§ 9.1. Establishment.

 If an intermediate unit provides an instructional materials service it will be established, approved and operated as provided in sections 906-A and 914-A(5) of the Public School Code of 1949 (24 P. S. § §  9-906-A and 9-914-A(5)), regulations of the State Board of Education, and the standards of the Secretary. The latter requirements may be obtained from the Secretary of Education, Post Office Box 911, Harrisburg, Pennsylvania 17126.

§ 9.2. Instructional materials service plan.

 If an intermediate unit provides an instructional materials service, it will file a plan for this program in accordance with the standards of the Secretary, which may be obtained from the Secretary of Education, Post Office Box 911, Harrisburg, Pennsylvania 17126.

§ 9.3. Administration.

 Where provided, the intermediate unit instructional materials service will include all component districts of an intermediate unit after July 1, 1972, except as stated in section 920-A(c) of the act of May 4, 1970 (No. 102) (24 P. S. §  9-970) and the regulations of the State Board of Education.

§ 9.4. Staff.

 The intermediate unit may appoint such program specialists and other staff members as may be necessary for the supervision and operation of instructional materials service. Such program specialists shall meet qualifications established by the State Board of Education and the standards of the Secretary, which may be obtained as provided in §  49.194 (relating to employment permits for program specialists).

§ 9.5. Contracted services.

 An intermediate unit may contract with another intermediate unit to fulfill its responsibility to provide an approved program of instructional materials service. All such contracts shall be subject to approval of the Secretary.

§ 9.6. Ownership.

 All instructional materials and related equipment purchased by the intermediate units shall become the property of the intermediate unit. In case of discontinuation of the instructional materials service, all property shall be disposed of as provided in a plan submitted to the Secretary for approval prior to the discontinuation of the service.

§ 9.7. Budget accounting.

 Revenues for support of the instructional materials service shall be obtained from a computed pro rata share when a majority of the component districts participate in this program. When less than a majority of the component districts participate in the instructional materials service the revenues may be obtained from either a direct fee or such other manner as agreed to by the intermediate unit and the participating districts. Regardless of the source of revenue, the budget for the service shall be included in the operational budget of the intermediate unit.

§ 9.8. Advisory committee.

 If an intermediate unit organizes an instructional media service and appoints an instructional materials advisory committee, it shall be done in accordance with the standards of the Secretary.

§ 9.9. Boundary lines.

 Effective July 1, 1972, boundary lines for the instructional materials service program of the intermediate unit shall conform with those of the intermediate unit except as otherwise provided in §  9.5 of this Title (relating to contracted services).
