§ 152.10. Qualification of officers and directors.
This section applies to risk-assuming preferred provider organizations which are not licensed insurers.
(1) The responsibility, character and general fitness for the preferred provider organizations operations of a person who is chosen, elected or appointed as an officer or director shall be such as to command the confidence of the public and warrant the belief that the preferred provider organizations operations will be honestly and efficiently conducted in accordance with the intent of section 630.
(2) If the Commissioner determines, after a proper investigation, that an officer or director of a preferred provider organization does not meet the qualifications stated in paragraph (1), the person shall cease serving as an officer or director, or both.
(3) The procedure before the Commissioner for the determination stated in paragraph (2) shall be under the adjudication procedure set forth in 2 Pa.C.S. § § 501508 and 701704 (relating to the Administrative Agency Law). The officer or director is entitled to judicial review as provided by statute.
