§ 4300.63. Commitment procedures.
(a) The Department will participate in costs incurred by counties for the commitment of individuals under the Mental Health Procedures Act (50 P.S. § § 71017503) and intellectual disability commitments under the act.
(b) The following costs are allowable:
(1) Mental health review officer time and related costs.
(2) Attorney for the county mental health and intellectual disability program or the facility.
(3) Examination and expert medical testimony by the examining physician.
(4) Cost of client transportation to or from hearing.
(5) Clients expert witness as provided under section 304(d) of the Mental Health Procedures Act (50 P.S. § 7304(d)).
(6) Commitment delegate expenses.
(c) The following costs are not allowable:
(1) Court costs or fees.
(2) Court clerical costs.
(3) Transcription costs.
(4) Clients attorney.
(5) Court reporter.
(6) Attorney for the petitioner when the petitioner is not the county administrator.
(7) Fees for testimony by witnesses other than expert medical and clients expert witnesses.
