PROPOSED NUTRIENT MANAGEMENT PLANS RELATED TO APPLICATIONS FOR NPDES PERMITS FOR CAFOs

 This notice provides information about agricultural operations that have submitted nutrient management plans (NMPs) for approval under 3 Pa.C.S. Chapter 5 and that have or anticipate submitting applications for new, amended or renewed (National Pollutant Discharge Elimination System) NPDES permits, or Notices of Intent (NOIs) for coverage under a general permit, for CAFOs, under 25 Pa. Code Chapter 92a. This notice is provided in accordance with 25 Pa. Code Chapter 92a and 40 CFR Part 122, implementing The Clean Streams Law and the Federal Clean Water Act.

 Based upon preliminary reviews, the State Conservation Commission (SCC) or County Conservation Districts (CCD) working under a delegation agreement with the SCC have completed an administrative review of NMPs described. These NMPs are published as proposed plans for comment prior to taking final actions. The NMPs are available for review at the CCD office for the county where the agricultural operation is located. A list of CCD office locations is available at http://www.nacdnet.org/about/districts/directory/pa.phtml or can be obtained from the SCC at the office address listed or by calling 717-787-8821.

 Individuals wishing to comment on an NMP are invited to submit a statement outlining their comments on the plan to the CCD, with a copy to the SCC for each NMP, within 30-days from the date of this public notice. Comments received within the respective comment periods will be considered in the final determinations regarding the NMPs. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

Acknowledgment of Notice(s) of Intent to Remediate Submitted Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.908).

 Sections 302—305 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin an acknowledgment noting receipt of any Notices of Intent (NOI) to Remediate. An acknowledgment of the receipt of a NOI to Remediate is used to identify a site where an individual proposes to, or has been required to, respond to a release of a regulated substance at a site. Individuals intending to use the background standard, Statewide health standard, the site-specific standard, or who intend to remediate a site as a special industrial area, must file a NOI to Remediate with DEP. A NOI to Remediate filed with DEP provides a brief description of the location of the site, a list of known or suspected contaminants at the site, the proposed remediation measures for the site, and a description of the intended future use of the site. An individual who demonstrates attainment of one, or a combination of the cleanup standards, or who receives approval of a special industrial area remediation identified under the Act, will be relieved of further liability for the remediation of the site for any contamination identified in reports submitted to and approved by DEP. Furthermore, an individual shall not be subject to citizen suits or other contribution actions brought by responsible individuals not participating in the remediation.

 Under Sections 304(n)(1)(ii) and 305(c)(2) of the Act, there is a 30-day public and municipal comment period for sites proposed for remediation using a site-specific standard, in whole or in part, and for sites remediated as a special industrial area. This period begins when a summary of the NOI to Remediate is published in a newspaper of general circulation in the area of the site. For the site(s) identified below, proposed for remediation to a site-specific standard or as a special industrial area, the municipality, within which the site is located, may request to be involved in the development of the remediation and reuse plans for the site if the request is made within 30-days of the date specified below. During this comment period the municipality may request that the individual identified below, as the remediator of the site, develop and implement a public involvement plan. AIR QUALITY

PLAN APPROVAL AND OPERATING PERMIT APPLICATIONS

 The Department of Environmental Protection (DEP) has developed an integrated plan approval, State Operating Permit and Title V Operating Permit program. This integrated approach is designed to make the permitting process more efficient for DEP, the regulated community and the general public. This approach allows the owner or operator of a facility to submit permitting documents relevant to its application for all sources related to a facility or a proposed project, affords an opportunity for public input, and provides for a decision on the issuance of the necessary permits.

 The DEP received applications for Plan Approvals or Operating Permits from the following facilities. Copies of the application, DEP's analysis, all pertinent documents used in the evaluation of the application and subsequently prepared proposed plan approvals/operating permits are available for public review during normal business hours at the appropriate DEP Regional Office. Appointments for scheduling a review must be made by calling the appropriate DEP Regional Office. The address and telephone number of the Regional Office is listed before the application notices.

 Individuals wishing to file a written protest or provide comments or additional information, which they believe should be considered prior to the issuance of a permit, may submit the information to the DEP's Regional Office. A 30-day comment period from the date of this publication will exist for the submission of comments, protests and information. Each submission must contain the name, address and telephone number of the person submitting the comments, identification of the proposed Plan Approval/Operating Permit including the permit number and a concise statement regarding the relevancy of the information or objections to issuance of the permit.

 Any individual wishing to request a hearing may do so during the 30-day comment period. A public hearing may be held, if DEP, in its discretion, decides that a hearing is warranted based on the information received. Final Plan Approvals and Operating Permits will contain terms and conditions to ensure that the sources are constructed and operating in compliance with applicable requirements in the Air Pollution Control Act (35 P.S. §§ 4001—4015), 25 Pa. Code Chapters 121—145, the Federal Clean Air Act (42 U.S.C.A. §§ 7401—7671q) and regulations adopted under the Federal Clean Air Act.

59-00002D: Eastern Gas Transmission & Storage, Inc., 10700 Energy Way, Glen Allen, VA 23060, Farmington Township, Tioga County. Application received: January 3, 2023. The Department intends to issue a plan approval for the installation of selective catalytic reduction units on Sources P101 and P102 to comply with RACT III at the Tioga Compressor Station facility. The Department's review of the information submitted indicates that installation of the air cleaning devices will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants. Based on this finding, the Department proposes to issue a plan approval for the proposed installation. The air contaminant emissions from the sources with the proposed air cleaning devices included in this project will not exceed the following: 47.08 tons of nitrogen oxides (NOx, expressed as NO2) per year, 170.12 tons of carbon monoxide per year, 41.18 tons of volatile organic compounds per year, 9.68 tons of particulate matter less than 10 microns and less than 2.5 microns, 9.30 tons of hazardous air pollutants, 0.14 ton of sulfur oxides, and 29,514 tpy of carbon dioxide equivalent. The facility is a Title V facility. If the Department determines that the source is constructed and operated in compliance with the plan approval conditions and the specifications of the application for Plan Approval 59-00002D, the requirements established in the plan approval will be incorporated into a Title V operating permit pursuant to 25 Pa. Chapter 127, Subchapter F. All pertinent documents used in the evaluation of the application are available for public review during normal business hours at the Department's Northcentral Regional Office, 208 West Third Street, Suite 101, Williamsport, PA 17701. 47-00014E: United States Gypsum Company, 86 PPL Road, Danville, PA 17821, Derry Township, Montour County. Application received: June 15, 2023. For a major facility plan approval application that would authorize the use of a new manufacturing process material, natural gypsum rock, at the facility, as feed to the existing wallboard manufacturing, as well as the proposed construction of the new Source ID P301 and P302/Natural Gypsum Preheater/Roller Mills A and B including new fabric collectors (Source IDs C301 and C302) to control the new roller mills, the roller mills' ancillary equipment including feed bins and screw conveyors and associated filter vents (Source IDs C303—C306); the proposed modification of Source ID C117/Waste Reclaim Dust Collector system in order to control the proposed natural gypsum crusher operation (Source ID P119A); and the proposed modification for Source ID P122 Gypsum Railcar & Truck Unloading Operations including the installation of dust suppression systems associated with Source C122B to control the new natural gypsum unloading operation. The project location would be within the US Gypsum Washingtonville Plant which is a major Title V facility. The Department's review of the information submitted by United States Gypsum Company indicates that the air contamination sources to be constructed, including the modification to facility, will comply with all regulatory requirements pertaining to air contamination sources and the emission of air contaminants including not limited to the best available technology requirement (BAT) of 25 Pa. Code §§ 127.1 and 127.12, the fugitive emission restrictions of 25 Pa. Code § 123.1, as well as other requirements as applicable pursuant to 25 Pa. Code Chapters 121—145. Moreover, the project plan approval application specifies that the above are subject to applicable Federal standards include the applicable requirements under the National Performance Standards for Stationary Source (NSPS) codified in 40 CFR Part 60 Subpart OOO (Non-metallic mineral processing), as well as Title V and Compliance Assurance Monitoring (CAM) provisions as specified in 25 Pa. Code § 127.511 and 40 CFR Part 64, respectively. Based on this finding, the Department proposes to issue a plan approval for the proposed construction and other changes previously listed. The emission from each proposed new sources and modification included in this project is being permitted to not exceed the following limits: The total combined fugitive particulate matter emissions from the Source P122 gypsum unloading operation including truck traffic as authorized to be modified upon project startup shall not exceed the existing PTEs of 30.49 tons in any twelve consecutive month period, and its total combined allowable fugitive PM-10 or PM2.5 shall not exceed 5.98 tons in any twelve consecutive month period. In addition, the total combined fugitive particulate matter emissions from Source P119 including truck traffic as authorized to be modified shall not exceed 17.19 tons in any twelve consecutive month period, and its total combined fugitive PM-10 or PM2.5 shall not exceed 9.09 tons in any twelve consecutive month period. No person may authorize the combined total annual fuel usage including the aggregate for Source IDs P101 and P102 and Source IDs P301 and P302 upon project startup to exceed 613,200 MMBtu/hr in order to maintain facility wide PTE less than 50 tons/yr. Additionally, the particulate emissions including PM filterable and condensable (total) from within the exhaust of new Source ID C301 and C302 for the new Source ID P301 and P302 natural gypsum roller mill/dryer operations shall not be in excess of the following limits: PM (total): 0.009 grain per dry standard cubic foot of effluent gas volume (gr/dscf); PM-10: 0.009 gr/dscf; and PM2.5: 0.009 gr/dscf. In addition, the total annual emissions of PM (total), PM-10, and PM2.5 from each Source ID P301 and P302, including and C301 and C302, shall not exceed 6.75 tons in any twelve consecutive month period. Additionally, the nitrogen oxides (NOx) emissions, expressed as NO2, by the Source ID P301/P302 natural gypsum roller mill/dryer operation shall not exceed 0.048 pound per million Btu of heat input (each). In addition, the total annual emissions of NOx from Source ID 301/P302 shall not exceed 3.57 tons in any twelve consecutive month period (each). Moreover, the carbon monoxide (CO) emissions by each the Source ID P301/P302 natural gypsum roller mill/dryer operations shall not exceed 0.20 pound per million Btu of heat input. In addition, the total annual emissions of CO from Source ID P301/P302 shall not exceed 14.9 tons in any twelve consecutive month period (each). The volatile organic compound (VOC) emissions, expressed as propane, by each of the Source ID P301/P302 natural gypsum roller mill/dryer operations shall not exceed 0.02 pound per million Btu of heat input. In addition, the total annual emissions of VOC from Source ID P301/P302 shall not exceed 1.50 tons in any twelve consecutive month period (each) and the total annual emissions of HAPs from Source ID P301/P302 shall not exceed 0.2 ton in any twelve consecutive month period (each). Lastly, the permittee shall only use natural gas as fuel to operate the burner associated with Source ID P301/P302 which has a heat input of 17 MMBtu/hr. Additionally, the total particulate emissions from the exhaust of the Source ID C117 collector as modified upon project startup to control the new Source ID P119A crusher operation shall not be in excess of the following limitations: PM (total): 0.009 grain per dry standard cubic foot of effluent gas volume (gr/dscf); PM-10: 0.009 gr/dscf; and PM2.5: 0.009 gr/dscf. In addition, the total annual emissions of PM and PM-10 from the Source ID C117 collector exhaust shall not exceed 0.56 lb/hr and 2.5 tons in any twelve consecutive month period and the annual total emissions of PM2.5 from the Source ID C117 collector exhaust shall not exceed 1.9 tons in any twelve consecutive month period, upon project startup, replacing existing restrictions under Source ID P117 of TVOP 17-00001 upon project startup. In addition, the total annual emissions of PM (total) and PM-10 from the Source ID P119A crusher operation shall not exceed 0.23 ton in any twelve consecutive month period, and its annual total emissions of PM2.5 shall not exceed 0.17 ton in any twelve consecutive month period. Moreover, no more than 1,100,000 tons of synthetic gypsum and natural gypsum on a combined sum total basis shall be processed at this facility in any 12 consecutive month period upon project startup. In addition, no more than 1,100,000 tons of synthetic and natural gypsum materials shall be delivered to the facility by railcar or truck in any 12 consecutive month period. Any portion of this combined throughput may be delivered by railcar and any portion may be delivered by truck. The limits replace the existing throughput conditions upon project startup and following the cessation of permitted synthetic gypsum materials as delivered by the conveyor. In addition to the above emission and throughput limitations, upon project startup, the following is a brief description of the conditions the Department intends to place in the plan approval in order to ensure compliance with all applicable air quality regulatory requirements The plan approval includes initial performance testing on the new natural gypsum dryer/roller mills and the upstream crusher, stockpiling and unloading operations associated with project startup; required monitoring including not limited to the bag leak detection monitoring for the new roll mill baghouses and differential pressure for the existing smaller collector for the new crusher; and recordkeeping of the total amounts of all natural gypsum deliveries in addition to synthetic gypsum delivered to the facility, as well as the fuel usages (MMBtu/yr) in order to verify compliance with the respective combined throughput restrictions previously listed; as well as semi-annual reporting of required monitoring, work practices and other additional requirements as necessary to verify compliance in accordance with all applicable regulatory requirements within 25 Pa. Code Chapters 121—145. The facility is a major Title V facility. 15-00054, Highway Materials Inc/Malvern Asphalt Plant, 680 Morehall Rd, Frazer, PA 19355, East Whiteland Township, Chester County. Application received: July 27, 2023. This action is for the renewal of the State Only Operating Permit for Highway Materials, Inc. Highway Materials, Inc. operates a hot mix batch asphalt plant, consisting of a rotary dryer which primarily burns natural gas, but is also approved to burn propane and various liquid fuels. Air emissions from the asphalt plant are controlled by a knockout box and baghouse dust collector. The permit authorizes the operation of portable aggregate processing equipment powered by diesel-fired engines. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing provisions of The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).

 The Department of Environmental Protection (DEP) has prepared a draft NPDES permit and made a tentative determination to issue the NPDES permit in conjunction with the associated mining activity permit.

Effluent Limits for Coal Mining Activities

 For coal mining activities, NPDES permits, when issued, will contain effluent limits that are the more stringent of technology-based (BAT) effluent limitations or Water Quality Based Effluent Limits (WQBEL).

 The BAT limits for coal mining activities, as provided in 40 CFR Part 434 and 25 Pa. Code Chapters 87—90 are as follows:

 A settleable solids instantaneous maximum limit of 0.5 ml/l applies to: surface runoff (resulting from a precipitation event of less than or equal to a 10-year 24-hour event) from active mining areas; active areas disturbed by coal refuse disposal activities; mined areas backfilled and revegetated; and all other discharges and drainage (resulting from a precipitation event of greater than 1-year 24-hour to less than or equal to a 10-year 24-hour event) from coal refuse disposal piles. Similarly, modified BAT limits apply to iron, manganese and suspended solids in surface runoff, discharges and drainage resulting from these precipitation events and those of greater magnitude in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

 Exceptions to BAT effluent limits may be applicable in accordance with 25 Pa. Code §§ 87.102, 88.92, 88.187, 88.292, 89.52 and 90.102.

Effluent Limits for Noncoal Mining Activities

 The limits for noncoal mining activities as provided in 25 Pa. Code § 77.522 are pH 6 to 9 and other parameters DEP may require.

 Discharges from noncoal mines located in some geologic settings (for example, in the coal fields) may require additional water quality based effluent limits. If additional effluent limits are needed for an NPDES permit associated with a noncoal mining permit, then the permit description specifies the parameters.

FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department of Environmental Protection (DEP). Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341), requires the State to certify that the involved projects will not violate the applicable provisions of Sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317), as well as relevant State requirements. Individuals objecting to approval of a request for certification under Section 401 or to the issuance of a Dam Permit or Water Obstruction and Encroachment Permit, or the approval of an Environmental Assessment must submit any comments, suggestions or objections within 30-days of the date of this notice, as well as any questions to the office noted above the application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed, and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The DEP may schedule a fact-finding hearing or an informal conference in response to comments if deemed necessary. Maps, drawings and other data pertinent to the certification request are available for inspection between the hours of 8:00 a.m. and 4:00 p.m. on each working day at the office noted above the application.

Temporary equipment crossings via timber mats will also occur at these stream crossing locations. Two (2) Palustrine Forested Wetlands (41.619132, -78.440613), (41.618775, -78.441218) will be crossed by the two (2) 8-inch lines open trenched with four (4) feet of minimum cover.  To 1) Installation of a new 68" × 43" Reinforced Concrete Pipe stormwater outfall discharging to Spring Creek from Park Boulevard. A new Cast-In-Place endwall and riprap apron choked with native streambed material will be installed to prevent streambed and streambank erosion; 2) Use Cured In-Place Pipe lining to rehabilitate an existing 35" × 54" Elliptical Corrugated Metal Pipe outfall that discharges to Spring Creek.  Chanticleer Garden is proposing to perform the following water obstruction and encroachment activities: 1) To demolish an existing bridge over an unnamed tributary to Little Darby Creek (CWF) also known as Love Canal and to relocate the unnamed tributary resulting in 63 linear feet (191 square feet) of permanent watercourse impact. This activity also includes the construction and maintenance of a new 11.1-foot-long, 49-inch by 33-inch corrugated steel-pipe arch culvert. 2) To demolish portions of an existing retaining wall along an unnamed tributary to Little Darby Creek (CWF) also known as Bell's Run and grading of the floodway to allow for greater floodplain access during larger storm events with riparian plantings resulting in 4,081 square feet of permanent floodway impact and 877 square feet of temporary floodway impact due to construction access to grade the floodway. This activity also includes the construction and maintenance of new stone wall section at the confluence of the relocated Love Canal and Bell's Run. The overall project includes a new 6-foot-wide grass trail with 1-foot-wide shoulders over the proposed pipe-arch culvert and within the floodway and is located in Chanticleer Garden in Radnor Township, Delaware County (USGS PA Valley Forge).  PennDOT District 6-0 is proposing to perform the following water obstruction and encroachment activities associated with the Ridge and Germantown Pikes Re-Alignment Project (SR 4031 Sec PH1): 1) to remove an existing 60-inch CMP culvert carrying an unnamed tributary to Perkiomen Creek (UNT 2, WWF-MF) and in its place, construct and maintain a 60-inch RCP culvert and extension in the same location resulting in 1,056.51 square feet of permanent water course impact, 15,701.27 square feet of permanent floodway impact, 784.67 square feet of temporary watercourse impact and 4,341.73 square feet of temporary floodway impact. This activity also includes the placement of riprap rock apron at the culvert inlet and outlet, placement of fill and grading for the culvert extension, and the construction and maintenance of a new 18-inch diameter outfall from a stormwater management facility (USGS PA Collegeville—Latitude 40.182434 N, Longitude 75.44364 W); 2) to remove an existing 60-inch CMP culvert carrying an unnamed tributary to Perkiomen Creek (UNT 3, WWF-MF) and in its place, construct and maintain a 60-inch RCP culvert and extension resulting in 1,119.86 square feet of permanent watercourse impact, 19,965.49 square feet of permanent floodway impact, 301.60 square feet of temporary watercourse impact and 11,230.42 square feet of temporary floodway impact. This activity also includes the placement of riprap rock apron at the culvert inlet and outlet of the extension, placement of fill and grading for the Ridge Pike and Germantown Pike Connector Road Intersection, grading associated with the construction of a stormwater facility, and the construction and maintenance of an 18-inch outfall from multiple stormwater facilities (USGS PA Collegeville—Latitude 40.181236 N, Longitude 75.442213 W); 3) to place fill within a pond which discharges to an unnamed tributary to Perkiomen Creek (UNT 3, WWF-MF) associated the construction of roadway embankment. This activity will result in 286.80 square feet of permanent impact and 1,236.26 square feet of temporary impact (USGS PA Collegeville—Latitude 40.180380 N, Longitude 75.441046 W); 4) to conduct temporary construction activities around an unnamed tributary to Perkiomen Creek (UNT 1, WWF-MF) and may result in 221.00 square feet of temporary watercourse impact, 784.67 square feet of floodway impact, and 80.88 square feet of temporary floodplain impact. The purpose of this project is to alleviate congestion and travel delay, improve safety, and enhance overall regional mobility around the Perkiomen Creek Bridge river crossing and involves Pechins Mill Road, SR 4009 (River Road), and Germantown Pike, SR 4031 (Ridge Pike), and the proposed Germantown Pike Connector Road and Roundabout.  To conduct a stream restoration project along 2,620-feet of Cedar Creek (WWF, MF) including the removal of legacy sediments and an existing agricultural crossing and 1.) the installation and maintenance of 2,115-feet of rock to protection; 2.) the construction of a 100-foot long by 30-foot wide livestock crossing under General Permit 6 coverage; 3.) the construction of a 50-foot by 20-foot temporary stream crossing under General Permit 8 coverage; and 4) the installation of a 3-teir riparian forest buffer, all for the purpose of reconnecting the floodplain by the removal of legacy sediment and stabilizing the streambank.
