add Outfall 001. Surface Acres Affected 9.38. Receiving stream: UNT Middle Wheeling Creek, classified for the following use: WWF. Wheeling-Buffalo Creek Watershed. The application was considered administratively complete on June 8, 2017. Application received April 25, 2017.

 Unless otherwise noted for a specific outfall, the proposed effluent limits for all outfalls in this permit are the BAT limits described above for coal mining activities.

FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 To restore, construct, and maintain approximately 1,000 linear feet in and along the 100-year floodplain of Buck Run (TSF, MF), also known as, Rokeby Road Stream Bank Restoration Project.

 The proposed work will include the installation of fish habitat structures, stream bank stabilization, and floodplain restoration. The site is located near the intersection of Rokeby and Springdell Roads (Coatesville, PA, USGS Map, Latitude: 39.92666; Longitude: -75.83673).

E15-885. Chesterbrook Trust Parcel 1 Master Association, c/o Castlebrook Management, 1770 E. Lancaster Avenue, Paoli, PA 19301, Tredyffrin Township, Chester County, ACOE Philadelphia District.

 To restore, and maintain approximately 820 linear feet in and along the 100-year floodplain of Wilson Run (a tributary to Valley Creek EV, MF). The proposed work will include the removal of an existing obstruction (a small rock dam), stream bank stabilization, and minor channel relocation and floodplain grading, providing a more naturalized and stable floodplain area. Also, to construct and maintain a 35.16 ft. long by 8 ft. wide pedestrian bridge with stone toe protection designed to maintain the existing channel cross section area and clearance for the 100-year flood, providing access to an existing trail and open space.

 The site is located between Heyward Ave, and Wilson Farm Park (Valley Forge USGS map; Lat: 40.071793; Long -75.44892).

 To construct and maintain a 16-foot wide pedestrian bridge across Piney Fork Creek (TSF) having a 41-foot span and a 16-foot approximate underclearance. The project is part of the Montour Trail Phase 8F project and is located approximately 20 feet upstream of the Piney Fork Road (S.R. 3014) bridge crossing (Glassport, PA Quadrangle, Latitude: 40°16`39"; Longitude: -79°58`32").

 To 1) install and maintain rock vanes in 5 locations permanently impacting approximately 840 linear feet of Toad Creek (HQ-CWF, MF), 2) install and maintain biolog and rock deflectors in 8 locations permanently impacting approximately 380 linear feet of Toad Creek (HQ-CWF, MF), 3) install and maintain rip rap bank protection in 4 locations permanently impacting approximately 255 linear feet of Toad Creek (HQ-CWF, MF), 4) perform culvert and bank protection maintenance at 2 locations impacting approximately 100 linear feet of Toad Creek (HQ-CWF, MF), 5) replace and maintain a pedestrian bridge impacting approximately 40 linear feet of Toad Creek (HQ-CWF, MF), 6) repair and maintain stream bank protection at 2 locations impacting approximately 300 linear feet of Toad Creek (HQ-CWF, MF), 7) to install and maintain 2 concrete stream bank stabilization walls impacting approximately 130 linear feet of Toad Creek (HQ-CWF, MF), and 8) install and maintain bank grading permanently impacting approximately 6,500 square feet of the floodway of Toad Creek (HQ-CWF, MF), all beginning at Latitude 40.497987 N; Longitude 75.704241 W and continuing to Latitude 40.503983 N; Longitude 75.700498 W in Toad Creek (HQ-CWF, MF) Topton Borough, Berks County, and all for the purpose of stream restoration/enhancement of Toad Creek and implementation of the Borough's Master Plan.

E06-712: UGI Utilities Inc., 225 Morgantown Road, Reading, PA 19611 in Centre Township and Shoe-makersville Borough, Berks County, U.S. Army Corps of Engineers Philadelphia District.

 1) To install and maintain approximately 1,100 linear feet of 8-inch high pressure and 200 feet of 8-inch medium pressure gas pipeline within the floodway and floodplain of and beneath the Schuylkill River (WWF) (Latitude: 40°29`41.54", Longitude: -75°58`15.78").

 2) to install and maintain a high pressure to medium pressure regulator station within the floodplain of the Schuylkill River for the purpose of connecting the existing Miller Street facility (Centre Township) to the existing Main Street facility (Shoemakersville Borough).

 No wetlands will be impacted by this project.

E22-636: Lower Paxton Township, 425 Prince Street, Harrisburg, PA 17109 in Lower Paxton Township, Dauphin County, U.S. Army Corps of Engineers Baltimore District.

 1) To install and maintain approximately 135 linear feet of 24-inch diameter, SLCPP from a Type-D headwall to a Type-M inlet and

 2) to install and maintain approximately 29 linear feet of 18-inch SLCPP in an unnamed tributary to Beaver Creek (WWF, MF) (Latitude: 40°19`19.6", Longitude: -76°46`30.2") for the purpose of alleviating storm flooding.

 Approximately 40 sq. ft. of wetlands will be impacted by this project.

E06-718: Reading Area Water Authority, 1801 Kutztown Rd, Reading, PA 19604 in Birdsboro Borough, Berks County, U.S. Army Corps of Engineers Philadelphia District.

 To construct and maintain a 16-inch water main permanently impacting 190 square feet of Hay Creek (CWF, MF) and 60 square feet of Exceptional Value Wetlands Latitude 40.2663100; longitude -75.8061690. In addition, the project proposes five separate General Permit 5 registrations to install and maintain a 16 inch water permanently impacting

 1) 1,953 square feet of Angelica Creek (CWF, MF) Latitude 40.3108590; Longitude -75.9239070,

 2) 4.5 square feet of a UNT to Schuylkill River (WWF, MF) Latitude 40.2686040; Longitude -75.8228860,

 3) 10.5 square feet of a UNT to Schuylkill River (WWF, MF) Latitude 40.2687010; Longitude -75.8280380,

 4) 9 square feet of a UNT to Schuylkill River (WWF, MF) Latitude 42.2714150; Longitude -75.8340640,

 5) 15.75 square feet of a UNT to Schuylkill River (WWF, MF) Latitude 40.2682410; Longitude -75.8203460,

 all For the purpose of providing water to the Birdsboro Power facility.
