Appeal of Geisinger Indemnity Insurance Company; Pennsylvania Life and Health Insurance Guaranty Association; Doc. No. 17-08-016

 Under 1 Pa. Code Part II (relating to General Rules of Administrative Practice and Procedure), a prehearing telephone conference shall be held on October 18, 2017, at 9:30 a.m. On or before October 16, 2017, each party shall designate the persons participating in the telephone conference and a telephone number to be used for each individual. Response to the appeal shall be filed with the Administrative Hearings Office on or before October 3, 2017. Motions preliminary to those at hearing, protests, petitions to intervene or notices of intervention, if any, must be filed with the Administrative Hearings Office on or before October 3, 2017. Any party, or person or entity petitioning to intervene, shall show cause by filing objections in writing on or before October 3, 2017, why this matter should not be consolidated with the similar appeals at Doc. No. FC17-08-014 (American Progressive Life & Health Insurance Company of New York) or Doc. No. FC17-08-015 (WellCare Prescription Insurance, Inc.), or both. Future prehearing scheduling and possibly a date for a hearing shall be determined, if necessary, at the October 18, 2017, prehearing telephone conference.

 This is an appeal by a member of the Pennsylvania Life and Health Insurance Guaranty Association (PLHIGA) from a determination by the Board of Directors (Board) of PLHIGA dated June 22, 2017, in which the Board denied or declined to act upon the member's appeal from PLHIGA's assessment in connection with the liquidation of Penn Treaty Network America Insurance Company and/or Penn Treaty Network America Insurance Company. The appeal seeks a determination that certain premiums associated with Medicare Parts C and D products are not subject to assessment.
