   Permit No. 301303. Wyeth-Ayerst Laboratories, P. O. Box 861, Paoli, PA 19301 was issued a permit to renew their continuing operation of a captive residual waste incineration facility located in East Whiteland Township, Chester County. Operations originally approved under Permit No. 400516 have been renewed in their entirety under Permit No. 301303 and Permit No. 400516 will be revoked. Permit No. 301303 was issued by the Southeast Regional Office on October 9, 1997.

   The Department of Environmental Protection (Department) has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (33 U.S.C.A. § 1341(a)).

   Persons aggrieved by this action may appeal, under section 4 of the Environmental Hearing Board Act (35 P. S. § 7514) and the Administrative Agency Law, 2 Pa.C.S. To reissue and amend Permit No. E46-414 for the extension and maintenance of an existing 10-foot by 5-foot box culvert which exists under Horsham Road (S. R. 0463) and along a tributary to Park Creek. Work also includes:  1.  Extend the Horsham Roadway culvert by 15 feet on the upstream end and 45 feet on the downstream end. 2.  To construct and maintain a concrete retaining wall associated with the culvert's outlet structure. 3.  To extend by 85 linear feet an existing 36-inch R.C.P. stream enclosure. The site is located approximately 434 feet southeast from the intersection of Babylon and Horsham Roads (Ambler, PA Quadrangle N:  13.6 inches; W:  5.9 inches) in Horsham Township, Montgomery County.

   E09-743.  Encroachment Permit. Borough of Doylestown, 57 West Court Street, Doylestown, PA 18901. To improve the North Street stormwater management facilities in and along a tributary to Cooks Run (WWF, MF). This work will include the following:  1.  To remove the existing culverts and enclosures between Swamp Road (S. R. 313) and Fonthill Drive. 2.  To install and maintain stream enclosures consisting of:  a.  851 linear feet of twin 30-inch diameter HERCP stream enclosure and associated swaling, being just downstream from S. R. 313 to point 190 linear feet, upstream from Fonthill Drive. (Roadway culverting described separately). b.  57 linear feet of twin 38-inch by 24-inch HERCP culvert under Chapman Avenue. c.  27 linear feet of twin 30-inch CPP culvert under Mercer Avenue. 3.  To install and maintain 50 linear feet of 6.5 foot by 2.5 foot concrete box culvert under Fonthill Drive. 4.  To modify the stream channel approximately 190 linear feet, upstream from the proposed Fonthill Drive culvert. This project is located approximately 1,400 feet southeast from the intersection of Route 313 and Route 611 (Doylestown, PA Quadrangle N:  13.5 inches; W:  0.3 inch) Doylestown Borough, Bucks County.

Giving its consent to maintain a concrete, open bottom arch stream enclosure having a length of approximately 245 l. f. in Forest Hills Run. This stream enclosure was modified using Emergency Permit No. EP4597401 to authorize pouring a concrete channel along the stream bed to interlock with the existing abutments to prevent further scour of the stream bed and abutments while preserving the structural integrity of the structure. The arch stream enclosure has a span of 8.5 feet and a minimum underclearance of approximately 7.3 feet measured from the top of the 8-inch high concrete fish baffles. The project is located along S. R. 0611, Section 07M, approximately 0.9 mile south of its intersection with S. R. 0940 (Mount Pocono, PA Quadrangle N:  21.0 inches; W:  13.8 inches) in the Borough of Mount Pocono, Monroe County.

   E45-325.  Encroachment. Pocono Property Finders, Inc., R. R. 5, Box 5234, East Stroudsburg, PA 18301. To place fill in a de minimis area of wetlands less than or equal to 0.05 acre for the purpose of constructing a gravel driveway and lawn area for a proposed single family dwelling on Lot 57, Section 1 of Lake of the Pines Residential Subdivision. The project is located approximately 1 mile southwest of the intersection of S. R. 1016 and S. R. 0209 (Bushkill, PA-NJ Quadrangle N:  13.1 inches; W:  6.1 inches) in Middle Smithfield Township, Monroe County.

   E48-244.  Encroachment. Saucon Valley Square L. P., 961 Marcon Boulevard, Allentown, PA 18103. To place fill in approximately 0.18 acre of wetlands for the purpose of constructing a commercial building and widening S. R. 0378 for the proposed Saucon Valley Square Shopping Center. The project is located between S. R. 0078 and S. R. 0378, south of Township Road T411 (West Raders Lane) (Allentown East, PA Quadrangle N:  15.5 inches; W:  1.5 inches) in Lower Saucon Township, Northampton County. The permittee is required to provide 0.10 acre of replacement wetlands onsite and by participating in the Pennsylvania Wetland Replacement Project for 0.08 acre.

   E54-234.  Encroachment. Schuylkill County Commissioners, 401 North 2nd Street, Pottsville, PA 17901. To repair and maintain a concrete arch bridge, County Bridge No. 105, having a span of approximately 100 feet and a maximum underclearance of 10.5 feet across Mill Creek. Repairs consist of the removal and replacement of sidewalks, the placement of riprap along the abutments and minor concrete work on spalled areas. This project is located along Acre Street, 100 feet upstream of S. R. 0209 (Pottsville, PA Quadrangle N:  12.6 inches; W:  5.6 inches) in the Borough of Port Carbon, Schuylkill County.

   E64-179.  Encroachment. Kenneth Love, P. O. Box 147, Narrowsburg, NY 12764. To excavate 0.62 acre of wetlands for the construction of a pond. This project is located along the east side of Township Road T-624 (Atco Road), 0.2 mile north of Township Road T-517 (Mohn Road) (Damascus, PA Quadrangle N:  1.4 inches; W:  11.7 inches) in Damascus Township, Wayne County. The permittee is required to provide 1.24 acres of replacement wetlands to resolve a violation on this previously constructed pond.

   E66-112.  Encroachment. Preston D. Funk, R. R. 2, Box 181F, Mehoopany, PA 18629. To construct and maintain a private footbridge across White Brook having a single span of 26.0 feet and an underclearance of approximately 6.0 feet. The project is located 200 feet upstream from S. R. 3001 (Dutch Mountain, PA Quadrangle N:  22.5 inches; W:  1.0 inch) in Forkston Township, Wyoming County.

   E02-1195.  Encroachment. Ben Avon Borough, 7101 Church Avenue, Ben Avon, PA 15202. To remove the existing bridge, to construct and maintain a metal arch culvert having a span of 15.7 feet and an underclearance of 8.0 feet and to construct and maintain gabion walls on the upstream and downstream sides of the culvert in Spruce Run. The project is located on Spruce Run Road at the intersection of Spruce Run Road and Strugeon Street, Spruce Run Bridge No. 2 (Emsworth, PA Quadrangle N:  1.0 inch; W:  11.0 inches) in Ben Avon Borough, Allegheny County.

   E11-251.  Encroachment. Cambria County Commissioners, Cambria County Courthouse, P. O. Box 269, Ebensburg, PA 15931. To remove the existing structure, to construct and maintain a 1-foot depressed 22.0-foot x 7.0-foot concrete box culvert in Little Conemaugh River, to construct and maintain an outfall channel downstream of the proposed culvert, to place and maintain R-7 rock riprap along the banks of Little Conemaugh River for a distance of 50.0 feet upstream and 62.5 feet downstream of the proposed culvert for bank stabilization and to place and maintain fill in 0.1 acre of wetlands for the purpose of widening T-434. This permit also authorizes 0.16 acre of replacement wetlands adjacent to the project area. The project is located on T-434, Station 14+44.44 (Cresson, PA Quadrangle N:  10.8 inches; W:  17.1 inches) in Washington Township, Cambria County.

   E11-252.  Encroachment. Cambria County Commissioners, P. O. Box 269, Cambria County Courthouse, Ebensburg, PA 15931. Remove the existing structure, to construct and maintain a single span bridge having a normal span of 84.7 feet and an underclearance of 11.5 feet across North Branch Blacklick Creek and to place and maintain fill in a de minimis area of wetlands less than or equal to 0.05 acre for the purpose of improving transportation safety and roadway standards. This permit also authorizes the construction and maintenance of a temporary roadway crossing consisting of nine 60-inch corrugated metal pipe culverts in North Branch Blacklick Creek at a point approximately 110 feet downstream from the proposed bridge for the purpose of accommodating local traffic during construction. The project is located on T-498, Station 24+42 (Colver, PA Quadrangle N:  11.1 inches; W:  15.1 inches) in Blacklick Township, Cambria County.

   E56-278.  Encroachment. Somerset County Commissioners, 111 East Union Street Ste. 100, Somerset, PA 15501. To remove the existing structure and to construct and maintain the New Baltimore Covered Bridge. The proposed structure is a single span bridge having a normal span of 72.0 feet and an average underclearance of 6.6 feet across the Raystown Branch of the Juniata River located on Town Hill Road (T-813) (New Baltimore, PA Quadrangle N:  20.3 inches; W:  3.2 inches) in Allegheny Township and New Baltimore Borough, Somerset County.

   E63-066-A1.  Encroachment. Dredge Docks, Inc., 1231 River Avenue, Pittsburgh, PA 15212. Giving its consent to amend Permit No. E63-066 to extend and maintain the existing barge mooring facility an additional 175.0 feet in the channel of and along the left back of the Monongahela River (WWF) for the purpose of improving the existing facility. The project is located near River Mile 39.0 (Monongahela, PA Quadrangle N:  7.1 inches; W:  0.4 inch) in Carroll Township, Washington County.

   E63-426.  Encroachment. PA Turnpike Commission, P. O. Box 67676, Harrisburg, PA 17106-7676. To remove existing structures, to construct and maintain four culverts in various unnamed tributaries to Peters Creek (TSF); to construct and maintain a bridge having a span of 43.4 feet and an underclearance of 7 feet across Peters Creek (TSF); to relocate and maintain nine channel relocations in Peters Creek and its tributaries, Huston Run and its tributaries and an unnamed tributary to Mingo Creek (TSF); to place and maintain fill in two nonjurisdictional dams; to place and maintain fill in 0.32 acre of six wetlands (PEM); and to place and maintain fill in two nonjurisdictional ponds located at Station 1292+30 and 1301+00. The work is being done in conjunction with the construction of the Mon/Fayette Expressway (S. R. 0043), Construction Section 52H, consisting of a four lane limited access, divided toll highway. This construction section begins off of Finleyville Elrama Road and ends approximately 1,500 feet north of Gill Hall Road (project starts at Monongahela, PA Quadrangle N:  18.1 inches; W:  15.4 inches and ends at Glassport, PA Quadrangle N:  2.5 inches; W:  14.6 inches) in Union Township, Washington County. The wetland replacement was approved under PA DEP Permit No. E02-1132.

   E63-433.  Encroachment. Gustine Washington Associates, Ltd., Birmingham Towers, 2100 Wharton St., Ste. 700, Pittsburgh, PA 15203. To place and maintain fill in approximately 0.35 acre of wetlands associated with an unnamed tributary to Chartiers Creek for the purpose of constructing the Strabane Square Development. The project is located on the east side of Old Manifold Road at the intersection of 19 and S. R. 70-79 (Interchange 7) (Washington East PA Quadrangle N:  11.6 inches, W:  14.0 inches) in South Strabane Township, Washington County. This permit also authorizes the construction of 0.55 acre of replacement wetlands.

   E65-657.  Encroachment. The Municipal Authority of the Borough of Smithton, P. O. Box 350, Smithton, PA 15479-0350. To construct and maintain a sanitary sewage treatment facility along an unnamed tributary to the Youghiogheny River. Project includes construction of 11,000 l. f. of sanitary sewers; a wetland crossing, a discharge outfall below normal pool elevation of the Youghiogheny River and to relocate and maintain 113 feet of an unnamed tributary to the Youghiogheny River located along S. R. 981, west of the intersection of S. R. 981 and T-372 (Smithton, PA Quadrangle N:  5.7 inches; W:  16.5 inches) in Smithton Borough, Westmoreland County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E65-673.  Encroachment. Hannastown Golf Club, 121 Blank School Road, Greensburg, PA 15601. To place and maintain fill in and along 2,810 feet of an unnamed tributary to Jacks Run, to place and maintain fill in 0.5 acre of wetlands (PEM, PSS) and to construct and maintain three separate culverts in an unnamed tributary to Jacks Run. Culverts A and B consist of single 38-inch x 60-inch elliptical concrete pipes. Culvert C consists of two 34-inch x 53-inch elliptical concrete pipes in an unnamed tributary to Jacks Run. This permit also authorizes 0.62 acre of replacement wetlands (PEM, PSS) onsite. This work is part of the construction of a 9-hole golf course expansion of the existing Hannastown Golf Club. The project is located off of Union Cemetery Road (T-798) (Greensburg, PA Quadrangle N:  14.0 inches; W:  4.5 inches) in Hempfield Township, Westmoreland County.

   E32-388.  Encroachment. Ronald J. Stewart, R. R. 1 Box 133, Marion Center, PA 15759. Construct and maintain a 100-foot x 60-foot convenience store/garage building in the 100-year floodway of an unnamed tributary to Pine Run for the purpose of replacing the previous structure destroyed by fire at this location. The project is located on SR 403 (Marion Center, PA Quadrangle N:  3.4 inches; W:  6.75 inches) in the Borough of Marion Center, Indiana County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E63-432.  Encroachment. Craig and Cindy Fox, 645 Duncan Avenue, Washington, PA 15301. Operate and maintain the existing bridge having a span of 12.0 feet with an underclearance of 6.0 feet (constructed under Emergency Permit No. EP6397202) across an unnamed tributary to Georges Run to provide access to applicant's property. The bridge is located approximately 900 feet west from the intersection of S. R. 4035 and S. R. 0018 (Washington West, PA Quadrangle N:  16.4 inches; W:  5.3 inches) in Canton Township, Washington County. This permit was originally published as an application under Permit Application No. E63-422. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.

   E63-438.  Encroachment. Pennsylvania Department of Transportation, P. O. Box 459, Uniontown, PA 15401-0459. Remove the existing bridge, to construct and maintain a spread box beam bridge having a normal span of 25.0 feet and a minimum underclearance of 5.8 feet over a tributary to Peters Creek (TSF). This project is located along S. R. 1006 (Washington Avenue) approximately 1,500 feet east of its intersection with S. R. 0088 (Glassport, PA Quadrangle N:  0.8 inch; W:  16.9 inches) in Finleyville Borough, Washington County. This permit was issued under section 105.13(e) Small Projects. This permit also includes 401 Water Quality Certification.
