Notes of Decisions

   Construction

   Medical institutions or groups not specifically identified by the legislature will not be included in the Pennsylvania Peer Review Protection Act (63 P. S. §  425.1 et seq.). McClellan v. Health Maintenance Organization, 660 A.2d 97 (Pa. Super. 1995).

   HMO

   Staff or group model HMO’s may be considered health care providers under the Pennsylvania Peer Review Protection Act (63 P. S. §  425.1 et seq.), in appropriate cases. McClellan v. Health Maintenance Organization, 660 A.2d 97 (Pa. Super. 1995).

   Peer Review Protection Act

   Because an IPA model HMO is neither a direct health care practitioner, nor the administrator of a health care facility, it cannot be embraced by the confidentiality protections of the Peer Review Protection Act (63 P. S. §  425.1 et seq.). McClellan v. HMO of Pa., 686 A.2d 881 (Pa. Cmwlth. 1996).
