SPECIAL NOTICES

Certified Emission Reduction Credits in the Commonwealth's ERC Registry

   Emission reduction credits (ERCs) are surplus, permanent, quantified and Federally enforceable emission reductions used to offset emission increases of oxides of nitrogen (NOx), volatile organic compounds (VOCs) and the following criteria pollutants: carbon monoxide (CO), lead (Pb), oxides of sulfur (SOx), particulate matter (PM), PM10 and PM10 precursors.

   The Department of Environmental Protection (Department) maintains an ERC registry in accordance with the requirements of 25 Pa. Code § 127.209. The ERC registry system provides for the tracking of the creation, transfer and use of ERCs. Prior to registration of the credits, ERC Registry Applications are reviewed and approved by the Department to confirm that the ERCs meet the requirements of 25 Pa. Code §§ 127.206--127.208. Registration of the credits in the ERC registry system constitutes certification that the ERCs satisfy applicable requirements and that the credits are available for use. The following registered and certified ERCs in the ERC Registry are currently available for use as follows:

   (1)  To satisfy new source review (NSR) emission offset ratio requirements;

   (2)  To ''net-out'' of NSR at ERC-generating facilities;

   (3)  To sell or trade the ERCs for use as emission offsets at new or modified facilities.

   The certified ERCs shown, expressed in tons per year (tpy), satisfy the applicable ERC requirements contained in 25 Pa. Code §§ 127.206--127.208. ERCs created from the curtailment or shutdown of a source or facility expires for use as offsets 10 years after the emission reduction occurs. ERCs generated by the over control of emissions by an existing facility do not expire for use as offsets. However, credits in the registry that are not used in a plan approval will be discounted if new air quality requirements are adopted by the Department or United States Environmental Protection Agency.

Request for Comment and Notice of Public Meeting for the Proposed Total Maximum Daily Load (TMDL) for the Duck Run Watershed in
Lawrence County

   The Department of Environmental Protection (Department) is holding a public meeting to discuss and accept comments on a proposed TMDL for the Duck Run Watershed in Lawrence County. The meeting will be held on November 10, 2008, beginning at 11 a.m. at the Knox District Office in Knox, PA. The proposed TMDL was developed in accordance with the requirements of The Clean Water Act, section 303(d). One stream segment in the Duck Run Watershed has been identified as impaired on the 1996, 1998, 2002, 2004, 2006 and 2008, Pennsylvania section 303(d) lists due to high concentrations of metals. The listed segment and miles degraded are shown in the following table:

   The proposed plan provides calculations of the stream's total capacity to accept metals (aluminum, iron, manganese and acidity), pH and maintain levels below water quality criteria. The applicable water quality criteria are as follows:

   The primary pollutant source for the watershed is abandoned mine workings. This watershed was heavily mined for coal in the late 19th century and mining continues on a smaller scale today. The effects of this are still present. The TMDL consists of load allocations, which are made to nonpoint sources of pollution and waste load allocations which are established for permitted point sources.

   The TMDL was developed using Monte Carlo Simulation to determine long-term average concentrations that each stream segment could accept and still meet water quality criteria 99% of the time. Monte Carlo Simulation allows for the expansion of a data set based on its statistical makeup. Since there was no critical flow condition where criteria were exceeded, the Department used the average flow to express the loading values in the TMDL.

   The TMDL sets allowable loading rates for metals and acidity at specified points in the watershed. The basis of information used in the establishment of this TMDL is field data collected over a 10 year period.

   The data and all supporting information used to develop the proposed TMDL are available from the Department. Request for Comment and Notice of Public Meeting for the Proposed Total Maximum Daily Load (TMDL) for the Little Connoquenessing Creek Watershed in Butler County

   The Department of Environmental Protection (Department) is holding a public meeting to discuss and accept comments on a proposed TMDL for the Little Connoquenessing Creek Watershed in Butler County. The meeting will be held on November 10, 2008, beginning at 9 a.m. at the Knox District Office in Knox, PA. The proposed TMDL was developed in accordance with the requirements of The Clean Water Act, section 303(d). Twenty-seven stream segments in the Little Connoquenessing Creek Watershed have been identified as impaired on the 1996, 1998, 2002, 2004, 2006 and 2008, Pennsylvania 303(d) lists due to high concentrations of metals. The listed segments and miles degraded are shown in the following table:

   The Department of Environmental Protection (Department) will hold a public meeting to discuss and accept comments on a proposed TMDL for the Moshannon Creek Watershed in Clearfield and Centre Counties. The meeting will be held on Tuesday, November 25, 2008, beginning at 7 p.m. at the Rush Township Building located at 150 North Richard Street in Philipsburg, PA. Individuals who plan to make a presentation at the public meeting should contact John Mital, Moshannon District Mining Office, at (814) 342-8200 no later than 4 p.m. on Monday, November 24, 2008. The Department will consider all comments in developing the final TMDL for the Moshannon Creek Watershed, which will be submitted to the Environmental Protection Agency for approval.

   The proposed TMDL for the Moshannon Creek Watershed was established in accordance with the requirements of The Clean Water Act, section 303(d). The main stem of Moshannon Creek has been identified as being impaired on the 1996 Pennsylvania section 303(d) list due to depressed pH and/or high concentrations of metals.
