Appeal of Werner Bus Lines under Pennsylvania Assigned Risk Plan (National Continental Insurance Company); Doc. No. P18-02-001

 Under the Pennsylvania Assigned Risk Plan (Plan), Section 62 adopted by the Acting Insurance Commissioner under 75 Pa.C.S. § 1741 (relating to establishment), notice is hereby given that Brett N. Benton, Esquire, counsel for Werner Bus Lines has requested a hearing in response to the Pennsylvania Assigned Risk Plan Governing Committee's decision that the actions taken by National Continental Insurance Company comply with the Plan. The proceedings in this matter will be governed by 2 Pa.C.S. §§ 501—508 and 701—704 (relating to Administrative Agency Law), 1 Pa. Code Part II (relating to General Rules of Administrative Practice and Procedure) and 31 Pa. Code Chapter 56 (relating to Special Rules of Administrative Practice and Procedure). This administrative hearing will be held in the Insurance Department's Administrative Hearings Office in Harrisburg, PA. Failure by the appellant to appear at the scheduled hearing may result in dismissal with prejudice.

 The hearing will be held in the Administrative Hearings Office, Capitol Associates Building, Room 200, 901 North Seventh Street, Harrisburg, PA 17102 on March 21, 2018, 9:30 a.m.

 Following the hearing and receipt of the stenographic transcript, the Acting Insurance Commissioner will issue a written order resolving the factual issues presented at the hearing and stating what remedial action, if any, is required. The Acting Insurance Commissioner's Order will be sent to those persons participating in the hearing or their designated representatives. The Order of the Acting Insurance Commissioner may be subject to judicial review by the Commonwealth Court.
