LAND RECYCLING AND ENVIRONMENTAL REMEDIATION

UNDER ACT 2, 1995
PREAMBLE 3


The Department Has Taken Action on the Following Plans and Reports Under the Land Recycling and Environmental Remediation Standards Act (35 P.S. §§ 6026.101—6026.907).

 Section 250.8 of 25 Pa. Code and administration of the Land Recycling and Environmental Remediation Standards Act (act) require the Department of Environmental Protection (DEP) to publish in the Pennsylvania Bulletin a notice of its final actions on plans and reports. A final report is submitted to document cleanup of a release of a regulated substance at a site to one of the remediation standards of the act. A final report provides a description of the site investigation to characterize the nature and extent of contaminants in environmental media, the basis of selecting the environmental media of concern, documentation supporting the selection of residential or nonresidential exposure factors, a description of the remediation performed and summaries of sampling methodology and analytical results which demonstrate that the remediation has attained the cleanup standard selected. Plans and reports required by the act for compliance with selection of remediation to a site-specific standard, in addition to a final report, include a remedial investigation report, risk assessment report and cleanup plan. A remedial investigation report includes conclusions from the site investigation; concentration of regulated substances in environmental media; benefits of reuse of the property; and, in some circumstances, a fate and transport analysis. If required, a risk assessment report describes potential adverse effects caused by the presence of regulated substances. If required, a cleanup plan evaluates the abilities of potential remedies to achieve remedy requirements. A work plan for conducting a baseline remedial investigation is required by the act for compliance with selection of a special industrial area remediation. The baseline remedial investigation, based on the work plan, is compiled into the baseline environmental report to establish a reference point to show existing contamination, describe proposed remediation to be done and include a description of existing or potential public benefits of the use or reuse of the property. The DEP may approve or disapprove plans and reports submitted. This notice provides DEP's decision and, if relevant, the basis for disapproval.

 1. An approximately 33` long by 16` wide extension of an existing concrete boat launch ramp, which was previously authorized by DEP File No. GP022617203, within the Youghiogheny River (WWF) and its floodway by installing 8 (eight) 4` x 16` concrete panels that interconnect with hook and eye mechanisms, resulting in 23 linear feet (LF) of permeant watercourse impacts and 0.01 acre of permanent floodway impacts;

A seasonally removable, 24` x 20` hexagonal floating dock and associated 30` x 5` gangway, which will meet Americans with Disabilities Act (ADA) accessibility requirements, along with a galvanized anchor chain and concrete column, within the Youghiogheny River and its floodway, resulting in 28 LF of permanent watercourse impacts and 0.02 acre of permanent floodway impacts. This activity may require removal or reconfiguration of a small area of bank stabilization riprap which was previously authorized by DEP File No. GP032617203;

 3. ADA accessible parking area and access walkway within the floodway of the Youghiogheny River, resulting in 0.03 acre of permanent floodway impacts. This activity may require removal or reconfiguration of a small area of bank stabilization riprap which was previously authorized by DEP File No. GP032617203; and

 4. Construction access, erosion and sediment controls, and temporary work areas needed to construct the aforementioned structures within the Youghiogheny River and its floodway, resulting in 85 LF of temporary watercourse impacts and 0.15 acre of floodway impacts.

 For the purpose of enhancing recreational fishing and boating access along the Youghiogheny River. Cumulatively, the project will result in permanent impacts to 61 LF of the Youghiogheny River and 0.06 acre of its floodway. The Department has review and approved a proposal to remove Bushong Dam to eliminate a significant threat to public safety and to restore approximately 3,000 feet of stream channel to a free-flowing condition. The proposed restoration project includes partial sediment removal within the limits of the impoundment and proposes grading and lining of the channel using native stone from the Bushong Dam. The downstream scour hole will be filled with stone from the dam and choked with graded material in phases. Once Bushong Dam is removed, the upstream timber crib dam will be removed.  This notice is a correction to the previous notice published September 28, 2024 to clarify that a public meeting will also be occurring along with the public hearing and to clarify the times for the meeting portion versus the hearing portion. The Department of Environmental Protection has scheduled a public meeting and hearing to accept comments on the hazardous waste permit renewal application and draft permit for the Keystone Cement Company, Route 329, P.O. Box A, Bath, PA 18014-0058. Notice of issuance of the draft permit was published in the Pennsylvania Bulletin on June 22, 2024.

 Keystone Cement Company is an existing permitted hazardous waste storage facility, located at Routes 329 and 987, Bath, PA, that specializes in the storage of approved liquid wastes prior to the beneficial use of the liquid waste as a fuel in the site cement kiln. The renewal permit will include a hazardous waste fuel mixing system that will be used with the tank farm, rail car unloading, and direct fuel transfer system. The renewed permit will allow the existing facility to remain in operation for another ten (10) years.

 The public meeting and hearing will be held on Monday, October 28, 2024 from 6 pm to 9 pm at the Nitschmann Middle School located at 1002 W Union Blvd, Bethlehem, PA 18018. The meeting to answer questions will take place from 6 pm to 7:30 pm and the hearing for testimony will take place from 7:40 pm to 9 pm.

 The Department requests that individuals wishing to testify at the hearing submit a written notice of intent to Colleen Connolly, Community Relations Coordinator, Keystone Cement Company Public Hearing, PA DEP, 2 Public Square, Wilkes-Barre, PA 18701-1915, or by email at coconnolly@pa.gov.

 The Department will accept notices up to the day of the hearing. The written notice should include the person's name, address, telephone number and a brief statement as to the nature of their presentation. The Department requests that individuals limit their testimony to five (5) minutes so that all individuals have the opportunity to testify.

 Written copies of oral testimony are requested. Relinquishing of time to others will not be allowed. Individuals attending the hearing will have the opportunity to testify if they so desire; however, individuals who pre-register to testify will be given priority on the agenda. Persons unable to attend the hearing may submit written statements/comments to the Department on or before October 28, 2024.
