FEDERAL WATER POLLUTION CONTROL ACT, SECTION 401

 The following permit applications, requests for Environmental Assessment approval and requests for 401 Water Quality Certification have been received by the Department. Section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341) requires the Commonwealth to certify that the involved projects will not violate the sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) as well as relevant State requirements. Persons objecting to approval of a request for certification under section 401 of the FWPCA, the issuance of a Dam Permit or Water Obstruction and Encroachment Permit or the approval of an Environmental Assessment shall submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the office noted before an application. Comments should contain the name, address and telephone number of the person commenting, identification of the certification request to which the comments or objections are addressed and a concise statement of comments, objections or suggestions including the relevant facts upon which they are based.

 The Department may conduct a fact-finding hearing or an informal conference in response to comments if deemed necessary. Each individual will be notified, in writing, of the time and place of a scheduled hearing or conference concerning the certification request to which the comment, objection or suggestion relates. Maps, drawings and other data pertinent to the certification request are available for inspection between 8 a.m. and 4 p.m. on working days at the office noted before the application.

 Persons with a disability who wish to attend the hearing and require an auxiliary aid, service or other accommodation to participate in the proceedings should contact the specified program. TDD users may contact the Department through the Pennsylvania AT&T Relay Service at (800) 654-5984.

 To construct and maintain a stream restoration project in 1,200 feet of Dubois Creek (CWF, MF) with work consisting of floodplain benches, restored stream banks, 2 cross vains, 4 J-hooks, 3 rock deflectors, and riparian plantings. The project's purpose is to stabilize the channel, improve aquatic resources, and establish riparian habitat. The project is approximately 0.20 mile north of the intersection of State Route 1022 and State Route 1037 (Franklin Forks, PA Quadrangle Lat: 41° 56` 48.2"; Long: -75° 45` 58.4") in Great Bend Township, Susquehanna County.

 To construct and maintain an 8-foot wide single span pedestrian suspension bridge across Jordan Creek, having an 80-foot span and a 12-foot minimum underclearance.  To (1) extend and maintain existing stream enclosure 237-linear feet with a 36-inch diameter with R-5 riprap apron for scour protection and within an Unnamed Tributary to Brush Run which is a perianal stream classifies as a Warm Water Fishery, (2) replace two 49-linear feet 24-inch diameter pipe in an Unnamed Tributary to the Beaver Dam Branch of the Juniata River which is a perennial stream classified as a Warm Water Fishery, (3) place fill in three exceptional value wetlands: .03 acre of PEM, .19 acre of PSS/PEM and, .01 acre of PSS wetlands as a result of fill, (4) construct .82 acre of wetlands as compensation for wetland Impacts. E08-482. Pennsylvania Department of Transportation, Engineering District 3-0, PO Box 218, Montoursville, PA 17754-0218. S.R. 4014 Section 20M Roadway Improvement, Paving and Bridge Replacement Project. Smithfield Township, Bradford County, ACOE Baltimore District (Sayre, PA Quadrangle N: 41° 53` 44"; W: 76° 34` 21").

 PA DOT Engineering District 3-0 proposes to upgrade approximately a two mile section of SR 0414. The project will include roadway widening, roadway paving and drainage upgrades. The project will include replacement of twenty nine pipes. The pipe replacements range from stormwater drainage to regulated replacements on Unnamed Tributaries to Buck Creek and one wetland. The project proposes a total of 0.01 acre of permanent impact to jurisdictional wetlands. These impacts are the result of roadway widening, pipe replacements and channel modifications for streams located adjacent to the roadway. Additionally, a single span concrete slab bridge will be replaced with a single cell precast box culvert. The existing structure has a normal span of 7.48 Ft.; skew of 45°, underclearance of 5.84 Ft. and a low chord of 1,049.51 Ft. The proposed structure will have a normal span of 11 Ft., skew of 45°, underclearance of 5.0 Ft. and a low chord of 1,049.33 Ft. The bridge replacement will be located over Bucks Creek. Bucks Creek and the Unnamed Tributaries to Bucks Creek are classified as Warm Water Fisheries by Title 25, Chapter 93 Water Quality Standards. The project will not require mitigation.

E14-552. Nathan C. & Trevor C. Hummel, 92 Lemon Lane, Mifflinburg, PA 17844-1105. Still House Hollow Culvert, in Penn Township, Centre County, ACOE Baltimore District (Coburn NW, PA N: 40°51`17.1"; W: -77°27`55.6").

 To construct and maintain a 4-foot diameter culvert depressed 1 foot into the streambed of Still House Hollow Road to access an existing cabin located 1,600 feet up Still House Hollow Road from Tunnel Road. This project proposes to permanently impact 25 linear feet of Still House Hollow Run, which is classified as a High Quality—Wild Trout stream.

E18-481. Keystone Central School District, 110 East Bald Eagle Street, Lock Haven, PA 17745. Baseball Fields, in Bald Eagle Township, Clinton County, Baltimore ACOE District (Beech Creek, PA Quadrangle N: 18.75 inches, W: 0.90 inch).

 To construct and maintain: 1) an 87 foot long by 5-foot by 5-foot concrete box culvert and its associated concrete wingwalls with the culvert invert set 1-foot below the stream bed, (2) mitigate all proposed wetland encroachments through on-site constructed wetlands, (3) conserve remaining wetland acreage through an ACOE approved deed restriction in order to build two baseball fields, parking lot, access road and associated infrastructure. The project will directly impact 0.618 acre of wetlands and 85 linear feet of an Unnamed Tributary to Bald Eagle Creek, which is classified as Cold Water—Migratory Fishery.

E19-297. Berwick Borough, 1800 N Market St., Berwick, PA 18603-1300. Test Track Susquehanna River Trail and Boat Launch, in Berwick Borough, Columbia County, ACOE Baltimore District (Mifflinville, PA Quadrangle N: 41.042656 inches; W: 76.260952 inches).

 The applicant proposes to improve approximately 1 mile of existing hiking trails along the Susquehanna River and to place an Asphalt wearing surface. This will include an on contour sidewalk directly downstream of the boat launch that extends to the river's edge. The project also includes the removal of the old concrete launch and installation of a new concrete launch to extend into the Susquehanna River. A third proposed part of this application is to construct a floating dock that measures 5 feet wide and shall extend 40 feet projecting into the Susquehanna River, which carries a water quality designation of Warm Water Fishery. This project does not impact any wetlands.

E41-632. Texas Blockhouse Fish & Game Club, 31 Grammer Road, Williamsport, PA 17701-8884. Texas Creek Channel Realignment and Fish Habitat Project, Pine Township, Lycoming County, ACOE Baltimore District (English Center, PA Quadrangle Latitude: 41° 28` 38.3"; Longitude: 77° 15` 09.8").

 The applicant is seeking authorization to change stream channel alignment, construct, operate and maintain a channel block and log deflectors in Texas Creek to restore channel alignment and in-stream fish habitat that was altered or lost in flooding. Texas Creek is classified as Exceptional Value by Chapter 93 Rules and Regulations. Channel realignment and habitat structure installation shall be limited to a maximum stream length of 200 feet. All activity authorized by this permit shall be reviewed, approved and field verified by the Pennsylvania Fish and Boat Commission—Division of Habitat Management. As proposed, the project poses 200 feet of permanent stream impact with the channel realignment with no temporary or permanent wetland impacts. The project is located along the northern right-of-way of SR 0284 approximately 1,930-feet north of Texas Creek Road and SR 0284 intersection.

E49-327. Randall Kramm, 7480 Paradise Road, Milton, PA 17847-8071. Muddy Run Stabilization/Fencing Project in Turbot Township, Northumberland County, ACOE Baltimore District (Milton, PA Quadrangle N: 41.048870 inches; W: -76.7905280 inches).

 The applicant proposes to complete a bank stabilization project within existing pasture ground. The improvements will consist of installation of four stabilized agricultural stream crossings, 450 linear feet of bank stabilization (laying back the slopes) within the middle pasture along the left bank, 605 linear feet of bank stabilization (laying back the slopes and riprap toe) along three outside meander bends (one right bank and two left bank). Additional work will include fencing placed outside the floodway to maintain the new improved banks and vegetation areas. Overall this project intends on improving well over 1,000 linear feet of Muddy Run, which carries a water quality designation of Warm Water Fishery. This project does not impact any wetlands.

E49-329. Pennsylvania Department of Transportation, Engineering District 3-0, PO Box 218 Montoursville, PA 17754-0218. S.R. 1023, Section 010, Bridge Replacement Project, Shamokin Dam Borough, Northumberland County, ACOE Baltimore District (Sunbury, PA Quandrangle N: 40° 50` 19"; W: 76° 49` 39").

 PA DOT Engineering District 3-0 proposes to replace a single span concrete encased steel I-beam bridge with a single span Steel Pipe Arch. The existing structure has a normal span of 12 Ft., Skew of 90°, an underclearance of 9.0 Ft. and a low chord elevation of 450.80 Ft. The proposed structure has a normal span of 14.17 Ft., Skew of 90°, an underclearance of 7.5 Ft. and a low chord elevation of 450.60 Ft. The proposed structure will be located on the same horizontal and vertical alignment. Both the existing and proposed structures will have a paved concrete flow line. The stream impact from the proposed structure will be 85.8 Ft, which is beyond the limits of the General Permit 11. The project will temporarily impact 0.03 acre of jurisdictional wetland. This project will not require mitigation. The project is located over an Unnamed Tributary to the Susquehanna River (WWF). The project is located in Shamokin Dam Borough, Northumberland County.

E57-124. Fox Township, 44 Middle Road, Shunk, PA 17768. Hoagland Branch Gravel Removal in Fox Township, Sullivan County, ACOE Baltimore District (Hillsgrove, PA Quadrangle N: 41.519611 inches; W: -76.703126 inches).

 The applicant proposed to remove two gravel bars that formed during the Hurricane Lee Flooding. The total length is 450 linear feet and the gravel is proposed to be removed to a maximum of 6 inches above water surface or 6 inches above dry bed of Hoagland Branch, which carries a water quality designation of Exceptional Value. This project does not intend to impact any wetlands.

F19-004. Montour Township, 195 Rupert Drive, Bloomsburg, PA 17815. Floodplain encroachment demolition and regrading in Montour Township, Columbia County, ACOE Baltimore District (Catawissa, PA Quadrangle Latitude: 40° 59` 13.27"; Longitude: 76° 28` 31.07").

 Montour Township is seeking authorization to demolish existing floodplain encroachments (flood-damaged structures) and re-grade the floodplain for the following locations along the right floodplain of Hemlock Creek: 10, 14 and 18 Perry Avenue, Bloomsburg, PA 17815; 16 Spade Avenue, Bloomsburg, PA 17815; 4 and 8 Perry Avenue, Bloomsburg, PA 17815; and 13 and 15 Club Avenue, Bloomsburg, PA 17815.

 Montour Township is also seeking authorization to demolish existing floodplain encroachments (flood-damaged structures) and re-grade the floodplain for the following locations along the right floodplain of Fishing Creek: 208, 210 and 220 Reading Street, Bloomsburg, PA 17815.

E26-365. Pennsylvania Department of Transportation—District 12-0, 825 N Gallatin Avenue Ext, PO Box 459, Uniontown, PA 15401-0459, North Union Township, Fayette County; ACOE Pittsburgh District

 Applicant proposes to remove the existing SR 2021, two lane, 22.5 ft total width, single span bridge having a total span length of 20 ft, and having a 3.6 ft underclearance; and to construct and maintain on the same alignment a 62 ft long, 17 ft wide, 3.75 ft underclearance box culvert with invert depressed 1 ft over Shutes Run (WWF) with a drainage area of 5.92 square miles. In addition the project includes temporary encroachments for construction and demolition, and encroachments associated with modification or replacement of road and bridge stormwater facilities. The Penndot improvement project in North Union Township (Uniontown Quadrangle, Latitude 39° 54` 28" and Longitude -79° 41` 23"), Fayette County.

E30-244. West Green School District, 367 Hargus Creek Road, Waynesburg, PA 15370, Center Township, Greene County; ACOE Pittsburgh District

 Applicant proposes to cut and/or fill approximately 420 feet, cumulatively, of two (2) unnamed tributaries to Hargus Creek (HQ-WWF), for the purpose of constructing an elementary school addition and an associated parking lot. The project is located at 1367 Hargus Creek Road, near the intersection of Hargus Creek Road with State Route 18, and the confluence of Hargus Creek with McCourtney Run. Vegetative plantings are proposed within the riparian corridor, along approximately 640 feet of the right descending bank and along approximately 440 feet of the left descending bank, of Hargus Creek, to compensate for these impacts. (Holbrook Quadrangle Latitude 39° 51` 59" and Longitude 80° 16` 56").

E65-954 Westmoreland County Industrial Development Corporation, Fifth Floor, Suite 520, 40 North Pennsylvania Ave., Greensburg, PA 15601, Unity Township, Westmoreland County, Pittsburgh ACOE District.

 Applicant proposes to construct and maintain three (3) road crossings, each with multiple utility line stream crossings, and two (2) stand-alone utility line stream crossings, of four (4) unnamed tributaries within the Ninemile Run watershed (WWF), for the purpose of installing the infrastructure (i.e. access roads and utility lines), for Phase II (an approximately 70 acre area), of the Westmoreland Air Park industrial development site. Culvert No. 1 will be a 14` wide x 4` high, pre-cast concrete box culvert. Culvert No. 2 will be a 48" diameter concrete pipe culvert. Culvert No. 3 will be a 84" diameter concrete pipe culvert. Both stand-alone utility line stream crossings will consist of 8" diameter ductile iron sanitary sewer pipe. The cumulative stream impact from these crossings will be approximately 411.3 feet; Latrobe, PA Quadrangle N: 1.39 inches, W: 6.68 inches; Latitude: 40° 15` 27.57", Longitude: 79° 25` 22.28". The project site is located near the intersection of Bayhill Road with State Route 981, in Unity Township, Westmoreland County.

E02-1551-A1 Pleasant Hills Authority, Fifth Floor, Suite 520, 1222 Cochrans Mill Road, Pittsburgh, PA 15025, South Park Township & Pleasant Hills Borough, Allegheny County, Pittsburgh ACOE District.

 Applicant proposes to amend their existing permit to include constructing and maintaining a new headworks building, along with other associated upgrades to the wastewater treatment plant, within the floodplain of Lick Run (TSF) for the purpose of preventing sanitary sewer overflows.  To construct and maintain a 7.45 mile long, 12-inch diameter natural gas gathering pipeline within the Conemaugh River Watershed (WWF). The project will entail crossings of 33 streams [including 8 UNTs to Tubmill Creek (TSF), Tubmill Creek (TSF), 11 UNTs to the Conemaugh River (CWF), the Conemaugh River (WWF), 7 UNTs to East Branch Richards Run (CWF) and East Branch Richards Run (CWF)] and 10 wetlands with their proposed pipeline and access roads (described below) for the purposes of transferring natural gas from the Flickinger Meter/Dehydration Site to the proposed meter at the end of the pipeline. There will be a total of 31 pipeline crossings of streams and wetlands. All pipeline crossings will consist of only temporary impacts to resources, and all but a single pipeline crossing (crossing of a wetland larger than 10 acres in size) is proposed to be permitted under the Department's General Permit No. 5. This project also proposes to cross 22 streams and wetlands with Temporary Access Roads (all proposed to be permitted under the Department's General Permit No. 8), and the following 5 permanent access roads (3 proposed to be permitted under the Department's General Permit No. 7 and two under the Department's General Permit No. 11):

 1- To remove the existing 13-foot long, 18-inch diameter pipe culvert, under the existing road located in a UNT to Tubmill Creek and construct and maintain a 13-foot long, 18-inch diameter pipe culvert.

 2- To remove the existing 24-foot long, 24-inch diameter CMP culvert, under the existing road located in a UNT to East Branch Richards Run and construct and maintain a 24-foot long, 24-inch diameter CPP culvert.

 3- To construct and maintain a 60-foot long, 12-inch diameter CPP culvert in a UNT to Tubmill Creek.

 4- To construct and maintain a 60-foot long, 18-inch diameter CPP culvert in a UNT to the Conemaugh River.

 5- To construct and maintain a 30-foot long, 18-inch diameter CPP culvert in a UNT to the Conemaugh River.

 This project proposes the following impacts: 0.12 acre of temporary wetland impact, 1,741 linear feet of temporary stream impact, and 135 linear feet of permanent stream impacts. No stream mitigation is proposed for the permanent stream loss and temporary stream impacts associated with this project. Project Beginning Point: Rachelwood & New Florence PA, Quadrangle N: 16.5 inches; W: 12.9 inches (latitude 40.3406, longitude -79.0931). Project End Point: N: 10.1 inches; W: 15.3 inches (latitude 40.4313, longitude -79.1105).

EROSION AND SEDIMENT CONTROL PERMITS

 The following parties have applied for Erosion and Sediment Control Permits for earth disturbance activities associated with either road maintenance or timber harvesting operations.

 Unless otherwise indicated, on the basis of preliminary review and application of lawful standards and regulations, the Department proposes to issue a permit to discharge, subject to certain limitations in the permit conditions. These proposed determinations are tentative. Limitations are provided as erosion and sediment control best management practices which restrict the rate and quantity of sediment discharged.

 A person wishing to comment on a proposed permit are invited to submit a statement to the appropriate Department regional office listed before the application within 30 days of this public notice. Comments reviewed within this 30-day period will be considered in the formulation of the final determinations regarding this application. Responses should include the name, address and telephone number of the writer and a concise statement to inform the Department of the exact basis of a comment and relevant facts upon which it is based. A public hearing may be held after consideration of comments received by the appropriate Department regional office during the 30-day public comment period.

 Following the 30-day comment period, the appropriate regional office water management program manager will make a final determination regarding the proposed permit. Notice of this determination will be published in the Pennsylvania Bulletin at which time this determination may be appealed to the Environmental Hearing Board (Board).

 The application and related documents, including the erosion and sediment control plan for the earth disturbance activity, are on file and may be inspected at the appropriate regional office.

 This proposed facility is located in New Holland Borough, Lancaster County.

 Description of Proposed Action/Activity: Permit approval for upgraded industrial wastewater facilities consisting of: The existing activated sludge treatment facility will be converted to a multi-stage Biological Nitrogen Removal (BNR) facility employing nitrification/denitrification to reduce Total Nitrogen and continuing to use Aluminum Chloride to reduce Total Phosphorus. A fine screen will be added after the primary screen. The chlorine disinfection will be changed to Ultraviolet Disinfection with a concrete contact tank and two banks of UV lights each sized to provide disinfection at peak throughput flow of 2.0 MGD and each equipped with an automatic chemical/mechanical cleaner. The existing chlorine contact tank will be used as a post-aeration tank or kept as a backup for chlorine disinfection if such is ever needed. (Note: only one Dissolved Aeration Flotation (DAF) tank is built and in use whereas two DAF units had been originally planned and included in the January 20, 1991 permit amendment).

 Description of Proposed Action/Activity: The construction and operation of a new treatment facility to be located adjacent to the existing facility. The proposed upgrades are aimed to comply with the Chesapeake Bay nutrient limitations in NPDES permit PA0026310, eliminate the combined sewer overflow (CS0, Outfall 039) at the plant, and to replace the existing aging infrastructure.

 The proposed new facilities are part of a 5 stage step feed Bardenpho BNR process capable of treating high peak influent flows. The system will have 3 treatment trains operating in parallel and consist of the following: influent wastewater pumping station, headworks/pretreatment building, vortex grit separators (2), fine screens (2), influent distribution box, reactor tanks (3), aeration blowers, final clarifier influent distribution box, final/secondary clarifiers (3), UV system, effluent channel and flow meter, RAS distribution box and pumps, maintenance buildings, chemical feed systems, sludge processing and storage systems, flow conveyance channels/pipes and pumps, and a Supervisory Control and Data Acquisition (SCADA) system, and a new outfall structure utilizing cascade aeration.

 This existing facility is located in Sullivan Township, Tioga County.

 Description of Proposed Action/Activity: Country View Family Farms, LLC is proposing the construction of a new sow barn with underbarn manure storage that measures 125`-6" wide, 812` long, and will have a 6` depth. The total storage capacity will be approximately 3.716 million gallons. The proposed barn will increase the existing Animal Equivalent Units (AEUs) by 1,600.90. A new foundation/leak detection system will also be installed at the perimeter of the footings and will collect at an observation well.
