Regulation No. 14-548 (# 3347)

 On June 23, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the Department of Human Services (Department). This rulemaking amends 55 Pa. Code Chapter 5230. The proposed regulation was published in the July 9, 2022 Pennsylvania Bulletin with a public comment period ending on August 8, 2022. The final-form regulation was submitted to the Commission on July 25, 2024.

 This regulation expands eligibility for psychiatric rehabilitation services (PRS) to include individuals 14 years of age or older but under 18 years of age, and expands the diagnoses that allow individuals to access PRS without going through the exception process by including posttraumatic stress disorder, bipolar disorder, major depressive disorder, and anxiety disorders.

 We have determined this regulation is consistent with the statutory authority of the Department (62 P.S. §§ 911 and 1021) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.

State Board of Medicine—
Licensure by Endorsement
Regulation No. 16A-4958 (# 3351)

 On August 1, 2022, the Independent Regulatory Review Commission (Commission) received this proposed regulation from the State Board of Medicine (Board). This rulemaking amends 49 Pa. Code Chapter 16 by adding §§ 16.12a, 16.12b, 16.12c, and revising 16.13(a). The proposed regulation was published in the August 13, 2022 Pennsylvania Bulletin with a public comment period ending on September 12, 2022. The final-form regulation was submitted to the Commission on July 25, 2024.

 This regulation implements Act 41 of 2019 (Act 41) (63 Pa.C.S. § 3111) which requires licensing boards and commissions to issue a license, certificate, registration, or permit to an applicant who pays fees established by the board or commission by regulation, provided the applicant meets certain criteria for eligibility. Act 41 also requires boards and commissions that issue provisional licenses, certificates, registrations, or permits to set the expiration of the provisional endorsement license by regulation.

 We have determined this regulation is consistent with the statutory authority of the Board (63 Pa.C.S. § 3111; 63 § P.S. 422.8; 63 P.S. §§ 272.101—272.301; and 63 P.S. §§ 1801—1806.1) and the intention of the General Assembly. Having considered all of the other criteria of the Regulatory Review Act, we find promulgation of this regulation is in the public interest.
