THE PENNSYLVANIA CLEAN STREAMS LAW AND THE FEDERAL CLEAN WATER ACT

APPLICATIONS FOR NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMITS AND WATER QUALITY MANAGEMENT (WQM) PERMITS UNDER THE CLEAN STREAMS LAW AND FEDERAL CLEAN
WATER ACT

 This notice provides information about persons who have applied to the Department of Environmental Protection (DEP) for a new, renewed, or amended NPDES or WQM permit, or a permit waiver for certain stormwater discharges, or have submitted a Notice of Intent (NOI) for coverage under a General Permit. The applications and NOIs concern, but are not limited to, effluent discharges from sewage treatment facilities and industrial facilities to surface waters or groundwater; stormwater discharges associated with industrial activity (industrial stormwater), construction activity (construction stormwater), and municipal separate storm sewer systems (MS4s); the application of pesticides; the operation of Concentrated Animal Feeding Operations (CAFOs); and the construction of sewage, industrial waste, and manure storage, collection and treatment facilities. This notice is provided in accordance with 25 Pa. Code Chapters 91 and 92a and 40 CFR Part 122, implementing The Clean Streams Law (35 P.S. §§ 691.1—691.1001) and the Federal Clean Water Act (33 U.S.C.A. §§ 1251—1376).  Section I identifies the following applications and NOIs that have been received by DEP:

 • Individual and General WQM Permit Applications Received—DEP provides a 15-day public comment period for Individual WQM Permit Applications for new and reissued permits. There is no public comment period for General WQM Permit NOIs.

 • General Chapter 92a NPDES Permit NOIs Received—There is no public comment period for General NPDES NOIs received.

 • All Transfer and Minor Amendment Applications/NOIs Received—Transfer and Minor Amendment Applications/NOIs received for Individual and General WQM Permits and Individual and General NPDES Permits, excluding PAG-01 and PAG-02, are identified but do not have public comment periods. DEP provides a 15-day public comment period for Individual WQM Permit Applications for amendments.

 Additional information on these applications and NOIs may be reviewed by generating the ''Applications and NOIs without Comment Periods Report'' or, for Individual WQM Permit Applications, the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Section II identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to sewage, industrial waste, industrial stormwater, MS4s, pesticides and CAFOs. A 30-day public comment period applies to these applications and draft permits, except when a site-specific water quality criterion is used to establish effluent limitations, in which case a 45-day public comment period applies. The period for comment may be extended at the discretion of DEP for one additional 15-day period. Additional information, including links to draft permits and fact sheets that explain the basis for DEP's tentative determinations may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice. Notification of 15-day extensions for comment will be provided in the ''Applications Received with Comment Periods Report'' (Comments column).

 Section III identifies individual NPDES permit applications received and draft permits indicating DEP's tentative determination relating to stormwater discharges associated with construction activities. A 30-day public comment period applies to these applications and draft permits. The period for comment may be extended at the discretion of the Department for one additional 15-day period. Additional information may be reviewed by generating the ''Applications Received with Comment Periods Report'' on DEP's website at www.dep.pa.gov/CWPublicNotice.

 Applications, NOIs and draft permits, where applicable, may be reviewed at the DEP office that received the application or NOI. Members of the public are encouraged to use DEP's website to obtain additional information as discussed previously.

 Comments received within the appropriate comment periods for WQM and NPDES permit applications will be retained by DEP and considered in the final determinations regarding the applications. A comment submittal should include the name, address and telephone number of the writer and a concise statement to inform DEP of the exact basis of a comment and the relevant facts upon which it is based.

 DEP will also accept requests or petitions for public hearings on applications. The request or petition must indicate the interest of the party filing and the reasons why a hearing is warranted. A hearing will be held if DEP determines that there is a significant public interest. If a hearing is scheduled, a notice of the hearing will be published in the Pennsylvania Bulletin and a newspaper of general circulation within the relevant geographical area. DEP will postpone its final determination until after a public hearing is held.

Roeco, LLC/CBD Project Management is proposing to develop the eastern part of the stie with a 5-story apartment building containing 197 units, a parking garage, amenity space, driveways, utilities, landscaping and any remaining stormwater management facilities.

 Special Conditions: Sinkholes. The permittee shall notify DEP/CCD immediately by phone if a sinkhole(s) develops on the project site. Within five days following the notification, the permittee shall submit a plan drawing showing the location of the sinkhole(s), photographs, the method of repair, and how E&S and/or PCSM BMPs will be modified as a result, if applicable. Utilization of Subsurface Injection Wells as PCSM BMP.

 1. Construction of Injection Wells.

 a. Water Quality Management (WQM) permit pursuant to 25 Pa. Code § 91.51(a) may be required. Please contact the DEP Bureau of Clean Water in the Southeast Regional Office to determine if a permit is required. If required, the WQM permit application is to be filed with DEP's Bureau of Clean Water, and a courtesy copy should be submitted to Regional Permit Coordination Office. The WQM permit application, accompanying report and supporting documentation is to be completed by the Licensed Professional Engineer and/or Licensed Professional Geologist.

 b. If any changes to the PCSM Plan are needed for consistency as a result of the WQM permit application, including but not limited to sampling stormwater runoff from the building's roof, the permittee shall submit an application to amend this permit to include such changes within 30 days of such changes being made or of receiving a request to make such changes from DEP.

 c. If the WQM permit for this project contains requirements which conflict with requirements identified in the E&S, PCSM, or PPC Plans associated with this permit, the more stringent requirements apply.

 d. The permittee shall provide DEP's Regional Waterways & Wetlands Program, DEP's Regional Clean Water Program and the CCD with five (5) business day advance notice immediately preceding the date when a gravity stormwater injection well will be constructed and tested. This notification shall identify the licensed professional who will be on-site and responsible during the construction and testing of the gravity stormwater injection well. Notification shall be by email, letter, or phone.

 e. Within 30 days of the completion of construction and testing of all gravity stormwater injection wells, the permittee shall submit a report to DEP's Regional Waterways & Wetlands and Clean Water Programs and the authorized conservation district; which includes the following and which shall be provided under the seal and signature of a Professional Geologist, licensed to practice in the Commonwealth:

 (1) A narrative describing the gravity stormwater injection well siting and sizing process.

 (2) Identification of the gravity stormwater injection wells; including specific identification number, which system the well is in, and the physical location.

 (3) The well logs showing the strata, construction details of each of the gravity stormwater injection wells, and the elevation of the soil/bedrock interface.

 (4) The acceptance rate of each of the gravity stormwater injection wells and the actual data, charts, and curves used to determine each gravity stormwater injection well's acceptance rate.

 (5) Calculations confirming that the system will accept the volume of stormwater within the allotted time period as identified in the permit application materials.

 (6) Whether or not the gravity stormwater injection well will be utilized.

 (7) The remaining amount of capacity, if any, which is required to be obtained by the system for full functionality of the proposed gravity stormwater injection well design.

 (8) Identification of site and weather conditions during installation and testing of the wells.

 (9) Any relevant observations/decisions made by the Licensed Professional who was on-site and responsible during the construction and testing.

 (10) The location and label of each Well drilled but not used and abandoned.

 (11) A narrative or log showing abandonment details for each well not used as part of the system.

 (12) A plot plan showing the label and location of all gravity stormwater injection wells, and wells not used and abandoned.

 2. Groundwater Response Monitoring. To assure the gravity stormwater injection well PCSM BMP practice functions as intended, groundwater monitoring, reporting, analyses, and corrective action will be required as follows:

 a. The permittee or co-permittee(s) shall implement the ____ Groundwater Monitoring Program, dated ____ , as prepared by ____ , except as modified in this permit condition.

 b. Groundwater piezometers shall be installed adjacent to all gravity stormwater injection wells. Groundwater monitoring shall commence prior to the use of the stormwater injection wells.

 c. The permittee or co-permittee(s) shall submit a Groundwater Monitoring Report within six (6) months of installation of the first gravity stormwater injection well and then annually thereafter. The report shall be signed and sealed by a Professional Geologist, licensed to practice in the Commonwealth, and contain the following elements:

 (1) Tabulated water elevation and temperature data from the piezometer data logging equipment.

 (2) Summary of observed responses to recharge events, including groundwater flow and epikarst water elevation variations.

 (3) Evaluation of the epikarst capacity to accept the recharge from the storm events observed during the monitoring period.

 (4) Proposed corrective action plan for any locations where recharge capacity has not met design standards or has diminished.

 d. Should DEP determine that a gravity stormwater injection well has not met design standards or is diminished; a corrective action plan must be submitted to DEP within 30 days of written notification and implemented by the deadline specified by DEP.

 3. Groundwater Quality Monitoring. To assure groundwater quality is being maintained and not degraded as a result of the stormwater recharge through the gravity stormwater injection well PCSM BMP, groundwater quality monitoring, reporting, analyses, and corrective action will be required as follows:

 a. The permittee or co-permittee(s) shall implement the ____ Groundwater Monitoring Program dated ____ , as prepared by ____ , except as modified in this permit condition.

 b. At least four (4) property perimeter piezometers and four (4) representative piezometers located within the interior of the site shall be installed prior to installation of the gravity stormwater injection wells. DEP must approve the location of the piezometers.

 c. To establish baseline groundwater quality, the permittee shall sample all piezometers and analyze for the following parameters: pH, total dissolved solids, arsenic, beryllium, cadmium, chromium, copper, lead, mercury, zinc, total suspended solids, total phosphorus, nitrate-nitrogen, nitrite-nitrogen, iron, nickel, manganese, cyanide, calcium, magnesium, potassium, aluminum, sodium, sulfate, alkalinity, chlorides, benzene, total petroleum hydrocarbons, and fecal coliform. At least two (2) baseline samples shall be collected and analyzed prior to the use of the gravity stormwater injection wells. The data from the two (2) baseline samples must be kept for the life of system.

 d. To establish current groundwater quality, the permittee shall sample all identified representative upgradient and downgradient perimeter piezometers and analyze for the following parameters: pH, total dissolved solids, arsenic, beryllium, cadmium, chromium, copper, lead, mercury, zinc, total suspended solids, total phosphorus, nitrate-nitrogen, nitrite-nitrogen, iron, nickel, manganese, cyanide, calcium, magnesium, potassium, aluminum, sodium, sulfate, alkalinity, chlorides, benzene, total petroleum hydrocarbons, and fecal coliform. The frequency of sampling and analysis shall be quarterly from start of construction through the approval of the NOT, semiannually for three years after the approval of the NOT, and annually thereafter. For the parameters: iron, nickel, manganese, cyanide, calcium, magnesium, potassium, aluminum, sodium, sulfate, alkalinity, chlorides, benzene, and total petroleum hydrocarbons, the frequency of sampling and reporting shall be annual.

 e. The permittee or co-permittee(s) shall submit a Groundwater Quality Monitoring Report within six (6) months of installation of the first gravity stormwater injection well and then annually thereafter. The report shall be signed and sealed by a Professional Geologist, licensed to practice in the Commonwealth, and contain the following elements:

 (1) Site map with perimeter piezometer locations, groundwater elevations, and groundwater flow directions shown.

 (2) Identification and justification of the identified representative upgradient and downgradient perimeter piezometers to be sampled that will provide representative water quality information of groundwater flowing onto the site and flowing off of the site.

 (3) Tabularized and graphical summary of groundwater sampling results, including the baseline results. Each report shall include the cumulative results from all sampling.

 (4) An evaluation of the data including trend analysis with a determination of changes and impacts to the groundwater quality resulting from the stormwater recharge, including a determination of whether an adverse impact is projected or existing.

 (5) Proposed corrective action plan to address any projected or existing adverse impact.

 f. Should DEP determine an adverse impact to groundwater exists or is projected to exist, a corrective action plan must be submitted within 30 days of DEP's written notification and implemented by the deadline specified by DEP.

 Project Description: The purpose of the Project is to install a Geosynthetic Clay Liner (GCL) within the secondary tank containment at the Buckeye Pittsburgh Terminal to reduce the permeability of the containment area. The secondary containment consists of a berm that surrounds Tanks 1, 2, 3, 5, 6 and slopes towards a grated catch basin from which stormwater runoff is conveyed through an existing 8" PVC drainage pipe that drains to an existing permitted outfall to the Ohio River. The project will include replacing the existing catch basin with a new one and upgrading a new section of storm sewer that will discharge to said outfall. The upgrade to the containment will include adjustment of the berm height to assure the required containment volume is obtained. The site will then be restored to its preconstruction layout. The project will result in approximately 4.49 acres of disturbance.
