FEDERAL WATER POLLUTION CONTROL ACT SECTION 401

 The Department has taken the following actions on previously received permit applications, requests for Environmental Assessment approval and requests for Water Quality Certification under section 401 of the Federal Water Pollution Control Act (FWPCA) (33 U.S.C.A. § 1341).

 Except as otherwise noted, the Department has granted 401 Water Quality Certification certifying that the construction and operation described will comply with sections 301—303, 306 and 307 of the FWPCA (33 U.S.C.A. §§ 1311—1313, 1316 and 1317) and that the construction will not violate applicable Federal and State water quality standards.

 Persons aggrieved by an action may appeal that action to the Environmental Hearing Board (Board) under section 4 of the Environmental Hearing Board Act and 2 Pa.C.S. §§ 501—508 and 701—704.  To perform the following water obstruction and encroachment activities associated with Bridgeport Front Street Relief Interceptor Relocation project within the floodway of the Schuylkill River (WWF, MF):

 1) To install and maintain approximately 9,123 LF of pipeline consisting of 1,777 LF of 24" PVC, 2,731 LF of 24" DIP, 2,205 LF of 54" DIP, 365 LF of 60" DIP, and 2,045 LF of 64" DIP.

 2) To construct and maintain two outfall structures discharging into the Schuylkill River and the Bridgeport canal.

 3) To modify and maintain the headwall of an existing outfall structure to facilitate the excavation work.

 4) To construct and maintain a culvert across an unnamed tributary to the Schuylkill River at approximately Station 25 + 00.

 The project commences at the intersection of Front and 2nd Streets. It runs toward the east and ends where 4th Street (S.R. 0023) intersects Jefferson Street in Bridgeport Borough, Montgomery County (Norristown, PA USGS Quadrangle N: 19.12 inches; W: 11.57).

 To construct and maintain a 10.16-foot wide, five-span pedestrian bridge having a normal span of 683.92 feet, a skew of 90°00`00", and a minimum underclearance of 21.67 feet over the Juniata River (WWF, MF) for the purpose of maintaining pedestrian foot traffic between Mifflin and Mifflintown Boroughs. The proposed bridge will be located in the footprint of the existing SR 0035 bridge (Mifflintown, PA Quadrangle; N: 12.66 inches, W: 3.47 inches; Latitude: 40°34`11.0", Longitude: -77°23`59.9"). This permit also authorizes the construction and maintenance of a public boating access which will be located approximately 50.0 feet upstream of the proposed SR 0035 traffic bridge along the west bank of the Juniata River (WWF, MF) (Mifflintown, PA Quadrangle; N: 12.05 inches, W: 3.52 inches; Latitude: 40°33`57", Longitude: -77°24`1.3") in Mifflin and Mifflintown Boroughs and Fermanagh, Milford, and Walker Townships, Juniata County; and the construction and maintenance of temporary causeways in the Juniata River (WWF, MF). The amount of wetland impact is considered a deminimus impact of 0.01 acre and wetland mitigation is not required. To compensate for unavoidable stream impacts, the permittee proposes to install three rock-tail pier structures on the three western most bridge piers.

E34-129: Pa. Department of Transportation, Engineering District 2-0, 1924 Daisy Street, PO Box 342, Clearfield, PA 16830, ACOE, Baltimore District

 To remove the existing structure and to construct and maintain a 43.46-foot wide, five-span bridge having a normal span of 708.1 feet, a skew of 80°00`00", and a minimum underclearance of 17.7 feet over the Juniata River (WWF, MF) for the purpose of improving transportation safety and roadway standards. The proposed bridge will be constructed approximately 1,500.0 feet downstream of the existing structure (Mifflintown, PA Quadrangle; N: 11.96 inches, W: 3.52 inches; Latitude: 40°33`57", Longitude: -77°24`1.3") in Mifflin and Mifflintown Boroughs and Fermanagh, Milford and Walker Townships, Juniata County. The project will involve the use of temporary causeways in the Juniata River (WWF, MF) and the temporary storage of construction materials within the 100-year floodplain of the Juniata River (WWF, MF). To compensate for unavoidable stream impacts, the permittee proposes to install two rock-tail pier structures on the center piers of the bridge.

Northcentral Region: Watershed Management Program Manager, 208 West Third Street, Williamsport, PA 17701, 570-327-3636

 To construct, operate and maintain a commercial development associated with the natural gas industry within the Mill Creek watershed (Cold Water Fishery, MF, Wild Trout). Construction of the development will require one (1) stream outfall and impact 0.58 acres of jurisdictional exceptional value wetlands. Replacement wetlands, 0.59 acres will be built on site. In addition, the permit applicant also has met the wetland replacement requirement by participating in the Pennsylvania Wetland Replacement Project. The development is located 0.2 miles east of Canton Borough, on the north side of SR 0414, prior to crossing Mill Creek.

 To perform the following water obstruction and encroachment activities associated with abandoned mine reclamation.

 This project will replace existing undersized culverts at Caroline Avenue and Eagle Hill Road and an undersized 48 inch concrete pipe downstream of Eagle Hill Road to carry a 10 year 24 hour storm flow volume from the project site. At Caroline Avenue the two 24 inch concrete pipes will be replaced with a 53 inch by 83 inch horizontal elliptical pipe. At Eagle Hill Road the two 30 inch concrete pipes will be left in place and two 42 inch concrete pipes will be added to carry the extra flow a short distance west of the existing pipes. The undersized 48 inch concrete pipe downstream of Eagle Hill Road will be replaced with a 53 inch by 83 inch horizontal elliptical concrete pipe. This will allow the site runoff water to travel to Mill Creek.

Request for Comments on the Proposed Total Maximum Daily Loads (TMDLs) Developed for the Boles Run Watershed in Erie and Crawford Counties Pennsylvania

 The Department of Environmental Protection will accept comments on the proposed TMDLs developed for the Boles Run Watershed in Erie and Crawford Counties, PA. These TMDLs were established in accordance with the requirements of Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included impaired stream segments in this watershed. The listings of these waterbodies were due to use impairments caused by excessive siltation from agriculture and road run off.

 There currently are no state or federal instream numerical water quality criteria for siltation. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. These proposed TMDLs set allowable loadings of sediment in the Boles Run Watershed. The sediment loadings were allocated among cropland, hay/pasture land, unpaved roads and stream bank categories present in the watershed. Data used in establishing these TMDLs was generated using a water quality analysis model (AVGWLF) designed by the Pennsylvania State University.

 The following table shows the estimated current sediment loadings for the watershed. Overall load reductions necessary in order to meet the TMDLs are also identified.

 The Department will consider all comments in developing the final TMDLs, which will be submitted to EPA for approval. Written comments will be accepted at the above address and must be postmarked by 45 days after publication in the PA Bulletin. A public meeting to discuss the technical merits of the TMDLs will be held upon request.

Request for Comments on the Proposed Total Maximum Daily Loads (TMDLs) Developed for the UNTs French Creek Run Watershed in Crawford County Pennsylvania

 The Department of Environmental Protection will accept comments on the proposed TMDLs developed for the UNTs French Creek Run Watershed in Crawford County, PA. These TMDLs were established in accordance with the requirements of Section 303(d) of the Clean Water Act. The Pennsylvania Integrated Water Quality Monitoring and Assessment Report included impaired stream segments in this watershed. The listings of these waterbodies were due to use impairments caused by excessive siltation.

 There currently are no state or federal instream numerical water quality criteria for siltation. Therefore, the Department utilized a reference watershed approach to implement the applicable narrative criteria. These proposed TMDLs set allowable loadings of sediment in the UNTs French Creek Run Watershed. The sediment loadings were allocated among cropland, hay/pasture land and streambank categories present in the watershed. Data used in establishing these TMDLs was generated using a water quality analysis model (AVGWLF) designed by the Pennsylvania State University.

 The following table shows the estimated current sediment loadings for the watershed. Overall load reductions necessary in order to meet the TMDLs are also identified.
