Public Notice of Proposed Consent Order and Agreement
Sandy Lake Asbestos Site
Stoneboro Borough, Mercer County Under section 1113 of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), the Department of Environmental Protection (Department) has agreed to a de minimis Consent Order and Agreement (Agreement) with the Lakeside Park Company, Robert R. Gillette, Bessie G. Gillette, the Estate of Homer B. Widel (Julie M. Widel, Executrix) (collectively, referred to as Lakeside) and the Sandy Creek Conservancy (Conservancy), concerning the resolution of Lakeside's liability for the Sandy Lake Asbestos Site (Site). The Site is located on a 31.75-acre parcel between the former Penn Central Railroad Line and Route 845 in Stoneboro Borough, Mercer County, PA.
In the past, asbestos containing wastes were disposed at the Site and this waste contaminated the environment at the Site. Asbestos is defined in section 103 of HSCA (35 P. S. § 6020.103) as a ''hazardous substance.'' The Department expects to incur approximately $350,000 to remove the asbestos wastes for proper disposal off-site. As owners of the Site during the time of the release and threatened release of hazardous substances at the Site, the members of Lakeside are each a ''responsible person'' as defined in section 103 of HSCA. Under the terms of the Agreement, Lakeside shall donate the 31.75-acre parcel that contains the Site to the Conservancy for public benefit in perpetuity.
The Department anticipates that it will remove the asbestos wastes from the Site during the summer of 2000. This response will help mitigate the threat to human health and the environment posed by the asbestos wastes there.
The specific terms of this settlement are set forth in the Agreement with Lakeside and the Conservancy. The Department will receive and consider comments relating to the Agreement for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations which indicate that the Agreement is inappropriate, improper, or not in the public interest.
After the public comment period, the Department's settlement with Lakeside and the Conservancy shall be effective upon the date that the Department notifies Lakeside and the Conservancy, in writing, that this Agreement is final and effective in its present form, and that the Department has filed a response to significant written comments to the Agreement, or that no such comments were received.
The Agreement is available for inspection and copying at the Department's office at 230 Chestnut Street, Meadville, PA. Comments may be submitted, in writing, to James W. (CERCLA), has entered into a de minimis settlement with Aukland Automotive Shop for reimbursement of certain response costs incurred to remediate hazardous substances disposed at the Sellersville Inactive Landfill (Site). This Site is located at the corner of Main and Twelfth Streets, in the Borough of Sellersville, Bucks County, PA.
Between the 1940s and the 1970s, the Site was used as an unpermitted dump for municipal, residual and hazardous wastes. Radioactive and nonradioactive hazardous substances were released on a 2-acre portion of the Site. Under its authority under section 501(a) of HSCA (35 P. S. § 6020.501(a)), the Department conducted a response action to remediate hazardous substances disposed on the Site. The Department incurred $6,106,720.50 in response costs to abate the release and threat of release of hazardous substances at the Site. The Department has determined that the amount of hazardous substances contributed by Aukland Automotive Shop is minimal; the toxic or other hazardous effect of these substances is minimal and these substances have caused only a minor portion of the response costs. Thus, it is in the public interest for the Department to resolve its claim against Aukland Automotive Shop in a de minimis settlement agreement. Aukland Automotive Shop shall reimburse the Department for certain response costs in the amount of $1,000.
This notice is provided under section 1113 of HSCA (35 P. S. § 6020.1113), which provides that ''settlement shall become final upon the filing of the Department's response to the significant written comments.'' LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908) and Chapter 250 Administration of Land Recycling Program.
Provisions of 25 Pa. Code § 250.8 Administration of Land Recycling Program requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act (act). Plans and reports required by provisions of the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigations, concentration of regulated substances in environmental media, benefits of reuse of the property, and in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

A Final Report concerning remediation of site soil contaminated with petroleum hydrocarbons and polycyclic aromatic hydrocarbons was submitted to the Department. The report demonstrated attainment of the Statewide health standard and was approved by the Department on April 13, 1998.
Doyle Dawson, Sr. Property, Phoenixville Borough, Chester County. Jeremy W. Bolyn, Earth Data, Inc., 924 Springdale Drive, Exton, PA 19341, has submitted a Final Report concerning remediation of site soil and groundwater contaminated with lead, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on May 16, 2000.
Spring Mill Development, Inc., Plymouth Township, Montgomery County. Darryl D. Borrelli, Manko, Gold & Katcher LLP, 401 City Avenue, Suite 500, Bala Cynwyd, PA 19004, has submitted a Site Characteriza- tion/Risk Assessment/Cleanup Plan concerning remediation of site soil contaminated with lead, heavy metals, pesticides, solvents, BTEX, petroleum hydrocarbons and polycyclic aromatic hydrocarbons. The report was approved by the Department on May 22, 2000.
Yocum Residence, Westtown Township, Chester County. Brian R. Evans, Hydrocon Services, Inc., 2945 South Pike Avenue, Allentown, PA 18103, has submitted a Final Report concerning remediation of site soil contaminated with petroleum hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on May 22, 2000.
Medders Residence, Willistown Township, Chester County. Brian R. Evans, Hydrocon, Inc., 2945 South Pike Avenue, Allentown, PA 18103, has submitted a Final Report concerning remediation of site soil contaminated with BTEX, and polycyclic aromatic hydrocarbons. The report demonstrated attainment of the Statewide health standard and was approved by the Department on May 24, 2000.

PPL, Environmental Management Division, 2 North Ninth Street, Allentown, PA 18101 submitted a Final Report concerning the remediation of site soils found to be contaminated with PCBs (polychlorinated biphenyls). The final report demonstrated attainment of the Statewide health standard, and was approved on May 29, 1998.

GPU Hollidaysburg Pole Storage Yard, Hollidaysburg Borough, Blair County. A Final Report has been submitted concerning remediation of site soils contaminated with PHCs and PAHs. The Final Report demonstrated attainment of the Statewide health standard, and was approved by the Department on April 22, 1998.

The limit of this work will begin at the Montgomery/Chester County boundary (Valley Forge, PA USGS Quadrangle N: 14.4 inches; W: 4.5 inches) and will end just east of Gulph Road (Valley Forge, PA USGS Quadrangle N: 15.6 inches; W: 1.8 inches) in Upper Merion Township, Montgomery County. The proposed work will include the following: To remove a series of existing structures under U. S. Route 202 and North Gulph Road, including two concrete bridges with a 25-foot clear span and one 25-foot by 8-foot box culvert in and along Crow Creek (WWF) (a.k.a. Abrams Run). All these structures will be replaced with a 196 linear foot stream enclosure consisting of a span of 25 feet and a rise of 8 feet. This structure will consist of both cast-in-place and pre-cast segments.
