Notes of Decision

   Recusals

Gaming Control Board did not act arbitrarily, capriciously and unconstitutionally in denying appellant’s application for category 2 slot machine license despite city’s endorsement or preference in its favor; Board considered statutory factors for issuance of slot licenses, city did not testify in final suitability hearing, and city’s endorsement letter was provided beyond deadline for public input.
