Federal Consistency under the Coastal Zone Management Act; Maintenance Dredging and Bank Stabilization along the Delaware River

 This notice is published under section 306(d)(14) of the Federal Coastal Zone Management Act of 1972 (16 U.S.C.A. § 1455(d)(14)), regarding public participation during consistency determinations. The Department of Environmental Protection (Department), Coastal Resources Management Program has received notice that Hueber Launch Services is seeking authorization from the United States Army Corp of Engineers (USACE) for a 10-year maintenance dredging permit and to perform rip-rap bank stabilization along the Delaware River in Marcus Hook Borough, Delaware County.

 The applicant is seeking USACE authorization to dredge approximately 93 cubic yards of material from a 315 square foot area between mean high water and 5 feet below mean low water (3 feet design depth plus 2 feet of overdredge) at 45 East Delaware Street in Marcus Hook Borough. The applicant proposes to conduct maintenance dredging every 2 years during the 10-year maintenance period to the same depth, as needed. Recovered materials will be stored upland at the site for dewatering and then disposed onsite. The applicant also proposes to place 49 cubic yards of rip-rap along 60 linear feet of bank within 663 square feet of open water below the high tide line. The applicant will deploy a turbidity curtain during all dredging and filling operations below the high tide line.

 This project is subject to Department review for Federal consistency because it is a Federal license and permit activity and will have reasonably foreseeable effects on the Commonwealth's coastal resources or uses.

 In accordance with National Oceanic and Atmospheric Administration (NOAA) regulations at 15 CFR Part 930, Subpart D (relating to consistency for activities requiring a Federal license or permit), Hueber Launch Services has certified that the proposed activity will be conducted in a manner consistent with the applicable enforceable policies of the Commonwealth's NOAA-approved Coastal Resources Management Program.
