CHAPTER 5300. PRIVATE PSYCHIATRIC HOSPITALS

5300.1.    Accreditation.
5300.2.    Not Nationally accredited or certified.

Authority

   The provisions of this Chapter 5300 issued under section 201(2) of the Mental Health and Mental Retardation Act of 1966 (50 P.S. §  4201(2)); section 1021 of the Human Services Code (62 P.S. §  1021); and sections 105 and 112 of the Mental Health Procedures Act (50 P.S. § §  7105 and 7112), unless otherwise noted.

§ 5300.1. Accreditation.

 The Department will accept, as sufficient for licensure, accreditation by the Joint Commission on Accreditation of Hospitals (JCAH), Medicare Certification or approval by other national accreditation bodies which are designated as acceptable by the Secretary, if the hospital is also in compliance with the applicable sections of Chapter 5100 (relating to mental health procedures).

§ 5300.2. Not Nationally accredited or certified.

 If a private psychiatric hospital is not nationally accredited or certified under §  5300.1 (relating to accreditation), the Department will apply the JCAH standards which are in effect on the date the application or re-application for a license is made, as well as applicable sections of Chapter 5100 (relating to mental health procedures).
