Extension of Deadline for Filing of Annual Campaign Finance Reports

February 1, 2021

Whereas, a severe winter weather event, a serious East Coast snowstorm, struck Pennsylvania and other States of the Northeastern United States beginning on January 31, 2021, and is forecast to continue unabated into February 1 and 2, 2021, with significant snow accumulation, as well as periods of freezing rain and sleet, and totals of over a foot of snow expected in many counties across the Commonwealth; and

Whereas, the effects of the snowstorm have already caused the closure of the Commonwealth Capitol Complex in Harrisburg, Pennsylvania, which includes the Office of the Secretary of the Commonwealth, on Monday, February 1, 2021; and

Whereas, the effects of the snowstorm will also likely cause the closure of many county offices, which include the sixty-seven county boards of elections, on Monday, February 1, 2021; and

Whereas, annual campaign finance reports are to be filed by January 31 of each year, under the provisions of Section 1627 of the Pennsylvania Election Code (25 P.S. § 3247), but with a statutory deadline falling on a Sunday extended to the next business day, such deadline being Monday, February 1, 2021, per provisions of Section 104 of the Pennsylvania Election Code (25 P.S. § 2604); and

Whereas, such annual campaign finance reports will need to be filed both with county boards of elections, and the Secretary of the Commonwealth; and

Whereas, the weather-related closure of the Office of the Secretary of the Commonwealth and of the county boards of elections, during the last day on which to file such annual campaign finance reports with the Secretary of the Commonwealth and/or the county boards of elections, makes it necessary and proper to extend the statutory deadline by which annual campaign finance reports may be filed with the Secretary of the Commonwealth and/or the county boards of elections; and

Whereas, on Monday, February 1, 2021, I, Tom Wolf, Governor of the Commonwealth of Pennsylvania, pursuant to the provisions of Section 7301(c) of the Emergency Management Services Code, (35 Pa.C.S. §§ 7101 et seq., as amended) proclaimed the existence of a disaster emergency in the Commonwealth in response to and in anticipation of a continued severe winter weather event expected to impact the Commonwealth.

Now, Therefore, I, Tom Wolf, Governor of the Commonwealth of Pennsylvania, by virtue of the authority vested in me by the Constitution of the Commonwealth of Pennsylvania, the Emergency Management Services Code, and other laws of the Commonwealth, do hereby issue this Executive Order as follows:

 1. The deadline prescribed by Section 1627 of the Pennsylvania Election Code (25 P.S. § 3247), as modified by Section 104 of the Pennsylvania Election Code (25 P.S. § 2604), for the filing of annual campaign finance reports with the Office of the Secretary of the Commonwealth, shall be extended by one additional day for each business day or partial business day during the week of February 1, 2021, on which the Office of the Secretary of the Commonwealth, is closed for business as a consequence of weather conditions.

 2. The deadline prescribed by Section 1627 of the Pennsylvania Election Code (25 P.S. § 3247), as modified by Section 104 of the Pennsylvania Election Code (25 P.S. § 2604), for the filing of annual campaign finance reports with a county board of elections, shall be extended by one additional day for each business day or partial business day during the week of February 1, 2021, on which the office of the county board of elections is closed for business as a consequence of weather conditions.

 3. No deadline may be extended pursuant to this Executive Order beyond 5:00 p.m. EDT on Friday, February 5, 2021.

 4. The Office of the Secretary of the Commonwealth shall post this Executive Order in the Department of State's Bureau of Campaign Finance and Civic Engagement, and on the website of the Department of State and said Bureau, and in all other appropriate places, and shall communicate its contents to the county boards of elections and shall take all necessary action to provide notice of this Executive Order to the general public.

 5. This Executive Order shall take effect immediately and remain in effect only until 5:00 p.m. EDT, Friday, February 5, 2021.
