§ 178.76. Retroactive payment under SSI and Title II of the SocialSecurity Act.
Retroactive payments under SSI and Title II of the Social Security Act (42 U.S.C.A. § § 401433) are excluded for 6 months after the month in which the retroactive payment is received. Any amount which remains after the sixth month is considered a resource. This exclusion does not apply to items purchased with the money even if the 6 month period has not expired.
