Rule 3783. Adversarial Proceedings.
(a) Initiating adversarial proceedings. Adversarial proceedings shall be initiated by the filing of a complaint.
(b) Rules governing adversarial proceedings. The Pennsylvania Rules of Civil Procedure shall apply to adversarial proceedings.
(c) Appointment of referee. The Court may appoint a referee to hear the complaint and make recommended findings of fact and conclusions of law and propose an order for review by the Court in the same manner and pursuant to the same procedure prescribed for the disposition of objections to a notice of determination. The Court shall determine who shall pay the referees fee and costs.
Official Note
Adversarial proceedings may not be commenced by filing a writ of summons.
