Watershed Redesigation
[31 Pa.B. 1911] The Storm Water Management Act (act) (32 P. S. §§ 680.1--680.19), requires Commonwealth counties to prepare and adopt watershed stormwater plans for designated watersheds. The intent of the act is to address the impacts of development on existing stormwater runoff levels and recommend measures to control accelerated runoff to prevent flood damage that could occur due to those development activities.
A watershed stormwater plan includes hydrologic and hydraulic evaluation of the drainage basin, consideration of existing drainage problems, existing and proposed flood control projects and their impacts, existing government regulatory mechanisms, and provides recommendations for the control of accelerated runoff as a result of development. The Department of Environmental Protection (Department) provides up to 75% funding assistance to counties for their watershed stormwater planning efforts.
Under section 14(a)(10) of the act (relating to powers and duties of the Department of Environmental Protection), the Department, in consultation with the counties, originally designated 353 watersheds in this entire Commonwealth. Those watersheds were approved by the Environmental Quality Board (Board) on May 31, 1980, with amendments on November 19, 1991, April 21, 1992, June 21, 1994, April 16, 1996, April 15, 1997, December 16, 1997 and most recently on March 20, 2001, bringing the current number of watersheds to 359.
Nine watersheds had previously been designated within Bucks County. The Bucks County Planning Commission requested that the Delaware River's direct drainage area located within the county boundary be redesignated into two separate watersheds as Delaware River (North) and Delaware River (South), for the purposes of stormwater planning under the act. On March 20, 2001, the Board approved this request to separate the watersheds at the Tinicum and Plumstead Township boundaries near the mouth of Tohickon Creek. This redesignation results in Bucks County having 10 watersheds for planning purposes.
Bucks County will take the lead role in preparing the watershed stormwater plans for the newly designated watersheds. The northern portion of the Delaware River (North) watershed drains to areas located in Northampton County. Northampton County has been informed that the redesignation will administratively affect the county. With the redesignations, Northampton County's ten watersheds, which previously were approved by the Board, result in 11 watersheds for planning purposes. The redesignation will enable Bucks County to undertake watershed planning separately, since each watershed has different topography, land uses and development pressures.
The Department conducted a preliminary evaluation of the hydrologic and hydraulic impacts of the redesignations on both of the redesignated watersheds and determined that there will not be any negative environmental impact from the redesignation action. Northampton County is expected to cooperate with Bucks County in undertaking watershed planning for the redesignated watershed within its jurisdiction.
The Department, subsequent to advertising in the Pennsylvania Bulletin on June 10, 2000, held public hearings on June 27, 2000, at the office of the Bucks County Planning Commission and on June 28, 2000, at the Lehigh County Courthouse to accept public comments on the redesignations. The Bucks County Planning Commission and the Lehigh Valley Planning Commission supported Bucks County's petition at the respective public hearings. No adverse comments were received. The public comment period following the hearings concluded on July 28, 2000, and no further comments were received.
This watershed redesignation is effective upon publication in the Pennsylvania Bulletin.
