WATER ALLOCATIONS

   WA 5-512E, Water Allocations. Bedford Borough Water Authority, Bedford County. The Authority was granted the right to withdraw 0.4 million gallons per day (mgd), based on a 30 day average, from the J. C. Smith Reservoir; 0.3 mgd, based on a 30 day average, from the Todd Reservoir; 0.2 mgd, based on a 30 day average, from the Milburn Reservoir; and a maximum of 1.8 mgd, when available, from the Raystown Branch of the Juniata River, located in Bedford Township, Bedford County. Furthermore, the Authority is granted the right to withdraw up to a maximum of 1.8 mgd from the J. C. Smith Reservoir and/or the Todd Reservoir provided that water is discharging over the reservoir spillways as a result of the reservoirs being at full capacity and/or the water level in the reservoirs is within 24 inches of the full capacity water elevation. SEWAGE FACILITIES ACT PLAN APPROVAL

   Plan Description: The approved plan provides for a sewer extension to serve the Route 15 area of Covington Township located to the north of Putnam Township. The extension will consist of a combination of gravity and pressure sewers. Sewage will flow into the Richmond Municipal Authority's system and be conveyed to the Mansfield Borough sewage treatment plant. The Department's review of the sewage facilities update revision has not identified any significant environmental impacts resulting from this proposal.

PUBLIC NOTICE OF PROPOSED CONSENT ORDER AND AGREEMENT

Avtex Adjunct Mercury Sites

Crawford County

   Under section 1113 of the Hazardous Sites Cleanup Act (35 P. S. §§ 6020.101--6020.1305) (HSCA), notice is hereby provided that the Department of Environmental Protection (Department) has agreed to a de minimis Consent Order and Agreement (Agreement) with Ralph Hunter, Inc. (Hunter) concerning the resolution of its liability for the Avtex Fibers, Inc. mercury release and the Avtex Adjunct Mercury Sites (Sites). The Sites are located at 33 separate locations in Hayfield, Richmond, Spring, Union, Venango, Vernon and Woodcock Townships, Crawford County.

   In 1995 and 1996, Hunter transported mercury-containing wastes (wastes) from the Avtex Fibers, Inc. facility in Vernon Township, Crawford County for use as fill material to various locations. The Sites received wastes for road base in the construction of access roads used for timbering, oil and gas exploration and residential driveways. These wastes contaminated the environment at the Sites. Mercury in the wastes is defined in section 103 of HSCA (35 P. S. § 6020.103) as a ''hazardous substance.'' To date, the Department has removed the wastes from most of the Sites for proper off-site disposal (response). These responses will continue into the construction season for the year 2001, until all remaining specific Sites are completed. The estimated cost for all the responses for the Sites is approximately $1,318,309. Those responses mitigated the threat to human health and the environment posed by the wastes.

   As a transporter and operator during the time of the release and threatened release of hazardous substances at the Sites, Hunter is a ''responsible person'' as defined in section 103 of HSCA (35 P. S. § 6020.103). Under the terms of the Agreement, Hunter shall pay the Department $48,000 to resolve its liability at the Sites. The specific terms of this settlement are set forth in the Agreement between Hunter and the Department. The Department will receive and consider comments relating to the Agreement for 60 days from the date of this Public Notice. The Department has the right to withdraw its consent to the Agreement if the comments concerning the Agreement disclose facts or considerations, which indicate that the Agreement is inappropriate, improper, or not in the public interest.

   After the public comment period, the Department's settlement with Hunter shall be effective upon the date that the Department notifies Hunter, in writing, that this Agreement is final and effective in its present form, and that the Department has filed a response to significant written comments to the Agreement, or that no such comments were received.

   The Agreement is available for inspection and copying at the Department's office at 230 Chestnut Street, Meadville, PA. LAND RECYCLING AND ENVIRONMENTAL REMEDIATION
UNDER ACT 2, 1995

The following final reports were submitted under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of Chapter 3 of the Land Recycling and Environmental Remediation Standards Act (Act) require the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of submission of final reports. A final report is submitted to document cleanup of a release of a regulated substance at a site where one of the Act's remediation standards. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis for selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed, and summaries of sampling analytical results which demonstrate that remediation has attained the cleanup standard selected.

   For further information concerning the final report, please contact the Environmental Cleanup Program Manager in the Department of Environmental Protection Regional Office under which the notice of receipt of a final report appears. The report is intended to document remediation of the site to meet Statewide Health and Site-specific Standards.

   Jarrell & Rea Property, 2nd Ward, City of Pittsburgh, Allegheny County. David R. Davis, Baker Environmental, Inc., AOP Building 3, 420 Rouser Road, Coraopolis, PA 15108 (on behalf of Bet-Tech International, 1150 Broadhead Road, Monaca, PA 15061-2500 and County of Beaver, 810 Third Street, Beaver, PA 15009-2191) has submitted a Remedial Investigation Report, Risk Assessment Report and a Cleanup Plan concerning remediation of site soil and groundwater contaminated with lead, heavy metals, and PAHs. The Department has taken action on the following plans and reports under the Land Recycling and Environmental Remediation Standards Act (35 P. S. §§ 6026.101--6026.908).

   Provisions of 25 Pa. Code § 250.8, Administration of the Land Recycling and Environmental Remediation Standards Act (Act) requires the Department of Environmental Protection (Department) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the Land Recycling and Environmental Remediation Standards Act. Plans and reports required by provisions of the Act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation, concentration of regulated substances in environmental media; benefits of refuse of the property and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. A cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or non-residential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. The Department may approve or disapprove plans and reports submitted. This notice provides the Department's decision and, if relevant, the basis for disapproval.

PPL Generation, LLC, Environmental Management Division, 2 North Ninth Street, Allentown, PA, 18101 submitted a Final Report concerning the remediation of site soils found or suspected to have been contaminated with PCBs (polychlorinated biphenyls). The final report demonstrated attainment of the Statewide health standard, and was approved on March 19, 2001.

   Mercury Cleaners-Keyser Oaks Shopping Center, City of Scranton, Lackawanna County. Wesley P. Fitchett, P.G., Director of Remediation Services, Property Solutions, Inc., 501 Delran Parkway, Unit A, Delran, NJ 08075 submitted an Final Report (on behalf of his client, Overlook Towers Partnership, c/o Juster Properties, 2001 West Main Street, Suite 244, Stamford, CT 06902) concerning the remediation of site soils found to have been contaminated with solvents. The final report documented attainment of the Site-specific standard and was approved on March 21, 2001. The Remedial Investigation Report, Risk Assessment Report and Cleanup Plan were also approved on March 21, 2001.

This facility was formerly owned by Statoil Energy/Paxton, LP. The facility's major sources of emissions includes boilers and engines which primarily emit NOx. This amendment is Revision # 1 of the facility's Title V Operating Permit.

   59-00005: Dominion Transmission Corp. Box 19002, Green Bay, WI 54307-9002) issued a revised Title V Operating Permit on March 19, 2001, to include applicable monitoring requirements for two combustion turbines in Shamokin Dam Borough, Snyder County.

   41-00024: Divine Providence Hospital (1100 Grampian Boulevard Williamsport, PA 17701) issued a revised Title V Operating Permit, Revision No. 1, on February 12, 2001, to include conditions from Plan Approval No. 41-00024A for operation of a 12.55 MMBtu/Hr natural gas/No. 2 fuel oil fired boiler in Williamsport, Lycoming County.
