§ 349.16. Construction codes and guidelines.
(a) Conformance. School Building projects shall conform to one or more of the following construction codes or professional guidelines, or portions thereof in accordance with § 21.72 (relating to construction codes).

A school district may submit, and the Department will evaluate, written justification of a request to have a particular construction code or professional guideline added to the approved list. The Department will have the authority to establish and enforce guidelines for safety factors not covered by the codes or professional guidelines listed in subsection (a) of this section.
(c) Energy Council. Subject to the provisions of the Public School Code of 1949 (24 P. S. § § 1-10127-2702), for purposes of Department review and approval, minimum construction standards recommended by the Governors Energy Council shall take precedence over the codes and guidelines listed in subsection (a) of this section.
