Pennsylvania Cash 5 with Quick Cash Terminal-Based Lottery Game

 Under 61 Pa. Code § 816.101 (relating to creation), the Secretary of Revenue hereby provides public notice of the termination of the Cash 5 lottery game rules at 61 Pa. Code §§ 816.101—816.117, effective for tickets purchased on or before February 8, 2021. Under the State Lottery Law (72 P.S. §§ 3761-101—3761-314) and 61 Pa. Code § 875.4 (relating to notice of terminal-based lottery game rules), the Secretary of Revenue hereby provides public notice of the following new rules for the terminal-based lottery game, Pennsylvania Cash 5 with Quick Cash, effective for tickets purchased on or after February 9, 2021:

 1. Name: The name of the terminal-based lottery game is Pennsylvania Cash 5 with Quick Cash (hereinafter, ''Cash 5 with Quick Cash''). The game will commence at the discretion of the Secretary, and will continue until the Secretary publicly announces a suspension or termination date.

 2. Price: The price of one Cash 5 with Quick Cash play is $2. Each Cash 5 with Quick Cash $2 play includes one Cash 5 Drawing play and one Quick Cash instant win play, printed on separate tickets. Additional Cash 5 with Quick Cash plays may be purchased at the discretion of the player, up to a maximum of ten plays for seven consecutive Cash 5 Drawings.

 3. Description of the Cash 5 with Quick Cash lottery game:

 (a) Cash 5 with Quick Cash is designed to give players the opportunity to win one Cash 5 Drawing prize and one Quick Cash instant win prize for each play purchased. Cash 5 Drawing plays or Quick Cash plays cannot be purchased separately.

 (b) For a single $2 purchase, the player receives one ticket containing five different Cash 5 Drawing numbers ranging from 1 to 43, which may either be quick pick or at the player's selection, and a ticket containing one Quick Cash play.

 (c) Players meeting all validation criteria can win a Cash 5 Drawing prize, identified in section 6(b) (relating to Determinations of Cash 5 Drawing prize winners for tickets correctly matching the winning numbers selected by the Lottery), by matching, in the same play, five, four, three or two of the winning numbers randomly selected by the Lottery as determined and publicly announced by the Secretary.

 (d) Players can win one Quick Cash instant win prize by matching any of the play symbols located in the ''YOUR NUMBERS'' area to any of the play symbols located in the ''WINNING NUMBERS'' area in a Quick Cash GAME. Correctly matching play symbols in this manner entitles the ticket holder to the prize shown to the right of the ''YOUR NUMBERS'' play symbols for that GAME, as further identified in Section 6(c) (relating to Quick Cash prizes available to be won and determination of prize winners). If more than one Quick Cash GAME appears on a ticket, (for example, where a purchase of two Cash 5 with Quick Cash plays includes a ticket containing two Quick Cash GAMES) each Quick Cash GAME is played separately.

 4. Cash 5 with Quick Cash bet slip and ticket characteristics:

 (a) To purchase a Cash 5 with Quick Cash play, the player shall remit to an authorized retailer the purchase price, submit the completed Cash 5 with Quick Cash bet slip or request the number selection through quick pick or manual terminal entry to have a ticket issued.

 (b) The Cash 5 Drawing ticket portion of the Cash 5 with Quick Cash play shall consist of one to ten plays, each containing one five-number selection for each $2 wagered, the drawing date or range of dates for which the ticket is entered, amount bet, and validation number data. On Cash 5 Drawing tickets containing multiple plays, each five-number Cash 5 Drawing selection will be identified by a letter prefix: A for the first play printed on the ticket; B for the second play printed on the ticket; C for the third play printed on the ticket; D for the fourth play printed on the ticket; E for the fifth play printed on the ticket; F for the sixth play printed on the ticket, G for the seventh play printed on the ticket; H for the eighth play printed on the ticket; I for the ninth play printed on the ticket; and J for the tenth play printed on the ticket. Each Cash 5 Drawing ticket shall be the only valid proof of the bet placed, and the only valid receipt for claiming a prize. The ticket shall only be valid for the drawing date or range of dates printed on the ticket. In addition, within the same purchase, a player may repeat the selected Cash 5 Drawing numbers for up to seven consecutive Cash 5 Drawings, for a maximum of 70 total Cash 5 Drawing plays, and 70 Quick Cash GAMES, per purchase.

 (c) The Quick Cash ticket portion of the Cash 5 with Quick Cash play shall consist of one to five GAMES, each containing five Quick Cash ''WINNING NUMBERS'' play symbols, five Quick Cash ''YOUR NUMBERS'' play symbols and one Quick Cash Prize area containing one Quick Cash prize symbol. On Quick Cash tickets containing multiple plays, each Quick Cash GAME will be identified by a GAME number: GAME 1 for the first play printed on the ticket; GAME 2 for the second play printed on the ticket; GAME 3 for the third play printed on the ticket; GAME 4 for the fourth play printed on the ticket; and GAME 5 for the fifth play printed on the ticket. A player who purchases more than five total Cash 5 with Quick Cash plays will receive multiple Quick Cash instant win tickets, each containing one to five Quick Cash GAMES, until the total number of Quick Cash GAMES has been printed. Each Quick Cash ticket shall be the only valid proof of the bet placed, and the only valid receipt for claiming a prize.

 (d) Cash 5 with Quick Cash bet slips shall be available at no cost to the player. The minimum wager is $2. For $2, purchase Cash 5 Drawing play A and one Quick Cash instant win GAME; for $4, purchase Cash 5 Drawing plays A and B and two Quick Cash instant win GAMES; for $6, purchase Cash 5 Drawing plays A, B and C and three Quick Cash instant win GAMES; for $8, purchase Cash 5 Drawing plays A, B, C and D and four Quick Cash instant win GAMES; for $10, purchase Cash 5 Drawing plays A, B, C, D and E and five Quick Cash instant win GAMES; for $12, purchase Cash 5 Drawing plays A, B, C, D, E and F and six Quick Cash instant win GAMES, printed on two tickets; for $14, purchase Cash 5 Drawing plays A, B, C, D, E, F and G and seven Quick Cash instant win GAMES, printed on two tickets; for $16, purchase Cash 5 Drawing plays A, B, C, D, E, F, G and H and eight Quick Cash instant win GAMES, printed on two tickets; for $18, purchase Cash 5 Drawing plays A, B, C, D, E, F, G, H and I and nine Quick Cash instant win plays, printed on two tickets; and for $20, purchase Cash 5 Drawing plays A, B, C, D, E, F, G, H, I and J and ten Quick Cash instant win GAMES, printed on two tickets. Plays shall be selected in accordance with the instructions printed on the Cash 5 with Quick Cash bet slip. A Cash 5 with Quick Cash bet slip has no pecuniary or prize value and does not constitute evidence of the purchase of a ticket or the numbers selected.

 (e) If Cash 5 with Quick Cash bet slips are unavailable, number selections may be given to an authorized retailer in groups of five-number selections, for each play and for each $2 wagered. The retailer shall manually enter the selections into the Lottery terminal. A player may also request number selection using the quick pick option by indication on the bet slip or making the request to an authorized retailer.

 (f) A player may also purchase Cash 5 with Quick Cash plays using a Pennsylvania Lottery self-service terminal. To purchase a ticket at a Pennsylvania Lottery self-service terminal, the player must insert into the self-service terminal a dollar amount equal to the total purchase price of the Cash 5 with Quick Cash game ticket and select the Cash 5 with Quick Cash option on the Lottery self-service terminal.

 (g) No portion of a Cash 5 with Quick Cash game ticket can be canceled or voided once printed by the Lottery Terminal, even if printed in error.

 5. Time, place and manner of conducting Cash 5 Drawings:

 (a) Time of drawing. A Cash 5 Drawing will be held on a daily basis or as determined and publicly announced by the Secretary.

 (b) Place of drawing. A Cash 5 Drawing will be conducted in the Harrisburg, Pennsylvania area unless the Secretary directs that a drawing or part of the drawing procedure be conducted at some other location.

 (c) Manner of conducting drawings. The Lottery will select, at random, five numbers from 1 through 43, with the aid of mechanical devices or any other selection methodology as authorized by the Secretary. The five numbers selected will be used in determining winners for each individual Cash 5 Drawing. The validity of a Drawing will be determined solely by the Lottery.

 (d) Winning Cash 5 Drawing selections are determined separately from winning Quick Cash GAMES. Tickets containing a Quick Cash GAME win may be presented for payment at any time while the ticket remains valid, as described in section 9(b) (relating to Unclaimed prize money).

 6. Cash 5 with Quick Cash prizes available to be won and determination of prize winners:

 (a) An amount equal to 44.39% of Cash 5 with Quick Cash gross sales for a Cash 5 Drawing will be reserved for prizes and allocated to the prize pool for payment of prizes as enumerated in Section 6(b) (relating to Determinations of Cash 5 Drawing prize winners for tickets correctly matching the winning numbers selected by the Lottery). The prize pool does not include money carried forward from a previous Pennsylvania Cash 5 Drawing.

 (b) Determinations of Cash 5 Drawing prize winners for tickets correctly matching the winning numbers selected by the Lottery, are:

 (1) Holders of tickets upon which the player's five numbers, in a single play, match the five winning numbers selected by the Lottery, shall be the winner of the jackpot category prize. The jackpot category prize shall consist of 44.0% of the Cash 5 Drawing prize pool, plus any prize money carried forward from a prior Cash 5 Drawing pursuant to §§ 6(b)(1)(iii), 6(b)(2)(ii) and 6(b)(3)(ii).

 (i) The Lottery will estimate and announce the projected amount of the upcoming jackpot category prize prior to the drawing. Payment will be made in the amount estimated and announced as the projected jackpot category prize or in the actual amount of the jackpot category prize, whichever is greater, divided equally by the number of plays on tickets determined by the Lottery to be entitled to claim a jackpot category prize.

 (ii) Prize money allocated to the jackpot category prize will be paid on a pari-mutuel basis. If more than one winning jackpot prize play is determined, each, upon meeting the requirements of 61 Pa. Code §§ 875.10 and 875.11 (relating to terminal-based lottery game ticket validation and requirements; and procedures for claiming and payment of prizes), is entitled to a prorated payment share of the total jackpot category prize.

 (iii) If, in a Cash 5 Drawing, there are no winning jackpot category prize plays, prize money allocated from the prize pool to that prize category will be carried forward and added to the amount allocated for the jackpot category prize money in the next Cash 5 Drawing.

 (2) Holders of tickets upon which four of the player's numbers, in a single play, match four of the winning numbers selected by the Lottery, shall be entitled to a second category prize of $200.

 (3) Holders of tickets upon which three of the player's numbers, in a single play, match three of the winning numbers selected by the Lottery, shall be entitled to a third category prize of $10.

 (4) Holders of tickets upon which two of the player's numbers, in a single play, match two of the winning numbers selected by the Lottery, shall be entitled to a fourth category prize of $2.

 (c) Quick Cash prizes available to be won and determination of prize winners:

 (1) Holders of tickets upon which any of the ''YOUR NUMBERS'' play symbols matches any of the ''WINNING NUMBERS'' play symbols, and a prize symbol of $6.00 appears in the Prize area to the right of the ''YOUR NUMBERS'' play symbols, in the same GAME, shall be entitled to a prize of $6.

 (2) Holders of tickets upon which any of the ''YOUR NUMBERS'' play symbols matches any of the ''WINNING NUMBERS'' play symbols, and a prize symbol of $2.00 appears in the Prize area to the right of the ''YOUR NUMBERS'' play symbols, in the same GAME, shall be entitled to a prize of $2.

 (d) All Cash 5 with Quick Cash prize payments, including the jackpot category prize, will be made as a one-time, lump-sum cash payment. For the purposes of jackpot prize calculation, the calculation will be rounded down so that prizes will be paid in multiples of $0.50.

 (e) A winning Cash 5 Drawing ticket is entitled only to the highest prize won by those numbers in each play appearing on the ticket.

 (f) A winning Quick Cash ticket is entitled to the prize for any winning GAME printed on that Quick Cash ticket. A winning Quick Cash ticket may contain up to five winning GAMES.

 (g) The number of prize categories, the allocation of prize money among the prize categories, and the minimum jackpot category prize amount for the Cash 5 Drawing portion of the Cash 5 with Quick Cash play may be changed at the discretion of the Secretary and the change will be announced by public notice. The changes will only apply prospectively to Cash 5 Drawings as of the date specified in the public notice.

 7. Probability of winning: The following tables set forth all possible ways that a prize can be won for the Cash 5 Drawing portion of a single Cash 5 with Quick Cash play; all the possible ways that a prize can be won for each GAME on the Quick Cash portion of a single Cash 5 with Quick Cash play; corresponding prize or prizes won; and probability of winning each prize or combination of prizes:

 8. Retailer Incentive and Marketing Promotion Programs:

 (a) The Lottery may conduct a separate Retailer Incentive Program for retailers who sell Cash 5 with Quick Cash lottery tickets. The conduct of the Program will be governed by 61 Pa. Code § 811.41 (relating to promotional prizes).

 (b) Retailer Incentive and Marketing Promotion Programs, including the use of unfunded free tickets, may be implemented at the discretion of the Secretary. If needed, funds for the programs, including the payment of prizes resulting from the programs, will be drawn from the Lottery Fund.

 9. Unclaimed Prize Money:

 (a) For a period of 1 year from the announced Drawing date, prize money from winning Cash 5 Drawing game tickets will be retained by the Secretary for payment to the persons entitled thereto. If no claim is made within 1 year of the anniversary date of the Drawing in which the ticket or chance was entered, the right of a ticket holder to claim the prize represented by the ticket, if any, will expire and the prize money will be paid into the State Lottery Fund and used for purposes provided for by statute.

 (b) A Quick Cash prize must be claimed within 1 year of the sale date of the Quick Cash ticket. If no claim is made within 1 year of the sale date of a Quick Cash ticket, the right of a ticket holder to claim the prize represented by the ticket, if any, will expire and the prize money will be paid into the State Lottery Fund and used for purposes provided for by statute.

 10. Governing Law: In purchasing a ticket, the player agrees to comply with and abide by the State Lottery Law (72 P.S. §§ 3761-101—3761-314), 61 Pa. Code Part V (relating to State Lotteries) and the provisions contained in this notice.
