Notes of Decisions Other Services Reasonably Necessary
Subparagraph (vii) of the definition of other services reasonably necessary, has no rational basis because insurance proceeds used to pay the estates expenses do not constitute a payment to the claimant; therefore, the section must be struck under the pronouncement of Spicer v. Department of Public Welfare, 428 A.2d 1008 (Pa. Cmwlth. 1981). Sharpe v. Crime Victims Compensation Board, 530 A.2d 520 (Pa. Cmwlth. 1987); appeal denied 539 A.2d 812 (Pa. 1988).
