MINING

APPLICATIONS TO CONDUCT COAL AND NONCOAL ACTIVITIES

MINING ACTIVITY APPLICATIONS

   Applications under the Surface Mining Conservation and Reclamation Act (52 P. S. §§ 1396.1--1396.19(a)); the Noncoal Surface Mining Conservation and Reclamation Act (52 P. S. §§ 3301--3326); The Clean Streams Law (35 P. S. §§ 691.1--691.1001); the Coal Refuse Disposal Control Act (52 P. S. §§ 30.51--30.66); The Bituminous Mine Subsidence and Land Conservation Act (52 P. S. §§ 1406.1--1406.21). Mining activity permits issued in response to such applications will also address the applicable permitting requirements of the following statutes: the Air Pollution Control Act (35 P. S. §§ 4001--4015); the Dam Safety and Encroachments Act (32 P. S. §§ 693.1--693.27); and the Solid Waste Management Act (35 P. S. §§ 6018.101--6018.1003).

   The following permit applications to conduct mining activities have been received by the Department of Environmental Protection (Department). A copy of the application is available for inspection at the District mining office indicated above each application. Where a 401 water quality certification is needed for any aspect of a particular proposed mining activity, the submittal of the permit application will serve as the request for the certification.

   Written comments or objections, or requests for informal conferences on applications, may be submitted by any person or any officer or head of any Federal, State or local government agency or authority to the Department at the same address within 30 days of this publication, or within 30 days after the last publication of the applicant's newspaper advertisement, as provided by 25 Pa. Code §§ 77.121--77.123 and 86.31--86.34 (relating to public notices of filing of permit applications, opportunity for comment, and informal conferences).

   Where any of the mining activities listed will have discharges of wastewater to streams, the Department will incorporate NPDES permits into the mining activity permits issued in response to these applications. The NPDES permits will contain, at a minimum, technology-based effluent limitations (as described in the Department's regulations--25 Pa. Code §§ 77.522, 87.102, 88.92, 88.187, 88.242, 89.52 and 90.102) for iron, manganese, suspended solids, settleable solids, alkalinity and pH. In addition to the above, more restrictive effluent limitations, restrictions on discharge volume or restrictions on the extent of mining which may occur will be incorporated into a mining activity permit when necessary for compliance with water quality standards (in accordance with 25 Pa. Code Chapters 93 and 95). Persons or agencies which have requested review of the NPDES permit requirements for a particular mining activity within the above-mentioned public comment period will be provided with a 30-day period to review and submit comments on those requirements.

   Written comments or objections should contain the name, address and telephone number of persons submitting comments or objections; application number; and a statement of sufficient detail to inform the Department on the basis of comment or objection and relevant facts upon which it is based. Requests for an informal conference must contain the name, address and telephone number of requestor; application number; a brief summary of the issues to be raised by the requestor at the conference; and a statement whether the requestor desires to have the conference conducted in the locality of the proposed mining activities.

   32920104.  Permit Revision. Opal Industries, Inc. (P. O. Box 980, Latrobe, PA 15650), revision to an existing bituminous strip operation to change the postmining land use from forestland to pastureland on the Steve Skapura property in Conemaugh Township, Indiana County, affecting 88.0 acres. Receiving streams unnamed tributary to/and Blacklegs Creek. Application received October 6, 1997.

   32960102.  Permit Revision. John R. Yenzi, Jr. (P. O. Box 287, Anita, PA 15711). The permit revision involves the addition of coal mining acreage as follows: On the Upper Freeport Seam, an additional 2.2 coal mining acres, on the Lower Freeport Seam, an additional 12.1 coal mining acres, and 20 Lower Freeport auger acres. Also, a request has been made to modify the proposed land usages on the properties of Genevieve, Raynold and Karen Haverilla, James Timblin, William Mahan and Sylvia Ferrara. Instead of returning these areas to forestland, it has been proposed to return them to pastureland or land occasionally cut for hay. The revision is located in Canoe Township, Indiana County, affecting 262 acres. Receiving stream unnamed tributaries to Canoe Creek to Canoe Creek to Little Mahoning Creek.    32960104.  D. J. & W. Mining, Inc. (P. O. Box 425, Indiana, PA 15701). Boundary revision to add 8.4 acres to an existing bituminous surface mine permit for additional mining of the Lower Freeport coal seam. Total SMP acres goes from 71.0 to 79.4. APPLICATIONS RECEIVED UNDER SECTION 401: FEDERAL WATER POLLUTION CONTROL ACT

ENCROACHMENTS

   The following permit applications and requests for Environmental Assessment approval and requests for water quality certification have been received by the Department of Environmental Protection (Department).

   In addition to permit applications, the Bureau of Dams, Waterways and Wetlands (BDWW) and the Regional Office Soils and Waterways Sections have assumed primary responsibility for processing requests for certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)), for projects requiring both a Dam Safety and Encroachments Permit, and a United States Army Corps of Engineers (ACOE) permit. Section 401(a) of the Federal Water Pollution Control Act requires the State to certify that the involved projects will not violate the applicable provisions of 33 U.S.C.A. §§ 1301--1303, 1306 and 1307, as well as relevant State requirements. Initial requests for 401 certification will be published concurrently with the BDWW permit application. Persons objecting to approval of a request for certification under section 401 or to the issuance of a Dam Safety or Encroachment Permit, or the approval of Environmental Assessments must submit comments, suggestions or objections within 30 days of the date of this notice as well as any questions to the Bureau or Field Office indicated as the responsible office.

To expand, operate and maintain Gricco's Marine Service, Inc. facilities situated along the northern bank of the Delaware River by installing and maintaining a 90-foot long addition attached at the terminus of the existing floating dock. The proposed floated dock system would extend a total length of 270 feet waterward of the existing low water line and would provide 29 mooring slips occupying approximately 0.7 acre of the submerged lands of this Commonwealth. The project is located in the town of Essington, approximately 200 feet south of the intersection of Front Street and Bartram Avenue (Bridgeport, NJ-PA Quadrangle N: 19.8 inches; W: 6.5 inches) in Tinicum Township, Delaware County.

   E15-556.  Encroachment. PA DOT, 200 Radnor Chester Rd., St. Davids, PA 19087-5178. To remove a steel girder bridge and to construct and maintain a single-span prestressed concrete spread box beam bridge with a clear span of 50 feet and an underclearance of 9 feet 2 inches on a 76 degree skew. This bridge spans Bucks Run along Park Avenue (SR 3077 Section 67S) (Coatesville, PA Quadrangle N: 12.2 inches; W: 15.75 inches) in East Fallowfield and Highland Townships, Chester County.

   E46-787.  Encroachment. Gambone Brothers, 1030 W. Germantown Ave., Fairview Village, PA 19409. To divert stormwater runoff into approximately 1,750 feet of storm sewer piping between Cassel Road and the proposed stormwater detention basin located at the southwest corner of the proposed Cassel Mill Farm Residential Subdivision and also to relocate an unnamed tributary of the Skippack Creek (TSF) through approximately 210 linear feet of pipe and approximately 1,425 feet of open channel. This subdivision is located just east of the intersection of Mill Road (SR 4005) and Cassel Road (Collegeville USGS Quadrangle N: 13.2 inches; W: 6.2 inches) in Skippack Township, Montgomery County.

   Northcentral Region, Water Management, Soils and Waterways Section, F. Alan Sever, Chief, 208 West Third St., Suite 101, Williamsport, PA 17701.

   E41-411.  Encroachment. Hepburn Township Supervisors, 4350 Bloomingrove Rd., Williamsport, PA 17701. To remove a gravel bar and miscellaneous debris in order to divert approximately 850 feet of Mill Creek from its current bed into the original stream channel. The project is located near the Hepburn Township maintenance building off SR 973 approximately 2 miles northeast of the intersection of SR 973 and US Rt. 15 (Cogan Station, PA Quadrangle N: 11.2 inches; W: 6.0 inches) in Hepburn Township, Lycoming County. Estimated stream disturbance is 850 feet of waterway with no wetland impact; stream classification is stocked trout fishery.

   E53-300.  Encroachment. Pa. Dept. of Transportation, 1924-30 Daisy St., Clearfield, PA 16830. To remove an existing structure and to construct, operate and maintain a twin cell precast concrete box culvert to carry SR 1011, Seg-offset 0090/0000 across the Genesee River. The twin cell culvert shall be constructed with a span of 20.0 feet, a rise of 7.0 feet and a skew of 90 degrees. The project is located along the eastern right-of-way of SR 0449 approximately 2,000 feet south of the intersection of T-407 and SR 1011 (Ulysses, PA Quadrangle N: 12.7 inches; W: 9.3 inches) in Bingham Township, Potter County. Estimated stream disturbance is 85 linear feet of stream with no wetland impact; stream classification is cold water fishery.

   E02-1206.  Encroachment. North Fayette Township, 400 North Branch Road, Oakdale, PA 15071. To construct and maintain a 13.0-foot steel plate arch culvert with 6.75 feet of underclearance and a length of 95 feet in an unnamed tributary to North Branch Robinson Run (WWF) and to place and maintain fill in 0.47 acre of wetlands (PEM) for the purpose of accessing a proposed residential development known as Manor at Stonebridge (Oakdale, PA Quadrangle N: 9.4 inches; W: 12.8 inches) in North Fayette Township, Allegheny County.

   E02-1207.  Encroachment. McCandless Township, 9957 Grubbs Road, Wexford, PA 15090. To place and maintain fill for an approximate distance of 200 feet in the floodway of Rinaman Run (CWF) for the purpose of stabilizing Rinaman Road located 0.9 mile south of intersection of Rinaman Road and Grubbs Road (Emsworth, PA Quadrangle N: 17.2 inches; W: 5.5 inches) in McCandless Township, Allegheny County.

   E02-1208.  Encroachment. McKees Rocks Industrial Enterprises, Inc., Nichol Ave., McKees Rocks, PA 15136. To operate and maintain the existing barge docking facility and to construct and maintain a 0.3 dock expansion in the Ohio River (WWF) (McKees Rocks, PA Quadrangle N: 19.7 inches; W: 8.3 inches) in McKees Rocks, Allegheny County.

   E03-336.  Encroachment. PA Department of Transportation, P. O. Box 429, Indiana, PA 15701. To remove existing structure and to construct and maintain a 3-span bridge with a 47-foot underclearance over the Allegheny River (WWF) located on SR 0128 at the southwest end of Ford City (Kittanning, PA Quadrangle N: 2.1 inches; W: 6.3 inches) in Borough of Ford City, Manor Township and North Buffalo Township.

   E11-256.  Encroachment. PA Department of Transportation, 1620 North Juniata Street, Hollidaysburg, PA 16648. To remove the existing bridge and to construct and maintain a prestressed concrete spread box beam bridge having a single normal span of 31.5 feet and a minimum underclearance of 7.0 feet over Clearfield Creek (WWF); to place and maintain fill in 0.11 acre of PEM wetlands for the purpose of widening the bridge; and to construct and maintain a temporary stream crossing consisting of four 60-inch pipes in Clearfield Creek during construction. The project is located along SR 1005, 150 feet north of its intersection with Township Road T542 (Cresson, PA Quadrangle N: 20.1 inches; W: 14.7 inches) in Allegheny Township, Cambria County. The wetland loss will be compensated by Advance Wetland Construction at State Game Lands No. 108.

   E11-257.  Encroachment. Windber Area Authority, 1700 Stockholm Ave., Windber, PA 15963-2061. To operate and maintain a 11.5 foot × 7.5 foot corrugated metal arch pipe and one 8-foot diameter CMP installed under Emergency Permit EP1196207. The pipes were installed at one location to provide access to the Windber Area Sewage Treatment Plant (Johnstown, PA Quadrangle N: 1.7 inches; W: 2.2 inches) in Richland Township, Cambria County.

   E26-240.  Encroachment. Redstone Township, Box 211, Twin Hills Road, Grindstone, PA 15442. To construct and maintain a flood protection project along 1,200 feet of Dunlap Creek (WWF) consisting of sediment removal and fill placement (New Salem, PA Quadrangle N: 12.1 inches; W: 14.3 inches) in Redstone Township, Fayette County.

   E65-676.  Encroachment. South Gate Plaza, R. R. 2, Golfland Bldg., Belle Vernon, PA 15012. To place and maintain fill in 0.1 acre of wetland (PEM) and to construct and maintain 0.1 acre of wetlands on site as part of proposed commercial development known as South Gate Plaza (Donora, PA Quadrangle N: 11.0 inches; W: 9.5 inches) in Rostraver Township, Westmoreland County.

   E02-1209.  Encroachment. Manorcare Health Services, Inc., 11555 Darnestown Road, Gaithersburg, MD 20878. To place and maintain fill in 0.1 acre of wetlands (PEM) for the purpose of constructing an assisted living facility just east of the intersection of Anderson Lane, Wyngate Drive and Tech One Drive (Braddock, PA Quadrangle N: 10.6 inches; W: 4.4 inches) in Monroeville Borough, Allegheny County.

   E26-239.  Encroachment. Friends of George C. Marshall Inc., P. O. Box 696, Uniontown, PA 15401. To place and maintain a 26-foot span bridge on existing abutments in Coal Lick Run (WWF) for the purpose of accessing proposed George C. Marshall Memorial Plaza located at the intersection of south and north Mt. Vernon Avenues (Uniontown, PA Quadrangle N: 4.65 inches; W: 14.85 inches) in the City of Uniontown, Fayette County.

   E65-677.  Encroachment. Glimcher Devcor, Inc., One Mellon Bank Center, 500 Grant Street, Suite 200, Pittsburgh, PA 15218. To place and maintain fill in 0.42 acre of wetlands (PEM) for the purpose of commercial development located between S. R. 0070 and Finley Road (Donora, PA Quadrangle N: 2.25 inches; W: 10.75 inches) in Rostraver Township, Westmoreland County.

DAM SAFETY

   D10-064A.  Dam. Treesdale Golf and Country Club (One Arnold Palmer Drive, Gibsonia, PA 15044). To modify, operate and maintain Pond No. 1 dam at the Treesdale Golf and Country Club. This dam is located across a Tributary to Breakneck Creek (WWF) (Mars, PA Quadrangle N: 10.1 inches; W: 0.5 inch) in Adams Township, Butler County. The dam is currently used for recreation and will also be used for stormwater detention for the remaining phases of the Four Lakes development.

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications and requests for plan approval and has issued the following significant orders.

   Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and 2 Pa.C.S. §§ 501--508 and 701--704 (relating to the Administrative Agency Law) to the Environmental Hearing Board, 400 Market Street, Second Floor, P. O. Box 8457, Harrisburg, PA 17105-8457, (717) 787-3483. Appeals must be filed with the Environmental Hearing Board within 30 days of receipt of written notice of this action unless the appropriate statute provides a different time period. The project is located on the west side of Big Spring Road (T-510) approximately 600 feet north of Route 422 (Sinking Spring, PA Quadrangle N: 18.2 inches; W: 16.9 inches). Drainage will be to Furnace Creek.

Approvals to Use NPDES and/or Other General Permits

   The following parties have submitted Notices of Intent (NOIs) for Coverage under (1) General NPDES Permit(s) to discharge wastewater into the surface waters of this Commonwealth. The approval for coverage under these general NPDES permits is subject to applicable effluent limitations, monitoring, reporting requirements and other conditions set forth in the general permit; (2) General Permit(s) for Beneficial Use of Sewage Sludge or Residential Septage by Land Application in Pennsylvania. The approval of coverage for land application of sewage sludge or residential septage under these general permits is subject to pollutant limitations, pathogen and vector attraction reduction requirements, operational standards, general requirements, management practices and other conditions set forth in the respective general permit. The Department of Environmental Protection approves the following coverages under the specified General Permit.

   The EPA Region III Regional Administrator has waived the right to review or object to this permit action under the waiver provision: 40 CFR 123.24.

   The application and related documents, effluent limitations, permitting requirements and other information are on file and may be inspected and arrangements made for copying at the contact office noted.
