Notes of Decisions Search and Seizure
The police lacked a reasonable basis to conduct a seizure and search of a drivers logbook, a bank bag, which contained toll receipts, and a brown bag, which contained shipping invoices and other documents, where, in view of the fact that the police had detained the driver and were planning to impound his tractor-trailer, the police had already taken a potentially dangerous vehicle and driver off the road.
