FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To construct and maintain the following water obstructions and encroachments associated with the 2.2-mile long, S.R. 443, Section 02S roadway improvement project in Mahoning Township and Lehighton Borough, Carbon County:

 1) To remove an existing stormwater outfall and to construct and maintain a stormwater outfall consisting of a 30-inch diameter concrete pipe, concrete endwall, and a 16-ft long, 22.5-ft wide R-4 riprap apron permanently impacting 0.005 acre of PEM wetlands. The impact is located on the north side of S.R. 443, approximately 0.19 mile east of the intersection of S.R. 443 and Ashtown Drive (Lehighton, PA Quadrangle Latitude: 40° 48` 54", Longitude: -75° 44` 6.19") in Mahoning Township, Carbon County.

 2) To remove an existing stormwater outfall and to construct and maintain a stormwater outfall consisting of a 42-inch diameter concrete pipe, concrete endwall, and a 10-ft long, 15-ft wide R-5 riprap apron permanently impacting 0.002 acre of PEM wetlands. The impact is located on the north side of S.R. 443, directly northwest of the intersection of S.R.443 and Mall Road (Lehighton, PA Quadrangle Latitude: 40° 48` 59.70", Longitude: -75° 43` 53.79") in Mahoning Township, Carbon County.

 3) To remove an existing stream crossing and to construct and maintain a stream crossing of a UNT to Mahoning Creek (CWF, MF) consisting of an 85-ft long, 42-in diameter concrete culvert, concrete headwall, concrete endwall, and a 25-ft long, 25-ft wide R-5 riprap apron permanently impacting 0.003 acre of PEM wetlands (EV) and 0.002 acre of floodway. The impact is located on the north side of S.R. 443, directly east of the intersection of S.R. 443 and Mall Road (Lehighton, PA Quadrangle Latitude: 40° 48` 59.70", Longitude: -75° 43` 53.79") in Mahoning Township, Carbon County.

 4) To construct and maintain streambank stabilization along the southern bank of Mahoning Creek (CWF, MF) consisting of 276-ft long, 3-ft high mudsill cribbing structure and R-6 riprap bank protection permanently impacting 0.003 acre of PSS wetlands (EV) and 0.032 acre of floodway. The impact is located on the north side of S.R. 443, approximately 0.2 mile west of the intersection of S.R. 443 and S.R. 902 (Lehighton, PA Quadrangle Latitude: 40° 49` 12.47", Longitude: -75° 43` 26.55") in Mahoning Township, Carbon County.

 5) To remove an existing stream crossing and to construct and maintain a stream crossing of Mahoning Creek (CWF, MF) consisting of a 56-ft long, 126.50-ft span steel I-beam bridge having two (2) 63.25-ft spans, a 11.66-ft underclearance, and permanently impacting 0.26 acre of floodway. The impact is located on S.R. 902 (S. 9th Street), directly north of the intersection of S.R. 443 and S.R. 902 (Lehighton, PA Quadrangle Latitude: 40° 49` 19.24", Longitude: -75° 43` 12.99") in Mahoning Township, Carbon County.

 6) To construct and maintain an extension of an existing stream crossing of a UNT of Mahoning Creek (CWF, MF) with work consisting of a 12-ft long, 42-in diameter concrete pipe and concrete headwall (on the upstream side), a 9-ft long, 42-in diameter concrete pipe and concrete endwall (on the downstream side), and permanently impacting 0.26 acre of floodway. The impact is located on S.R. 443, approximately 0.03 mile west of the intersection of S.R. 443 and S.R. 3002 (East Penn Street) (Lehighton, PA Quadrangle Latitude: 40° 49` 19.24", Longitude: -75° 43` 12.99") in Mahoning Township, Carbon County.

 7) To remove an existing, abandoned stormwater pipe, which will permanently impact 0.001 acres of PEM wetlands (EV). The impact is located on the south side of S.R. 443, approximately 0.13 mile east of the intersection of S.R. 443 and S.R. 3002 (East Penn Street) (Lehighton, PA Quadrangle Latitude: 40° 49` 21.10", Longitude: -75° 42` 46.21") in Mahoning Township, Carbon County.

E01-325: Littlestown Borough Authority, 10 South Queen Street, Littlestown, PA 17340 in Littlestown Borough, Adams County, U.S. Army Corps of Engineers Baltimore District.

 1) To place and maintain approximately 320 square feet of fill within the floodplain of Piney Creek (WWF, MF) for the purpose of building a new pump station at South Queen Street. 2) To install, operate, and maintain 2 stream crossings of Piney Creek and 3 stream crossings of unnamed tributaries to Piney Creek with 10-inch gravity flow sanitary sewer interceptor permanently impacting 21.34 square feet of streams and 1,470.06 square feet of floodway. The project is located near the intersection of Mill Avenue and South Queen Street (Latitude: 39.742027; Longitude: -77.077801). No wetlands will be impacted by this project.

E38-207: Pennsy Supply, 1001 Paxton Street, Harrisburg, PA 17105 in Jackson Township, Lebanon County, U.S. Army Corps of Engineers Baltimore District. To 1.) relocate and maintain 900 feet of Tulpehocken Creek (CWF, MF, Wild Trout); 2.) install and maintain 900 feet of 30 mil pvc liner under Tulpehocken Creek (CWF, MF, Wild Trout); 3.) to place and maintain a 1.5-foot thick layer of R-4 rip rap to serve as streambed material in Tulpehocken Creek (CWF, MF, Wild Trout), all for the purpose of preventing the frequent development of sinkholes in the stream. The project is located immediately west of the intersection of US 422 and South Ramona Road (Latitude: 40° 21` 52.09" N; Longitude: 76° 20` 19.42" W) in Jackson Township, Lebanon County. No wetlands will be impacted by this project.

Northwest Region: Waterways and Wetlands Program, 230 Chestnut Street, Meadville, PA 16335-3481.

E24-271, City of St. Marys, 11 Lafayette St., St. Marys, PA 15857. Central Park Pedestrian Bridge, in the City of St. Marys, Elk County, ACOE Pittsburgh District (St. Marys, PA Quadrangle N: 41°, 25`, 41.60"; W: 78°, 33`, 27.72").

 To install a prefabricated pedestrian bridge over Elk Creek at 294 Depot Street St. in the City of St. Marys, Elk County. The 65` proposed structure is a single span bridge with a low beam elevation of 1,661`, a rise of 12.88` and a hydraulic opening of 416.57 SF that will connect a vacant lot to a grassy area near the parking garage. It will be set on two 10.33` × 2` × 9` abutments with 4` wing walls on each side of the stream. The banks will be stabilized with 3 stone retaining walls on the NW, SW, SE sides of the bridges and a concrete landscape wall 74 ft long from the NE corner of the bridge. The structure is designed to pass the 100-year storm without an increase in the flood elevation and will not overtop during the 500-year storm event.

ENVIRONMENTAL ASSESSMENTS

 To regrade and maintain 1,675 feet of the left bank of the Conestoga River for the purposes of reducing the frequency of flooding and restoring the riparian buffer. The project is located near the intersection of Kurtz Road and Martindale Road (Latitude: 40° 09` 13" N; Longitude: 76° 06` 43" W) in Earl Township, Lancaster County. No wetlands will be impacted by this project.

This notice of final action is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 Sections I—VI contain actions regarding industrial, animal or sewage wastes discharges, discharges to groundwater, and discharges associated with MS4, stormwater associated with construction activities and CAFOs. Section VII contains notices for parties who have submitted NOIs for Coverage under General NPDES Permits. The approval for coverage under these General NPDES Permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions in each General Permit. The approval of coverage for land application of sewage sludge or residential septage under applicable general permit is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions in the respective permit. The permits and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted before the action.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act (35 P.S. § 7514) and 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law). The appeal should be sent to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 The State Conservation Commission has taken the following actions on previously received applications for nutrient management plans under 3 Pa.C.S. Chapter 5, for agricultural operations that have or anticipate submitting applications for new, amended or renewed NPDES permits or NOIs for coverage under a general permit for CAFOs under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Persons aggrieved by an action may appeal under 3 Pa.C.S. § 517, section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704 to the Environmental Hearing Board, Second Floor, Rachel Carson State Office Building, 400 Market Street, P.O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. TDD users should contact the Environmental Hearing Board (Board) through the Pennsylvania AT&T Relay Service at (800) 654-5984.
